New Rail Service Agreement Reached

Jamestown Post Journal.

Gov. George E. Pataki announced the Southern Tier extension rail line will
soon be operated by the Western New York and Pennsylvania Railroad, a
subsidiary of the Livonia, Avon and Lakeview Railroad.

The new rail line will interchange freights with Norfolk Southern and other
connecting lines and will recieve $2 MILLION TO UPGRADE TRACKS AND REOPEN
SERVICE.

The rail line is between Hornell and Corry, a distance of about 142 miles,
and is a former Conrial line that is owned by Norfolk Southern. At this
time, the service is provided only between Olean and Jamestown. The segment
between Olean and Hornell has been out of service since the early 1990's.

As part of the conrail sale process, Norfolk Southern, the State
Transportation Department and Southern Tier West Regional Planning and
Development Board acting on the behalf of Cattaraugus, Chautauqua, Allegany
and Steuben counties agreed in 1998 to preserve continued service to
existing customers and to any new customers locating on the line in return
for property tax relief.

I know this is kinda early to ask about or think
about, but I was wondering what frequencies they
must use on this line? I know that they use 160.83
up here in Rochester area and I think they use
161.370 in Victor,NY, I have no idea what they use
down in Bath,NY? So just a though I had during
part of my boring day. :)

Curiousity got the best of me, and so I just called the office to see
if they'd be running north to Rochester tomorrow. They most likely
will not, as they went today and plan to go up on Thursday. Damn the
luck, today was sunny and I had four classes. I have none tomorrow
and was thinking of possibly going up north again. I guess not. :) At
least the LAL is something that I will soon have covered well in my
collection...

The line through Cattaraugus belongs to the New York & Lake Erie. It is out of service below the Setterstix plant on the south end of town to Salamanca. For NYLE to interchange with the new railroad, they would want to restore about 5 miles of the old BSW to service, from Conewango Valley west to Waterboro Junction. The line from Cattaraugus to Salamanca has several condemned bridges in the out-of-service area which they would need help to fix if they wanted to interchange at Salamanca.

I left Ithaca at 0615 hours in the AM, so I was making a good bet
noone would be in the office then! Apparently it was a last-minute
decision to cancel the train. Oh well, that's the only thing I wanted
to do today anyways. Unfortunately we probably we won't see the sun
for another two months now!

doing the LA&L. As most people know, M-W-F is not a given but the
normal operating schedule for the CSX interchange job. Long story
short, the train got cancelled today and my hour/45 min. drive was
made less rewarding. Still had some fun photographing the S1 drilling
cars around the shops area, but it wasn't worth sticking around for
all day long. GTI C424m 452 is now parked beside the shops building
coupled to the plow and ballast cars. The four Centuries and RS1 were

didn't go into downtown Lakeville to check on the stray unrebuilt
C424m, which may or may not be in the shops now as we speak. I'm

You know, I didn't think that the LA&L had that much
capital to use on rebuilding a railroad, but I guess
they do! My only question is, WHERE?
I would have never have guessed that the LA&L would be
the one's to operate the Olean Secondary. I would have
thought that the B&P (G&W) would be more able to
operate the Olean Sec.

Les, those engines have been moved a while now. I
have no idea where they are? I did go by the shop
last weekend and all I saw there was a snowplow.

