"Sin, to one who loves God, is nothing other than an arrow from the enemy in
battle. The true Christian is a warrior fighting his way through the regiments
of the unseen enemy to his heavenly homeland. According to the word of the
Apostle, our homeland is in heaven; and about the warrior he says: 'our warfare
is not against flesh and blood, but against principalities and powers.'"

St. Seraphim of Savov.

Sub: Kolenchery Issue
Fr. Dr. John's Abraham Konat (Priest Trustee)
After the intervention of the High Court on 30th it has become clear
that the court is not going to give any interim relief in the
Kolenchery issue. The case has been posted on 2nd November for hearing
of the appeal. The court suggested trying mediation. It is clear that
one of the reasons why the court did not interfere on 30th was the
fact that the Government had taken a stand to solve the issue in 15
days. The Patriarch’s faction is continuously asking for mediation
efforts. The Orthodox Church has never turned its back on mediation
efforts. But let me just remind all the readers something which
happened during the argument in the supreme court in 1995. Justice R.
N. Sahai one of the three judges describes the incident as follows.

“ When hearing of these appeals commenced it was felt both at the
outset and in the midst that if both parties agreed, the dispute could
be referred to some high-powered committee of religious authorities.
But probably the issue being less religious and more legalistic and
technical, both the parties through their counsel reposed confidence
in this court and entreated the Bench to bring an end to this
litigation. Therefore, now after dealing with various legal matters
which could not have probably been satisfactorily resolved it is
appropriate to declare that…..” (Judgment page No. 165-166. This is
not his opinion but he is describing an incident which happened in the
court.)
Once again the inconsistency of the demands of the Patriarch’s
faction is exposed in these words. They themselves had told the
Supreme court that they have confidence in the verdict of the court
and they are not ready to entrust the matter to some other
high-powered committee. But now they say that the problem cannot be
resolved through court verdicts; the problem can only be solved
through mutual negotiations. In the Kolenchery issue, they themselves
approached the court and when the verdict of the court is against them
they are not ready to accept it. When we begin the negotiations with
the cabinet sub-committee, we don’t forget that we already have a
bunch of agreements which were never respected by the Patriarch’s
group.

"Upon awakening, first give praise to God and, having asked His intercession,
begin your most important work, that is, to pray in the heart, purely and
without distraction...We are commanded to bring the first and best as offering
to God, that is our first thought which we must direct straight to our Lord
Jesus Christ in a pure prayer of the heart..."

With our minds made prudent and holy, we offer worship to that which lies hidden
beyond thought and beyond being. With a wise silence we do honor to the
inexpressible. We are raised up to the enlightening beams of the sacred
scripture, and with these to illuminate us, with our beings shaped to songs of
praise, we behold the Divine Light.

Spiritually Minded Cross Messages

"To be carnally minded is death; but to be spiritually minded is life and
peace." Romans 8:6

Fr John Brian uses the timing of Meskel, the Ethiopian festival of the
cross, to talk about the spirituality of the cross.

This sermon uses and refers to scripture readings appointed by the Syrian
Malankara calendar and was give on Sunday, October 02, 2011 by Fr. John Brian
Paprock at Holy Transfiguration Orthodox Mission Chapel, Madison, Wisconsin.

"We have this treasure in earthen vessels, that the excellency may be of the
power of God and not of us." 2 Corinthians 4:7.

"For just as those who were freed by Moses from slavery in Egypt sang to the
Lord a triumphant song after the crossing of the Red Sea and the drowning of
Pharaoh's army, so it is fitting also for us to render worthy thanks for
heavenly benefits after receiving the forgiveness of sins in baptism."

