I cannot imagine how you are able to describe such detail about my car from your vantage point of a pedestrian presumably about to be run over due to erratic driving. I find your timing suspect and wonder why you did not immediately call the police? I suspect that your true motive is some ridiculous attempt to embarrass me in a public forum. This listserv was not designed for the purpose of posting false reports. If you ever see me or any citizen driving erratically then do not hesitate to call the police. Be reminded that making false reports is a punishable offense; I am certain you already know this, which is why you posted this falsehood here.

Residents,

 

Unfortunately, the Supreme Court today struck down part of the District of Columbia’s handgun ban.  I wanted to drop you a note to let you know the immediate impact of this decision.

 

The Supreme Court’s ruling is limited and leaves intact various other laws that apply to private residents who would purchase handguns or other firearms for home possession.  It is important that everyone know that:

 

  • First, all firearms must be registered with the Metropolitan Police Department’s Firearms Registration Section before they may be lawfully possessed.   

 

  • Second, automatic and semiautomatic handguns generally remain illegal and may not be registered.   

 

  • Third, the Supreme Court’s ruling is limited to handguns in the home and does not entitle anyone to carry firearms outside his or her own home.   

 

Lastly, although the Court struck the safe storage provision on the ground that it was too broadly written, in my opinion firearms in the home should be kept either unloaded and disassembled or locked.

 

I will comply with the Court’s reading of the Second Amendment in its letter and spirit.  At the same time, I will continue to vigorously enforce the District’s other gun-related laws.  I will also continue to find additional ways to protect the District’s residents against the scourge of gun violence.

 

Residents who want additional information can visit the Metropolitan Police Website at www.mpdc.dc.gov/gunregistration.  Residents with questions are encouraged to contact the Firearms Registration Section at 202-727-9490.

I sincerely hope this doesn't mean that there will be a lot of gun shops springing up everywhere....that will just add another headache of things we have to fight going into our community....it's bad enough with all the ghetto liquor stores and check cashing joints.

  • First, all firearms must be registered with the Metropolitan Police Department¢s Firearms Registration Section before they may be lawfully possessed.   

 

  • Second, automatic and semiautomatic handguns generally remain illegal and may not be registered.   

 

  • Third, the Supreme Court¢s ruling is limited to handguns in the home and does not entitle anyone to carry firearms outside his or her own home.   

 

Lastly, although the Court struck the safe storage provision on the ground that it was too broadly written, in my opinion firearms in the home should be kept either unloaded and disassembled or locked.

Unlike your department the highest court in the land has  decided to ensure the rights of the people.  The DC police has decided to erect road blocks as an ineffective and illegal method to show the appearance that it stops crime.  After DC banned hand guns murders went up and DC police have since tried to illegally infringe upon our rights a law abiding citizen, we will now be able to defend themselves from criminals.  It is time DC had a police chief that believes in the rights of citizens and can deal with crime, that is not you.

Perhaps, but I really don't think overturning the gun ban will change anything.  The criminals who want guns for illegal activity and are out shooting one another already have guns and have methods of getting them that circumvents the law.  Yes, some people might run out and buy guns in a panic, but I think the vast majority of law-abiding DC citizens aren't going to run out and buy guns.  If they do, they may be intelligent enough to follow general safety precautions (i.e., locking the gun up).  So, in the end, overturning the gun ban hasn't changed a darn thing.

I grew up in a state (Virginia) with very liberal gun laws and there
were certainly not a lot of gun stores in the "hood."  More than
likely a criminal is not going to waltz into a gun shop and purchase
a weapon since he/she would have to register it. I have lived in DC
since 1993 and criminals HAVE ALWAYS had guns.  In fact the there
were 143 gun-related murders in Washington last year, compared
with 135 in 1976, when the handgun ban was enacted. What does that
tell you???   Gun ban or not the criminals have them and use them
practically EVERY WEEK!  No disrespect to the police but the ban was
doing squat and IF a criminal wanted a gun it was quite easy to get
one.  And the police knows that.  Now law abiding citizens have the
right that was granted under the Constitution to have a handgun.
Please note you have always been able to have a rifle in DC. So if
people weren't afraid criminals would break in and steal rifles...or
that there were a lot of rifle shops in the hood...not sure where
the panic is coming from now.

The truth is the Constitution should not be "bent" based on where
you live or high crime.  A gun ban has done very little to keep
crime lower in Washington, DC.  Actually it probably helped
criminals because the likelihood of a regular law abiding citizen
having a gun was low and the criminals always had them.  Well that
made regular people much easier targets.

In addition, the logic that someone might break into a house so
let's  ban guns is also flawed. Someone MIGHT steal your car but I
don't think people stopped buying them.  Someone MIGHT break in your
house and steal any of your personal belongings or hurt you, but you
still live in the city.