SALAMANCA - Beginning in April, the Western New York & Pennsylvania Railroad
will begin hauling freight across the Southern Tier on the historic former
151-year-old Erie Railroad line. On Thursday, the Southern Tier Railroad
Authority and Norfolk Southern Corp. agreed to amend a 1998 contract to
maintain freight service over the 145-mile line from Hornell west to the
Pennsylvania state line and to Corry, Pa. The agreement calls for Norfolk
Southern to convey ownership of the line to the rail authority for nine
years. During that time, the line will pay no property taxes. In 2011, the
line will revert to Norfolk Southern and be back on the tax rolls. The tax
abatement will be in effect this fall when school taxes are due. "As a result
of the abatement, Norfolk Southern will have several years to make the line
viable again without the albatross of a big property tax bill," said Donald
R. Rychnowski, director of the Southern Tier West Regional Planning Board,
which has worked to save the line for more than a decade. "Local taxing
jurisdictions will see the first effect of any abatement starting in 2001 for
school taxes and 2002 for town, city and county taxes," Rychnow-
ski said. "After the abatement period ends, municipalities will again see the
property tax revenue from the line, as opposed to its total loss if the line
was abandoned." Last month, the superintendents of seven school districts
along the rail line asked the authority for help because of the tax revenue
they will lose for the next nine years. Up to $690,000 will be lost annually
by schools along the line, including around $126,614 for the Olean School
District. Superintendents agreed to work with the railroad authority and the
state to foster economic development along the line to increase tax bases.
"This strategy has been the subject of intense review and negotiations over
many years, and we feel this is in the best long-term interests of
southwestern New York and northwestern Pennsylvania," said County Legislator
Gerard Fitzpatrick of Ellicottville, chairman of the railroad authority. The
agreement allows Norfolk Southern to sublease operating rights for the line
to the newly created Western New York & Pennsylvania Railroad, a wholly owned
subsidiary of the Livonia, Avon and Lakeville Railroad Corp. Headquarters for
the short line are in Lakeville, just off Route 15, south of Avon. It serves
shippers north to Rochester and has been operating since 1964. It has around
15 employees and 11 engines. Vice President William Burt, who is also a
stockholder, said: "We see significant potential in the area where businesses
are located, particularly in Jamestown. In April, we will begin
rehabilitation and track repairs." A priority is to repair the line west from
Steamburg to Jamestown, where trains are now limited to 10 mph because track
conditions. It must be increased to 25 mph, Burt said. Engines and crews will
be based in Jamestown, Burt said. He said anyone interested in working for
the railroad or on a rehab crew should contact him at the new railroad.
Through a connection along the Norfolk Southern line at Waterboro - near
Kennedy - the New York & Lake Erie Railroad of Gowanda will be able to ship
over the Southern Tier main line, and the opposite will be true as the NY&LE
offers a northbound connection to the Buffalo area.

Authority saves NS some $1.4 million in property taxes while establishing the
Western New York and Pennsylvania Railroad Company as sublessor of the
145-mile stretch. Thursday's agreement is expected to be finalized later this
month. The Extension, which links Hornell with Corry, Pa., had badly
deteriorated over the past decade after being effectively abandoned by former
owner Conrail. Only a 50-mile stretch between Olean and Jamestown remains
functional. State officials in June created the Authority to spark
rehabilitation of the railroad and promote it as an economic development tool
for Chautauqua, Cattaraugus, Allegany and Steuben counties. "We feel that
this is in the best long-term interest of southwestern New York and
northwestern Pennsylvania," Authority Chairman Jess Fitzpatrick said. The
Authority has told school districts it will seek emergency state aid to
offset revenue losses by the nine-year property tax abatement. The abatement
is possible through a sale-leaseback arrangement, whereby the Authority takes
ownership of the Extension through 2010. In 2011, the rail line reverts back
to NS ownership and returns to the tax roll.

145-mile line from Hornell west to the Pennsylvania state line and to Corry,
Pa.

The agreement calls for Norfolk Southern to convey ownership of the line to
the rail authority for nine years. During that time, the line will pay no
property taxes. In 2011, the line will revert to Norfolk Southern and be
back on the tax rolls.

The tax abatement will be in effect this fall when school taxes are due.

"As a result of the abatement, Norfolk Southern will have several years to
make the line viable again without the albatross of a big property tax
bill," said Donald R. Rychnowski, director of the Southern Tier West
Regional Planning Board, which has worked to save the line for more than a
decade.

"Local taxing jurisdictions will see the first effect of any abatement
starting in 2001 for school taxes and 2002 for town, city and county taxes,"
Rychnow-
ski said. "After the abatement period ends, municipalities will again see
the property tax revenue from the line, as opposed to its total loss if the
line was abandoned."

Last month, the superintendents of seven school districts along the rail
line asked the authority for help because of the tax revenue they will lose
for the next nine years. Up to $690,000 will be lost annually by schools
along the line, including around $126,614 for the Olean School District.

Superintendents agreed to work with the railroad authority and the state to
foster economic development along the line to increase tax bases.

"This strategy has been the subject of intense review and negotiations over
many years, and we feel this is in the best long-term interests of
southwestern New York and northwestern Pennsylvania," said County Legislator
Gerard Fitzpatrick of Ellicottville, chairman of the railroad authority.

The agreement allows Norfolk Southern to sublease operating rights for the
line to the newly created Western New York & Pennsylvania Railroad, a wholly
owned subsidiary of the Livonia, Avon and Lakeville Railroad Corp.

Headquarters for the short line are in Lakeville, just off Route 15, south
of Avon. It serves shippers north to Rochester and has been operating since
1964. It has around 15 employees and 11 engines.

Vice President William Burt, who is also a stockholder, said: "We see
significant potential in the area where businesses are located, particularly
in Jamestown. In April, we will begin rehabilitation and track repairs."

