Officer in charge of evidence accused of theft A San Francisco police officer assigned to handle evidence was arraigned for allegedly stealing from the department and doctoring reports to hide the crime.

SAN FRANCISCO - A San Francisco police officer assigned to handle evidence will be arraigned today for allegedly stealing from the department and doctoring reports to hide the crime.

Officer Michelle Alvis, a five-year veteran of the Police Department, was assigned as the Taraval Station manager — a job that involved documenting evidence being sent to police headquarters — after her involvement in a fatal 2006 officer-involved shooting. She was arrested Friday and released on bail after a grand jury indictment of
grand theft involving an incident on Oct. 31, 2006.

Although a grand jury indictment that details the charges is sealed, a brief police incident report accuses Alvis of grand theft, filing a false report, preparing false documentary evidence and two counts of willful loss or destruction of records by officer entrusted.

A conviction of grand theft alone could result in a sentence of three years in prison, depending on the value of the goods stolen.

While the Police Department and the District Attorney’s Office declined to comment on the specifics of the indictment, the president of San Francisco’s police union, Gary Delagnes, expressed doubt that an officer in her position would steal from the department when all fingers would point back in her direction
.“This is a question of on-duty conduct and she’s one of our members, so we’ll stand by her as this thing plays out,” Delagnes said. “I guess the grand jury must have seen something.”

This is not the first time Alvis has been the center of controversy. Six months before the alleged theft, on June 6, 2006, Alvis shot and killed 25-year-old Asa Sullivan in the attic of a Villas Parkmerced apartment.

At the time of the shooting, Alvis was accompanied by Officer John Keesor, who had fired the first shot because he said Sullivan was holding a
“cylindrical item” that later was determined to be an eyeglass case, according to police.

The bullet ricocheted and hit Alvis’ ear and she fired, according to the police account.
Sullivan was shot 16 times, according to the medical examiner’s report. Police have yet to release incident reports related to the officer-involved shooting.

Sullivan’s family is suing the department in federal court for $10 million.

Alvis’ attorney, Lydia Stiglich, did not return calls late Monday afternoon for comment.

Police Summit a Great Success, 7/1/2006
A fact-finding summit that focused on the current state of discipline and civilian review within the SFPD was recently convened at the University of San Francisco. On May 30 and June 1, 2006, a very distinguished panel invited witnesses to appear before them to discuss the quagmire that currently entangles the SF Police Commission, OCC, MCD, and which has adversely affected the near-lifeless morale of the police rank-and-file. It was a very interesting and informative event, sorely needed, and I anxiously await the experts’ recommendations for fixing this utterly dysfunctional system.

The conference was appropriately hosted by The International Institute of Criminal Justice Leadership and was co-chaired by former San Francisco Police Chief
Tony Ribera, and former SF Mayor and Chief of Police Frank Jordan. Joining them on the panel was the Dean of San Francisco Law School, Joe Russoniello; John Dineen, Senior consultant from POST; retired FBI agent George Grotz, now representing Data 911; Yumi Wilson, Professor of Journalism at San Francisco State; Superior Court Judge Lillian Sing; and Civil Service Commissioner Morgan Gorrono.
The panelists represented a broad political spectrum and each has a unique perspective on San Francisco law enforcement.

Those invited to address the panel were just as diverse, and composed a who’s who SFPD experts. They ranged from
Police Commissioners
Theresa Sparks and Louise Renne, to Mark Schlosberg from the ACLU,
Kevin Allen from OCC,
Chief
Heather Fong, me,
POA legal coordinator
Steve Johnson,
Deputy Chief
Morris Tabak,
Deputy Chief
Tony Parra,
Captain
Paul Chignell,
Inspector
Lea Millatello,
The Mayor’s Director of Criminal justice,
Allen Nance,
as well as several other prominent people involved in the disciplinary process of the SFPD.

It was truly refreshing to see, for the first time, people that have been involved in the criminal justice system asking police commissioners, the OCC, and the ACLU tough questions about how they conduct business with regards to the disciplinary process, and how that conduct is juxtaposed to the rights of individual police officers.

The panel heard many hours of testimony over the 2-day period, but it was quite obvious from the questions asked, and the inquiries made, that some recurring issues need to be dealt with by the mayor’s office.

It would not appear practical to bring all of the concerned parties into negotiations without the Mayor’s office intervening and directing the process.