Sam is spot on. In fact if you go back in history, the Malankara Church was
formed by St.Thomas & from then on it were the East Syriac bishops who
frequented Malankara. West Syriac bishops started visiting later as at one point
of time, two Patriachs of both the denominations(West & East Syriac) operated
out of Babylon.
In fact, had not the portugese come to Malankara, we would have been with the
Assyrian Syrian Churh today & not the SOC.
We should therefore not fall for the dubious arguements of some of our friends
on the other side portraying the SOC as the guardian angel of Malankara. I will
even go to express that what the Universal SOC has gained from Malankara is far
more than what we got from them simply because, the church in Syria minor, Iraq
minor & Turkey minor is virtually non existant today.
Hopefully one day, our Malankara Metropolican will head the Syrian Church
worldwide.
Proud to be an Indian

Dear Geogy Abraham
You are totally Ignorant and misguided by stating as you wrote that IOC only 100
years old and Soc is 2ooo years old!MOSC/Ioc exists from A.d.52! St.Thomas as a
fully ordained disciple of Jesus Christ had all authorities like St.Peter!
There is no need for MOSC to compromise due to mere allegations from JSCC!
A.D.345 onwards there were no SOC In MALANKARA! Knanaya people are not send here
in Malankara by SOC or Antioch Patriarch in A.D.345!
We all know the presence of SOC people in Malankara when and how!
Kolechery's Spiritual head was not appointed by St.Peter or his successors!
It is not the issue of Majority here in Kolenchery! It is the Issue of exexcution
of Court ruling/decree!Do not try to conceal the truth as a self style image of
a pretended peacemaker!

*Beloved Members,*

Hope you are doing well. we would like to submit a request for* Orthodox TV
(24x7) live web Streaming Channel*. We have launched the Orthodox TV web
Channel *(
<http://ww.indianorthodoxradio.com/><http://ww.indianorthodoxradio.com/>
www.orthodoxtv.in)* on July 3rd 2011 by using the new generation mobile and
web technology. Although today Cell phones certainly have come a long way
and they’re still evolving, the latest telecommunications technology is 4G.
Fourth Generation System promises a wide range of personal mobility features
using multimedia-like 3G and 4G phones, which is going to make a great break
through for the new generation. Some of the Churches in India & USA have
already started using this media, as the best way to catch our new
generation.

Our humble prayer is that, *The Malankara Orthodox Church should use this
new generation technology by putting together our clergy, scholars and
works, and they maybe able to, present a complete picture of the works of
the Orthodox Church across the world.* Orthodox TV applications were found
to be a practical method, to bring the messages to a larger audience.

Orthodox TV Apps seeks to deepen and enrich the faith of Orthodox Christians
around the world with streaming audio-Video programs. Users will be allowed
to watch online TV on their, Television (USA & Canada), Computer, web

"Just as it is impossible for fish to live outside of water, a human being
cannot walk without feet or see light without eyes or speak without a tongue or
hear without ears. So also without the Lord Jesus and the working of divine
power, no one can know the mysteries and the wisdom of God or be rich and be a
Christian."

"Let the weakest, let the humblest, remember that in his daily course he can,
if he will, shed around him almost a heaven. Kindly words, sympathizing
attentions, watchfulness against wounding men’s sensitiveness - these cost
very little, but they are priceless in their value. Are they not almost the
staple of our daily happiness? From hour to hour, from moment to moment, we are
supported, blessed, by small kindnesses."          F. W. Robertson,

"I would rather live my life as if there is a God and die to find out there
isn't, than live my life as if there isn't and die to find out there is"
Albert Camus quote

Perfection

The relatively perfection union with God which is possible in this world,
consisting in proportional to the degree of charity possessed and exercised: it
is therefore compatible with venial sin, but not mortal sin. "The perfection of
Christian life consists essentially in charity, primarily in loving God,
secondarily in loving ones neighbor."
(Saint Thomas Aquinas). When a man loves God with his whole heart, soul, mind
and straight, and his neighbor as himself for God's sake, then is he perfect.
The perfection attainable in this life is only relative and progressive;
absolute and ultimate perfection belongs to the next life, when the creature
will have definitely gained his last end, God Himself, in the Beatific Vision.
The attachment to God by love which perfect demands involves as its counter
detachment from all that hinders or diminishes  that love. Hence the way of
perfection is a way of renunciation and mortification.