I suggest the Police Department offer gun training, education and
safety classes.  In addition, it would be nice if registered gun
owners were required to take a class in gun safety.  Guns are not
bad; people are bad.  If you become a registered gun owner it should
not be taken lightly and you should learn to properly use your
weapon.  If not, you may only hurt yourself or the wrong person.

So if you were in support of the ban this battle has been
lost...suck it up and let's come up with ideas that will encourage
the proper use of weapons and safety controls so people and children
are not hurt.  BUT to keep whining about the ban is a bit futile
since it's gone....

Although I am sure when crime goes up this summer which I am SURE it
will...everyone will blame it on the ban being lifted.

FEAR PEOPLE MORE THAN GUNS....

I believe you are hasty in your assumption that semi-automatic handguns are outlawed.  I have read the ruling and find nowhere that it allows the City to ban semi-automatic handguns. In fact, it states the opposite as indicated in the ruling:

"It is enough to note, as we have observed that the American people have considered the handgun to be the quintessential self-defense weapon.  There are many reasons that a citizen may prefer a handgun for home defense: It is easier to store in a location that is readily accessible in an emergency; it cannot easily be redirected or wrestled away by an attacker; it is easier to use for those without the upper body strength to life and aim a long gun; it can be pointed at a burglar with one hand while the other hand dials the police.  Whatever the reason, handguns are the most popular weapon chosen by Americans for self-defense in the home, and a complete prohibition of their use is invalid....


...The handgun ban and the trigger-lock requirement (as applied to self-defense) violate the Second Amendment.  The District’s total ban on handgun possession in the home amounts to a prohibition on an entire class of “arms” that Americans overwhelmingly choose for the lawful purpose of self-defense." 


I am certain that the general population (and the courts) will agree that semi-automatic hand guns are a "popular weapon chosen by Americans for self-defense..." A ban on semi-automatic handguns in itself would be a ban on an "entire class of 'arms'."  Please stop wasting the taxpayers' money trying to defend and indefensible position.  The criminals will always have guns; they don't care about laws.  All you are doing is attempting to take away the rights of lawful citizens. The Supreme Court’s ruling is limited and leaves intact various other laws that apply to private residents who would purchase handguns or other firearms for home possession.  It is important that everyone know that:

 

  • First, all firearms must be registered with the Metropolitan Police Department’s Firearms Registration Section before they may be lawfully possessed.   

 

  • Second, automatic and semiautomatic handguns generally remain illegal and may not be registered.   

 

  • Third, the Supreme Court’s ruling is limited to handguns in the home and does not entitle anyone to carry firearms outside his or her own home.   

 

Lastly, although the Court struck the safe storage provision on the ground that it was too broadly written, in my opinion firearms in the home should be kept either unloaded and disassembled or locked.

 

I will comply with the Court’s reading of the Second Amendment in its letter and spirit.  At the same time, I will continue to vigorously enforce the District’s other gun-related laws.  I will also continue to find additional ways to protect the District’s residents against the scourge of gun violence.

I read the Court's decision precisely as you read it Mr. Smith.  It would be a total waste of the people's money to attempt to exclude semi-automatic weapons.  There are only two types of handguns, revolvers and semi-automatics.  It would be very difficult to shoot and aim a revolver while phoning 911.  The trigger-pull on a revolver is hard to pull and btw, a revolver only holds six rounds.  I personally do not like revolvers. 

 

In addition, the Interim Attorney General stated on NPR that all handguns registered in the District would require a trigger lock.  BTW, I wonder how many criminals have trigger-locks on their handguns.  I wonder how many will now go out and get trigger-locks.  I would venture nada.  Thank Goodness, the Court addressed that issue as well.  Trigger-locks on handguns cannot be mandated.  To do otherwise would require more litigation and a waste of additional tax payers money.  

 

Finally, Lanier stated that before an individual could register and legally own a handgun, the individual would be required to pass a written exam.  Hello, the Court said that to defend oneself in their home and to own a handgun was a RIGHT. Not a PRIVILEGE, but a RIGHT, sought of akin to a right to vote.  I believe that requiring the passage of a written test for something that is a RIGHT was addressed more than sixty years ago.  Not with guns, but with votes.  What happens when an illiterate person who is otherwise qualified to own a gun wants to register his weapon.  I suggest that before more taxpaying money is squandered, somebody actually read the decision and stop shooting from the hip.  It would also help that when it is read and interpreted, it be performed by a taxpaying DC resident who actually gives a flying hoot about the money coffers.  Somebody who actually cares about the constitution.  Perhaps, somebody who willing became a DC resident without the lure of a big time title and position.  Somebody who will care and remain in the city more than six months after he/she is no longer holding that big title.  Somebody whose own pocket book would be affected by their decisions to circumvent the Supreme Court of the United States.  Oh BTW--did I mention that I was ecstatic by the Court's decision.  And yes, I was born, raised, and educated in this city.  I left it and voluntarily returned.  So yes, I know all about the violence in the city.  But I sure will feel better when I have the same rights, beginning with owning a handgun, as my cousins in Maryland and Virginia.

