Hi Liz and others,
We did a little research on the Federal Dept of Ed to see if they had regulations themselves (like the State Bd of Ed) on the implementation of NCLB Section 9528. Since the military is challenging forms that separate military and colleges, we wanted to see if that was specified in a regulation of the government.
Here is the website: http://www.ed.gov/news/pressreleases/2002/10/mrguidance.html which is a Q & A from the federal government on the implementation, but it does not refer to any regulation of enforcement. More research has to be done, but it makes no mention of this point, which is being used to intimidate districts into changing their forms.
Now that I see that it was the military who came to your school and not the Dept of Ed, perhaps we need to do research on their regs since their is a separate law § 544 of the National Defense Authorization Act for Fiscal Year 2002 (P.L. No. 107-107), that says the same thing but that might be regulated by the military or Dept of Defense instead of the DOE..
We will look into it further tomorrow.

This may be off topic, well, its on topic. but its sort of random, but today we (Alissa and I) were talking to our principal. He told us that the military has challenged our policy and that the school laywers were reviewing our form, becuase it seperated education and military, allowing you to opt out of one or another. I know our school board resolution includes this. I don't know if this will cause problems with the state school board now as well. Maybe theres a lawyer we could get in touch with ourselves to ask about it? Any way. Just a thought so that were prepared if the state school board brings this up