Perfection is open to all, because the full love of God is possible in any walk
of life; and all are called to it, at least remotely, in the words of Jesus
Christ: (Matt. 5:48)--the calendar of saints includes men and women of all types
and all nations. But the religious life is more conducive to perfection than
life in the world, because it concentrates definitely on this aim by means of
the vows of religion and organized prayer and asceticism. Perfection demands the
observance of the precepts and of such counsels as apply to ones state of life.
The essence of perfection, therefore, does not consist in a multiplicity of
devotions, confraternities, etc: nor even in austerity, solitude, silence, and
virtuous exercises. All these are means of acquiring perfection, or are
manifestations of its presence.

How to Become a Saint

The way Saints are made outside the cloister as well as in. It can be expressed
in three words: Fidelity to conscience..
All those who are saved eternally will be saved of their fidelity to conscience.
The only thing you need to do in order to become a Saint is obey your
conscience, and God will do the rest...Begin today; and see what a wonderful
change it will make in your life. Every time your conscience prompts you to
good, do it: every time it tells you a thing wrong, don't do it. The chief
difference between saints and ordinary Christians is simply this, that they
always obey the slightest suggestion of the still, small voice, while others do
not. This is what St. Paul meant when he said. "Extinguish not the Spirit;" for
conscience is like a flame, which may be blown out by willful inattention, and
thus man is left, without a guide, to walk in the dark.
In such a condition it is utterly impossible to remain long upon the narrow path
that leads to the kingdom of heaven.

A Man cannot Save Himself by his own good works

Good works prompted by purely natural motives cannot save a man. Thus St. Paul
says, If I should give all my goods to feed the poor, and have not charity, it
profiteth me nothing."  1 Cor. XIII., 3. yet good works inspired by faith in
Christ and love for Christ are necessary.  "By works a man is justified, and not
by faith only." James II.,24. Indeed the "Son of man will come in the glory of
His Father....and then will He render to every man according to his works."

"Now He commanded men to be poor in spirit, and such He calleth blessed and
worthy of the kingdom of heaven. Again He chargeth us to mourn in the present
life, that we may obtain comfort hereafter, and to be meek, and to be ever
hungering and thirsting after righteousness: to be merciful, and ready to
distribute, pitiful and compassionate, pure in heart, abstaining from all
defilement of flesh and spirit, peacemakers with our neighbors and with our own
souls, by bringing the worse into subjection to the better, and that by a just
decision making peace in that continual warfare betwixt the twain; also to
endure all persecution and tribulation and reviling, inflicted upon us for
righteousness' sake in defence of His name, that we may obtain everlasting
felicity in the glorious distribution of His rewards."

Dear Abraham Uthup
There are people who twists the facts or concealing the truth behind the facts!
Jesus Christ did not ordain /appoint St.Peter as his successor or sole authority
as his only shepherd to lead the Church from the day of Pentecost!
the Church feud in Malankara was initially originally created by Antiocheans or
SOC heads of Antioch! They tried to make a colony of theirs here like the
British! Now the Kolenchery church issue also exaggerated by Jacobites in
Malankara for their own material wealth and possessions!
They(jacobites) went to courtfor petition and court made its ruling! Instead of
honoring the ruling or court decrees/verdict, they want to now Referendum and
right to handle/govern Kolenchery church on dubious as well as baseless and
untrue basis!
It was not Disciples of Christ who sought and follow him( Christ)! Christ
followed them and selected/and appointed them as his apostles!
so there is no need of referendum in court rulings /decrees!
On Ayodhya issue the majority of Hindus in India respected the court ruling/
verdict/decree!
As true Christians H.B.Thomas I group should also follow similar way!

Best regards

"Since the Logos of God though His descent to us has brought the kingdom of
heaven close to us, let us not distance ourselves from it by leading an
unrepentant life. Let us rather flee the wretchedness of those who sit `in
darkness and the shadow of death' (Isa. 9:2). Let us acquire the fruits of
repentance: a humble disposition, compunction and spiritual grief, a gentle and
merciful heart that loves righteousness and pursues purity, peaceful,
peace-making, patient in toil, glad to endure persecution, loss outrage, slander
and suffering for the sake of truth and righteousness. For the kingdom of heaven
or, rather, the King of heaven - ineffable in His generosity - is within us (cf.
Luke 17:21); and to Him we should cleave through acts of repentance and patient
endurance, loving as much as we can Him Who so dearly has loved us."