As I saw it, the issues that were most often addressed by the experts, and which are in most need of fixing are:

Discipline and Civilian Oversight

• The interaction between the Police Commission, the Police Department, The OCC, and the POA is nearly non-existent. The relationships are so fractured and mired in bitterness and distrust that no meaningful progress can be made without the involvement of City Hall. Nothing in the police discipline/community oversight system is more important than trust, communication, and professional cooperation. These elements need to be addressed first and foremost if any headway is to be made in the overhaul of the discipline system.

• Too many disciplinary cases are being handled at the Police Commission level rendering it nothing more then a disciplinary body. To address this backlog of disciplinary cases, the Chief’s suspension powers should be broadened to at least 50 days and perhaps 90. Also, independent hearing officers need to be utilized in order to expedite less serious disciplinary matters

• The initial intake system at OCC needs to be revamped. There needs to be a practical way to triage citizen complaints to sort out the legitimate complaints from the
spurious, vindictive, or just plain crank or lunatic beefs. On that point, the OCC and its supporters need to get real and acknowledge that a sizable percentage of the complaints fall into the latter category and dismiss them out of hand.

Morale

• A comprehensive “Career Development” program needs to be established in the SFPD to enhance and expand an officer’s career potential. Rotation, variety of assignments, and non-stop training are the keys to bringing this department into the new century.

• “Performance appraisals” must be revised to truly establish a system that fairly and equitably judges an officer’s performance.


• An “Early Intervention System” that is fair to all parties and is not seen as much as a punitive tool as a monitoring tool should be implemented as soon as possible.

Dr. Joel Fay, a police psychologist, presented some of the most interesting testimony. He testified that police officers cannot and will not respond to a disciplinary process that does not have a clear delineation of supervision. He stated that, “Discipline in the SFPD is the equivalent of being punished by the mother for one offense, the father for another, and the entire neighborhood for yet another. “Cops operate under a para-military structure, they understand and accept discipline, but it must be fair and consistent. They must know who is in charge or they will shut down.”

Attorney
Lydia Stiglich, a career defense attorney whose deft legal prowess is used frequently by the POA, also offered very compelling testimony. She testified that the most shocking revelation to her was the fact that many factions in society and in the criminal justice system don’t view police officers as human beings. She also said that it was amazing to her that a city that is so adamant about defending the rights of all citizens seems to completely disregard that philosophy when the citizen happens to be a police officer.

I am confident that, when the panel issues its report and recommendations, a rebuilding process can and should begin. The time is ripe for a practical overhaul of the crucial police oversight function.

That being said, I also must caution all San Franciscans that, if a professional and trusted oversight process is not soon put into place, the city stands to lose scores, if not hundreds, of first class police recruits.

The retention and recruitment situation is dire. If the department continues to lose top tier candidates to other cities because of a
ludicrous and disreputable system of civilian oversight, progressive law enforcement in San Francisco will grind to a halt.

The committee’s recommendations will be made public in the next few weeks and the Mayor’s office would be very wise to consider them carefully if they are concerned about the state of the San Francisco Police Department.

PS: In another shinning example of the SF Chronicle’s objectivity it should be noted that the renowned author of the hit piece against our officers was present during the entire two days of testimony yet not one word about the summit was printed in the local fish wrap.

Gee, I guess real facts just don’t jibe with the Chron’s editorial philosophy, or its desire to completely demoralize the SFPD.

He's accused of attacking the victims in a cell away from

A former Harris County jailer accused of beating two inmates in a
corner of the jail where surveillance cameras don't reach will face
trial on criminal charges.

A Harris County grand jury has indicted Timothy Gough, 25, on two
charges of aggravated assault by a public servant. He is free on
$30,000 bail, court records show.

Gough's attorney could not be reached for comment late Monday.

Gough's indictment comes at a time of intense scrutiny for the Harris
County Jail, where federal justice officials announced last month
they would be investigating possible civil rights abuses. The death
of another inmate, in a January altercation with deputies, was
recently ruled a homicide.

Prosecutor Warren Diepraam said he filed charges against Gough after
hearing a complaint of abuse from a man arrested for public
intoxication in March of last year. The man, Michael Lagatta, said
Gough took him to a secluded jail cell and beat him, breaking his
nose and seriously injuring him.

"I filed that case a while ago," Diepraam said. "In the meantime, the
sheriff's office was investigating him for a strikingly similar
incident."