A priority is to repair the line west from Steamburg to Jamestown, where
trains are now limited to 10 mph because track conditions. It must be
increased to 25 mph, Burt said.

Engines and crews will be based in Jamestown, Burt said. He said anyone
interested in working for the railroad or on a rehab crew should contact him
at the new railroad.

Through a connection along the Norfolk Southern line at Waterboro - near
Kennedy - the New York & Lake Erie Railroad of Gowanda will be able to ship
over the Southern Tier main line, and the opposite will be true as the NY&LE
offers a northbound connection to the Buffalo area.

I was down there on a gloomy day, thinking about shooting for my article I am
going to put into Railpace soon. Those two Also C424m's #451 #452, they were
checking them out there was guys inside them, I am assuming they might want
to bring 'em back into service. This was I think one week ago.

I am not sure what business are still out there, but I am sure there
will be a couple that will start getting railroad service. The mention
of the B&P with the SD-45's, all you would have to do is get a pig train
and you are going back to the days of NY100 and NY99!!  But I don't care
what power is moving over the Meadville line, as long trains are running
again. Good luck Bill Burt. Lets hope he has no problems with the
washouts.

That was item 9 I should have put on my email of a short time ago - What power will they use? They've got one excess engine at Lakeville now. Sounds like time to bring 'em out of the weeds (or maybe borrow some of the Alcos BSOR just got?)..

The news of LA&L getting the operating lease on the Meadville Line is good news for customers and us historians alike. Several thoughts came to mind about this:
 
1. LA&L is one of the three best choices to run this line. The others would have been GVT or B&P. All of these are locally based, which means they have a better understanding of the region's needs than lines based outside of this area.
 
2. Bill Burt's restoration plan for the line is very sound. The area where he is going to need the most help financially is being left for last. Even though I'm sure they'd like to get their hands onto business from Air Preheater (High value loads are big revenue business), Air is going to have to rearrange its plant setup so they can use the siding again (if they want to). This will take a while. The west end is for the most part intact with little more than some brush removal, crossing work, and isolated tie/ballast work needed. I'm not sure if there are any washouts out there. Not bad for a railroad that has been out of service ten years as of 2/1.
 
3. What is this going to mean to Bob Dingman's Oil Creek and Titusville, which currently operates the Corry to Meadville segment? Will he have to get more power or will it mean lots of work for their FPAs? Or will LA&L just operate right through? This should be interesting.
 
4. Will LA&L go after getting some interchange traffic for B&P from the west? Could this mean interchange at Salamanca?
 
5. With the closure of Pennzoil in Rouseville and subsequent replacement by the less-traffic active Lubrizol plus the permanent closure of Trinity Industries in Greenville (which hadn't been active prior to its official closure for close to a year), NS's Meadville Yard, while not that big, has room to fit LA&L's intentions to bring traffic in from there. Trains 44K and 45K have room to handle this traffic.
 
6. Will NS, once offered the opportunity, bring some coal over to the Meadville Line? The grades are a little tougher than via the Tier, with three main grades to deal with - east from Meadville to Union City, east out of Olean to Cuba, and east out of Wellsville to Tip Top. However, it avoids the Buffalo traffic jam. Keep in mind that the Olean-Hornell part of the line had the most traffic in the last days of its use.
 
7. What potential customers are there that could go back on line right now if given the right service? Here's a few ideas. Any of you out there who can update me on whether these industries are even there would help my records. Here goes:
 
Bush Industries in Falconer, which had a spur built just for it in the 80s and was a big customer, was scared away by weak service.
Ethan Allen in Falconer
Two other industries in Falconer at the first couple of grade crossings west of DV Tower
Blue Seal Feeds in Randolph
Two other industries in Salamanca
One industry about 5 miles west of Lakewood (old Cummins Engine Plant)
Feed Mill just east of Rte 6 underpass in Columbus
Keywell Air-Vac Industries, which is currently serviced off the NY&LE Main at Conewango Valley
Jamestown Municipal Power Plant
Three other industries in Jamestown on west side of town plus any industries that used to be on a spur that left the main west of Sixth Street overpass
Sargent Transportation in Cuba
 
8. Will the NY&LE want to interchange with LA&L at Waterboro Junction as an alternative to using BSOR? This tale will be very telling since BSOR has little business below North Collins except for the interchange traffic from NY&LE.
 
Well, there you have it. Let's all get our two cents in on this and wish Bill Burt the best. He's got the right attitude for making this successful.