While on earth, we only can assume that it is like a journey through the fog
that hides everything around.
As the great poets Shelly and T.S. Eliot have confessed, "poetry is not a
creation, but a revelation", so also religion and spiritual outputs are the
`spontaneous outflow of powerful feelings" (W.
Wordsworth) from a vibrating and fluttering medium. It happens only when we
become a medium of the spirit or the H. Spirit. When "Soul After Death" is read,
we realize that Jesus wrote the Pauline epistles for him, so also St. Paul
dictated the religious or spiritual food to the golden-tongued Mar Evanios or to
another Bishop; I don't remember the name correctly. Eph 2: 11-22 is that Christ
has destroyed the wall that separated by the hostility, the outcome of Adam
eating the forbidden fruit, and Jesus uniting the redeemed ones by deleting the
old covenants and statutes and making a second covenant meant for all races,
Heb.8:7-13.
I wrote it emphatically that the gulf between the 3 celestial regions do exist,
so also the different zones in the planes of hell. Even the `Soul after death'
testifies that our continual supplication and oblation for the condemned ones
will be heard and restituted for those who are in darkness also. Our
Osthathios thirumeni also says that there is no permanent hell for the condemned
ones. We don't have enough proof to authenticate such claims because we live it
to the Lamb who saved us by spilling His blood. If their punishment is not for
an everlasting time, we may have to believe the concept of the reincarnation
concept that bring the soul back to earth and start all over again for a
spiritual metamorphosis. If that is so, another Eden and a forbidden fruit which
make another aeon is a wrong Christian teaching. Then it comes to the Hindu
teachings of various eons that rotate in circles again and again.

My question is whether those who have come into Paradise, whether all will be
taken to Eternity after the Last Judgment. "Blessed are the dead who die in the
Lord henceforth…that they may rest form their labours, for their deeds follow
them", Rev.14: 13. It means that they may stop toiling and moiling, but may
continue their deeds which battery charge their spiritual life for a higher
place in Eternity. Read Rev.20: 4-5. Those who were beheaded, possibly during
the tribulation period, for Christ, lived for 1, 000 years in Paradise with the
Lord. This is the first resurrection. The rest of the dead didn't come to until
the 1, 000 years were ended for a 2nd resurrection period for Last judgment. It
is thus validated in praying to the virgins, saints, who live with the Lamb for
our salvation, Rev.7& 14. Christ took the repented thief to the Paradise, the
place of the first fruits for the Lamb and God, Rev.14: 4, not for the good
departed people who wait for the judgement, proving that the mid-air plane
Paradise also may have some divided areas. It is, therefore, our duty to pray
for the rest of the departed till the 2nd resurrection, that is the last
judgement. The gulf between the virgins, Rev. 14, and the rest of the dead who
wait for the last judgement may remain till the last judgement also, the reason
for us to pray only to the departed saints for our sake, not to all the dead
ones whose fate is yet to be decided upon. We can pray to Father Abraham, but
not to the rich man whose fate is still not decided permanently. He, the rich
man, may pray for us and we can pray for him, but not to him for our salvation.
We are allowed to pray to the saints who are, therefore, officially declared by
the church, but the spiritual hierarchy of today asks us to pray to all our
departed ones for our sake. Even there may a separation of positions or roles,
as there are great and small in the Kingdom of God, mt.5: 19. These are likely
hypotheses because the mystery of death, resurrection and eternity is a
forbidden fruit that we are not allowed to be fiddled with or penetrated into
now by our imaginative interpretation, while man remains as a mystery unknown to
himself even.