You can buy a gun on the street for $50 bucks.  It is not a good gun, but it shoots.  Why would a criminal break in the house for a gun, when the home owner might use the gun on the criminal.  No, I don't think people will break in homes purely for a gun.  There would be far more valuable items to grab instead.

Unlike your department the highest court in the land has  decided to ensure the rights of the people.  The DC police has decided to erect road blocks as an ineffective and illegal method to show the appearance that it stops crime.  After DC banned hand guns murders went up and DC police have since tried to illegally infringe upon our rights a law abiding citizen, we will now be able to defend themselves from criminals.  It is time DC had a police chief that believes in the rights of citizens and can deal with crime, that is not you.

In the coming days the District of Columbia will be implementing new rules and regulations regarding the Supreme Court decision in the District of Columbia v. Heller (handgun) case. The Supreme Court ruled that residents will be allowed to possess handguns in their homes. It is critical that all Metropolitan Police Department members know the immediate impact of this ruling:

  • All Firearms including handguns must be registered with the Metropolitan Police Department’s Firearms Registration Section before they may be legally possessed.
  • Automatic and semi-automatic handguns remain ineligible for registration.
  • The Supreme Court’s ruling is limited to handguns in the home and does not affect the legality of firearms carried outside of the home.
  • The Metropolitan Police Department will urge residents that do obtain licenses to carry weapons in the home to also keep that weapon either disassembled or secured with a locking device (not a current legal requirement).

What Happens Now?

The Supreme Court will formally issue its mandate within the next month, possibly as early as July 17, 2008.  The U.S. Court of Appeals will then send the case to the U.S. District Court to enter an injunction.  The injunction is the court order that will officially prevent the District government from enforcing the handgun ban.  That process may take a few months.  Within 21 days, the Metropolitan Police Department will promulgate regulations to accommodate the process of registering handguns for lawful possession.

Can people go out and get handguns right now? 
If not, when will they be able to do it?

No.  Residents may not go out and get handguns, though they will soon be able to do so.  There is further court action before the Supreme Court’s decision is implemented and the handgun ban is officially lifted, though that should happen within the next few months.  It should be emphasized that even after the handgun ban is lifted, those who wish to possess handguns will first be required to register them with the Metropolitan Police Department, as they must do with all firearms, in order for the possession to be legal.  Furthermore, under the Supreme Court’s decision, possession of properly registered handguns will still be legal only in one’s own home.

What can people do right now?

Although people cannot yet register handguns for legal possession in the home, they will be able to do so soon, and the District government will fully comply with the Supreme Court’s decision.  Residents should wait for the regulations that the Metropolitan Police Department will prepare within the next 21 days for further instructions.  In the meantime, if residents have specific questions, they may contact the Firearms Registration Section of the Metropolitan Police Department at (202) 727-9490 or visit the Department’s website at www.mpdc.dc.gov/gunregistration.

Will there be restrictions on who can register a handgun?

Yes, under District law that the Supreme Court did not disturb, someone who seeks to register any firearm must meet certain requirements.  Among these are that the would-be registrant must be 21 years of age and cannot have been convicted of a felony or other crime of violence or weapons crime, or have been committed to a mental hospital within the past five years.  Registrants also must be fingerprinted and pass a test regarding knowledge of District gun laws.

Yes, under District law that the Supreme Court did not disturb, automatic and semi-automatic handguns generally may not be registered. What existing law requires prohibition on all semi-automatic firearms?
  In reading the current law, I thought that guns that can carry more
than 12 rounds without modification are prohibited.  Some
semi-automatics (e.g.: Glock model 26) are designed for carrying 10
rounds unless a modified magazine is used (which are prohibited under
DC law, I believe).

I can comfortably shoot with good accuracy using a semi-automatic,
which is safer, more accurate, and more reliable than a revolver.
That said, would MPD allow a firearm meeting the above specs
(semi-auto designed to hold 12 or fewer rounds without modification,
as law allows)?

Any clarification would be appreciated!

Every time this crime summary comes out, I notice that there is some sort of
crime committed at the 900 block of Rhode Island Ave. NE in 505.  It seems to me
that if something seems to be happening there all the time that there should be
increased police presence in that particular spot and/or the business that
perpetuates the crimes should be shut down....just a thought

You are one hundred percent correct and that is how we made arrest in the last two robberies that occurred there over the last week.  We will continue patrol this area with hopes of making even more apprehensions.