Hornell. The ERIE is (will be) alive again!   One question though, how will NS

This is great news about LA&L expanding their NY state trackage. It
can only mean further increased stimulation of rail traffic, and an
increase in local film sales as railfans follow the sights, sounds
and smells of the railway's preferred ALCO power! It should be great
to see C424ms, the presumed motive power choice for the new
operation, running the rails of southwestern New York. Thanks for
starting this list Les.

Rail Service For Region To Expand

SALAMANCA - Twelve years of struggling to keep rail service on-track in the
Southern Tier has successfully come to the end of the line.

Bill Burt's Western New York and Pennsylvania Railroad has been named
short-line operator for the Hornell-to-Corry Southern Tier Extension, it was
announced during a meeting Thursday of the region's Rail Authority board of
directors.

Not only will the operators run the track, but, it also was announced, they
will restore the full line so it is completely operational by December 2002.

Phase 1A of Burt's plan to upgrade the rail service will occur in the first
90 days after the deal is closed, which is expected to happen by the end of
February. At that time, Western New York and Pennsylvania will operate the
Olean-to-Jamestown line as is and undertake initial rehabilitation of the
Corry-to-Jamestown segment.

Phase 1B, to be done during the second half of this year, will be to shift
Jamestown traffic to a Meadville-Corry-Jamestown routing, which is expected
to improve local service.

Rehabilitation will continue between Corry and Olean, along with repairs to
washouts in Allegany County. Grade crossing and bridge issues will be
undertaken.

Phase 2, set for December 2001, will be to notify Norfolk Southern that
Corry-to-Olean is open for haulage and or trackage-rights trains, while
rehabilitation of track between Olean and Hornell will begin.

Phase 3 in December 2002 will open the entire route for haulage and
trackage-rights trains.

Burt said he has served as a rail consultant for Southern Tier West since
1992, and understands the opportunities and risks associated with the
operation of the local rail line.

''It has the potential to do more business and make other businesses more
competitive,'' he said. It will be his job, he said, to find a way to make
the line more attractive to businesses. He said he plans to do that by
paying attention to local customers from a Jamestown-based office.

Burt said the line will be a challenge in the first years but expects that,
in less than five years, it will have daily service. He said the first-year
operating loss is projected at $290,919, with positive income expected by
the third year of operation.

Rail authority members Thursday also adopted, renewed and amended a 1998
agreement with Norfolk Southern to lease the line for nine years. During
that time, about $1.4 million in taxes throughout Chautauqua, Cattaraugus,
Allegany and Steuben Counties will be abated. At the end of the nine years,
the rail line will revert to Norfolk Southern ownership from the authority
and be subject to taxation.

Other terms and conditions of the agreement were not disclosed.

''This strategy has been the subject of intense review and negotiations over
many years, and we feel that this is in the best long-term interest of
southwestern New York and northwestern Pennsylvania,'' said Jess
Fitzpatrick, Rail Authority chair and Cattaraugus County Legislature
chairman. ''We believe that what we have done today will pave the way for
significant economic development and jobs in our region.''

Fitzpatrick is not the only one who thinks so.

''It's a really important day for us,'' said Southern Tier West Executive
Director Don Rychnowski. He called the step ''a beginning.'' However, he
said, officials must work to attract businesses for the line.

''It doesn't work just to have a railroad,'' he said. The ultimate goal is
to replace taxes and revive the economy.

Bill Ingram of Norfolk Southern said choosing a shortline operator and
settling the agreement are ''progressive steps.'' Now, he said, work must
begin on building businesses along the line.

''It's a historic event,'' said Fred Larson, Chautauqua County attorney and
Rail Authority member. Not only will firms such as Falconer-based Monofrax
continue to be served by the line, but rail service can also be used as ''an
economic development tool,'' Larson said.

The meeting was attended by representatives of Congressman Amo Houghton,
Sen. Charles Schumer, Sen. Hillary Clinton, Representative Jack Quinn and by
officials from Norfolk Southern, Chautauqua County government, Cattaraugus
County government, Empire State Development, the Seneca Nation of Indians,
Southern Tier West and the New York State Department of Transportation.

''It's a remarkable accomplishment,'' said Chet Lunner of Houghton's office.
The meeting drew ''the greatest concentration of political power north of
the beltway,'' Lunner said.

He said the presence of the representatives demonstrated a serious
commitment to ''make happen what we can'' in Washington to advance local
rail service on the Southern Tier.

The Western New York & Pennsylvania R.R., LLC is a wholly-owned subsidiary
of the Livonia, Avon & Lakeville R.R. Corporation. William D. (Bill) Burt is