The love of God is certain that He is a just God who punishes the evil at the
time of the last judgement and segregate between the good and evil, sheep and
goat. This earth will disappear, Rev.20: 11, and a bottomless gulf remains
between the good and evil. God loves the repenting sinner while he is in his
flesh, and may be thereafter till the last interrogation, but not beyond that,
Rev.22: 15. We don't know about another kind of rebellion by a different Lucifer
wage in New Jerusalem which invite another cleansing by another Eden tragedy
which pave for another aeon of the Hindu yogic `yuga'. However, man is worth
only for a breath; he can't postulate what happens next moment. The belching of
lava fire is a prologue of the lake of sulphur fire and `they will be tormented
day and night for ever and ever' there, Rev.20: 14. The beast and the false
prophet, the church of women's deity during the time of anti-christ, Dan. 11: 37
are thrown into such sulphur fire before 1000 years than the dragon that
deceived in Eden was hurled into thereafter 1, 000 years, Rev.20: 10. If one
wants to know about this gulf of 1, 000 years, I am ready to cerebrate upon if
somebody is eager to know.

Dear Sam

It is a matter of grave concern that a whole generation of the faithful have
been mislead & viciated by the leadership of the Jacobite church. It makes me
sad because these faithful are our brethren. May good sense prevail.
The defamatory language of most of their bishops(many of them in their mid
thirties who won't even become parish priests in the MOSC) borders on
extremism. God alone knows what the future has in store for them with such
immature high priests leading them.
The icing on the cake came today with the malayalam channels in kerala
broadcasting news about the CBI decieding to question their HB Thomas-1 in
connection with the Malankara Varghese murder case. What more do you want to
hang up your heads in shame.
May our mislead brethren come back to their mother church.

Dear All
None of the Malankara Nazranis at Kolenchery belongs to Antioch Patriarch or
Syrian tradition of Antioch!Antioch Patriarch or his representatives did not
come in Malankara to preach gospel nor they have any community of syrian
christian(antioch) living here in Malankara!
Malankara church is not an arch diocese of Syrian orthodox church of Antioch! Do
not make allegations or doubts in the minds of ordinary believers! The
Representative of H.H. Zaka made an allegation recently that Jacobites of
Malankara are persecuted by IOC which are purely lies and unchristian statement
by the representative
When certain man approached Jesus Christ to end his dispute in family share of
wealth the response Jesus made must be remembered here! Now Jacobites are seeking
help from Oriental orthodox family members to support them in getting possession
ansd properties legally belonged to MOSC!

Dear believers,
The church schemes new ventures that electrify the church population together
and dictates its own agenda of misleading or making a cat and mouse chase, so
that it can survive by identifying within the gamut of social or secular or
political system. The main agenda of the church is to cater spiritual foods to
its members. If it falls short of or over-feed with junk food, either it makes
spiritual anemia or so-called spiritual obesity, the leavened bread of the
Pharisees and Sadducees. Human beings are equal, but individuals are not.
Whenever we start or which ever way we start education or anything else, the
underlying factors for the successes in life varies in accordance with the
genetic factors, the conditioned reflexes, natural or environmental influences
to an extent and over above all is by the blessings of God. If `vijaya Dasami'
is an auspicious day, let us do it as we did before by a `guru' of any caste,
religion or creed because it doesn't involve any sacramental role. `Vijayam' or
earthly success by hook or by crook is the likely aim of today's education, `not
knowing thyself' of the role of the past. Some of our church hierarchical
members that advocate in worshipping God by being in any religion has imparted
with a new spiritual culture are the lodestars of the day. We organize
interchurch and inter-faith conferences and meetings which flourish ecumenism in
its heyday. Many previous pagan influences like birthday, wedding day, Gandhi
Jayanthi, Onam, ottam thullal and many such elements which our Fathers never
have dreamt of are the lifeblood that youngsters adore with and are encouraged
by the religious hierarchy. Why should we have to do vidayarambam, in unison
with, on the same day by the church hierarchy? It gives employment opportunities
for the clerical members to dangle with temporal profligacy because spiritual
education has become an anachronism to the post-religious church administration
and religious life. Filtering the mosquito and swallowing the elephant is the
spiritual ethos of the church that betrays Jesus. These are the nails that we
strike at the body of Jesus, just as the Bethesda cripple, Jn.5, who was saved
by Jesus pierced Jesus on the cross, as tradition notes, because he lost his
earnings that he got by begging, which he didn't have to labour for. The
multi-betrayal strategy of the church that monopolises in all our private life
is an encroachment to our personal freedom. They control us and demand money for
everything is a monopoly of the church which sees that women are also in the
work force. Therefore, this way of grabbing money from the faithful is a
lucrative business without any physical labour.
I feel ashamed of by witnessing that the priesthood has degenerated to this
extent of showering flowers during wedding receptions, singing secular or social
birthday wishes and immersing the fingers in the rice grains for Vidyarabam. The
clerical tongue that is the key to the doors of heaven and the fingers which
prepare the liturgical food are misused for the wrong purposes of appeasing the
faithful for craving for the lust of life. As the church hierarchy embraced the
culture of birthday and wedding day celebration, the Saturday evening that has
become the only sparable day for the people has ended up in mega carnivals which
restrict or disallow people to prepare for Sunday and attend the church on time
or don't attend the Sunday worship at all. Those who celebrate the birthday or
wedding day celebration attend the worship in a bride or bride-groom status and
getting cheers and applause from the members and the church hierarchy by wasting
the devotees' valuable time. While there are venues for squabbling with all
these paraphernalia in our secular, social and private life, don't make our
worship also in tune with the mega celebrations of carnivals and orchestra. Can
the church get out of from our private life- arena, unless requested for
guidance, advice and counseling, and give paramount importance to sacramental
celebrations in simple and humble manner that befit the spirit of God in
renewing the spirit of man. Profaning spiritual life has become the mission
field of the church authorities who invent policies that occupy their time which
yield power and money. The present- day education or vidya which is devoid of
the wisdom which need to propel our difficult lives is totally lacking, and the
vacuum is filled with the religion of fads and promiscuities. The IT age is the
last age that which give birth all profanities for the destruction of human
values and sanity, the birth sign of a world of disorder and dysfunction. It is
only an organized chaos of an age of cataclysm which only increases our head
weight and body lust for its final doom. Job-hunting, educational high-flying
success and encouraging Arts and cultural life in the church venue are not the
businesses of the church. Thanks for the progress of science that manufacture
various types of family modules, which limit the number of children to one or
two has converted them as the parents' second heaven.
Thank Mr.Eldo Joseph for listing a number of gimmicks that is sponsored by the
church authorities who become a slave of political agenda to pre-occupy our
private life because we have to invent new celebration agendas for the church
mob to be engaged with and supervised by the clergy. It is a good arena because
all their pompous and colorful photos and their personal adventures will come in
the Catholicate news and `facebooks' and TV.

"Therefore, through patience and the consolation of the Scriptures may we also
have hope of consoling ourselves after the afflictions of our distress when we
too have been patient in tribulation and call to mind the actions of those who
have far excelled us in righteousness and merit and borne far greater trials of
adversity than we. For they, on account of the righteousness in which they were
quite exemplary, often suffered the persecution of the unrighteous, in order
that, by their exercise of righteousness, they might receive the crown of
invincible patience, and might, moreover, leave behind for all who followed them
the glorious footprints of their perseverance to mark their way."

The demons cunningly withdraw for a time in the hope that we will cease
to guard our heart, thinking we have now attained peace; then they suddenly
attack our unhappy soul and seize it like a sparrow. Gaining possession of it,
they drag it down mercilessly into all kids of sin, worse than those which we
have already committed and for which we have asked forgiveness. Let us stand,
therefore, with fear of God and keep guard over our heart, practicing the
virtues which check the wickedness of our enemies.

Spirituality of Materialism

There is a spirituality of materialism which is destructive and selfish. But
Orthodox Christians are called to a higher spirituality that is constructiveand
altruistic.

We say we live unto the spiritual and eternal life, but not to the exclusion of
the troubles of this world.

"You cannot serve God and wealth (mammon)" Says Jesus Christ in Luke's
Gospel. Fr. John Brian gives a discerning sermon on living the spiritual life
by serving God first.

So, how much of your life belongs to God? How much of your time belongs to God?

This sermon uses and refers to scripture readings appointed by the Syrian
Malankara calendar and was give on Sunday, October 09, 2011 by Fr. John Brian
Paprock at Holy Transfiguration Orthodox Mission Chapel, Madison, Wisconsin.

"We have this treasure in earthen vessels, that the excellency may be of the
power of God and not of us." 2 Corinthians 4:7.

nothing in the world is more beautiful than that. It is indeed a comfort in this

Dear John Sir
The "Vidhyarabham" project/venture was started initially by H.G. Dr.
Geevarghese mar Osthathios at St.Paul's Mission center during 1980's to fight
against christian faithful who used to send their kids to Hindu Gurus or Non
Christian Shrines! Here there is no cat and mouse game or money making minded
idea behind this great service of learning by Kids!
Let me tell you even now our orthodox people are following the hindu customary
observation of "RHAU KALAM" during wedding/marriage and "RASHI" for Housewarming
ceremony!I wonder why these so called Staunch orthodox people behave like
HYPOCRATS!
Your mere allegation of wasting devotees valuable time are to be treated like
Parisee who used to critisize Jesus Christ!

earnings that he got by begging, which he didn't have to labour for. The
multi-betrayal strategy of the church that monopolises in all our private life
is an encroachment to our personal freedom.

"May we all imitate this good man [Jacob], we in the age of Grace imitating this
man who lived before the Law, and let us ask the Lord for nothing in this world.
After all, he does not wait for a reminder from us: even if we don't ask, He
grants us what we need. He makes the sun rise on evil people and good, and rains
on just and unjust. Let us believe Him as He advises us in these words, 'Seek
first the kingdom of God, and all these things will come to you in addition.' "

St. John Chrysostom.

"Conscience in men is nothing else but the voice of the omnipresent God moving
in the hearts of men, as He Who alone Is and has created everything, the Lord
knows all as Himself - all the thoughts, desires, intentions, words, and works
of men, present, past, and future. However far in front I may let my thoughts,
my imagination, run He is there before me and I ever inevitably finish my course
in Him, ever having Him as the witness of my ways. 'His eyes are open upon all
the ways of the sons of men' (Jer 32:19). 'Whither shall I go from Thy Spirit,
or whither shall I flee from Thy presence?' (Ps 139:7)."

Much has been talked about these two judgments which went against
MOSC. While dealing with legal matters, it is quite natural that
occasionally decisions of judges may go against us. On such occasions
we have to learn from mistakes and correct ourselves. We should not
get desperate. Having said this let me try to explain the
complications related with CPC 92(1). This point has been raised by
the patriarch’s group recently. When they raised it, our own advocates
– who are very efficient and who have fought well in court to get
positive results – were of differing opinions. Some said it will be
applicable and others said it can be overlooked. We were not sure
which direction the judges were going to take. As the advocates were
confident, we entrusted the matter to them. It should be noted that
section 92 was a point raised by the Patriarch’s group in order to
delay the progress of all our suites. So naturally the church was
always trying to avoid this complication.
An initial judgment on the applicability of CPC 92 in our church cases
was pronounced two years ago regarding Nechoor church. The verdict was
against us. The judges concluded that section 92 is applicable to the
MOSC church suites. We consulted some eminent lawyers in this issue at
the Supreme Court level. We consulted Adv. F.S. Nariman himself who is
confident to get a verdict in our favor from the Supreme Court. So
appeal has been filed in the Supreme Court regarding the applicability
of CPC 92 in our church cases. Adv. Nariman himself appeared for us in
court when the appeal was received in file. The appeal is pending. The
church authorities have consulted high ranking advocates in this
issue.
The problem with CPC 92 is that some advocates do not know deeply
about the manner in which it has to be dealt with. This is what
happened in Kandand. When we approached the Munsiff’s court for a
prior permission, even the Munsiff did not know that he was not
authorized to grant a prior permission according to CPC 92. The
Munsiff granted the permission and our advocate, again a person who
has been practicing since years, thought that it was OK. But later we
had to withdraw the case and file a new one in the District court. The
permission was rejected by the District court only on the ground that
the time limit of three years from the cause of action has expired.
Once again our advocates are confident to a get a verdict from the
high court in our favour.
In the case of Puthencruz church, the suite has been filed quite early
when the question of section 92 has not yet been raised. We continued
with the early suite in order to gain time. But the verdict went
against us. Let us hope that the church leadership will make the best
efforts solve the problem.