Another inmate reported that Gough beat him in the same remote jail
cell after the inmate got into an argument with the deputy booking
him. That inmate also suffered serious injuries, Diepraam said.

Gough's April 11 indictment includes charges from both complaints.

Officials with the sheriff's office were not available for comment on
Monday.

Diepraam said he believes Gough is no longer working in the jail, but
said he doesn't know if cameras have been installed in the cell where
the beatings are alleged.

If Gough is convicted, he will face a sentence ranging from five
years of probation to life in prison.

Hello Everyone,

Next month on June 06 is Asa B. Sullivan's two year anniversary of
his death. I would like to have a gathering in remeberance of "Big
Asa". (Big O's two year marker of his death is not far behind also).

I will not be going out in front of 2 Garces, S.F. where Asa was
killed. I know there are some who still put flowers there in his
memory and I thank you for that.

Last year on Asa's one year marker of his shooting, a few of the
family, friends and I were quietly paying our respects. We were in
front of the apartment where Asa was gunned down. We were interupted
by a rude neighbor there. This neighbor ran off with all of our
flowers and photos (that we put in front of the public tree by the
sidewalk) and threw them all in the garbage; sneaking behind our
backs while we were turned away quietly talking. I was accused of
banging hard on this neighbors door (of which I did not). The police
took her side looking me straight in the face saying I did this.
Well, it was not me. We were not there to make any problems. I did
manage to find our flowers and photos from inside the garbage near
this neighbors apartment. I will not go through that again. I choise
then and there to say goodby to the last place Asa was alive. To make
matters worse "little Asa" was witness to seeing the police again and
so this was even more disturbing to us.

On "Big" Asa's second year memorial, I do not want any unplesant
interruptions. June 6th is a Friday this year and the weather has
been good. Stay in touch and let me know your thoughts.

PLAINVIEW, Texas - A former prison guard charged in the death of an inmate
whose head was slammed against a wall pleaded no contest to manslaughter and
was given the minimum sentence by a jury that said it would have acquitted
him.

Jose Rodriguez Jr., 28, originally faced a 99-year sentence on a murder
charge that prosecutors reduced to manslaughter, the Plainview Daily Herald
reported in Friday editions. After Rodriguez pleaded no contest earlier this
week, a jury gave him two years' probation and no fine on a second-degree
felony charge that carried maximum punishments of 20 years in prison and a
$10,000 fine.

"It is the unanimous judgment of this jury that if we had the option of
finding Mr. Rodriguez innocent we would have done so," jury foreman Paul
Henderson read from a statement after the punishment was announced.

Rodriguez was accused of slamming 52-year-old Paul Ray Judia's head into a
cell wall at the Formby Unit in November after the handcuffed inmate
allegedly kicked him in the groin. Judia died at a hospital three days after
the incident.

"There was definitely a strong feeling among the jury that we shouldn't even
be messing with this case because the community is very pro-prison," said
Alice Gregg of the state's special prison prosecution unit in Lampasas.

Judia was a transfer inmate serving a 10-year sentence for burglary.
Rodriguez was hired in 2005.

Local TDCJ Prison Locked Down Amid Corruption

HOUSTON -- Note: The following story is a verbatim transcript of an Investigators story that aired on Wednesday, May 7, 2008, on KPRC Local 2 at 6 p.m.

A Houston-area prison is on lockdown tonight. Texas Department of Criminal Justice investigators are searching the entire CT Terrell prison unit in Brazoria County -- including searches of both inmates and corrections officers.

The lockdown comes after Local 2 Investigates exposed serious charges of officers and inmates committing crimes together, and claims the prison leadership attempted to cover it up. Officers inside Terrell blew the whistle on it all.

Wednesday, a new warden and top managers took over, as an intense investigation continues.

Investigative reporter Stephen Dean has more on the fallout from his investigation.

The gates are closed, showing signs of the prison lockdown that will last all week.

However, corrections officers who work at the Terrell prison unit weren't the ones doing the search. Prison officers and inspector general teams from all over the state were in charge, and the local officers were among those being searched.

Inmates are used to being rattled out of their cells for shakedown. Sky 2 showed the out-of-town search teams at work, including drug-sniffing dogs and a mobile command unit.

However, the action in the parking lot proves this was no ordinary search. Corrections officers' cars were searched one-by-one as they arrived for work, with prison investigators looking for any clues of the corruption we've been reporting since last week.

"You have a group of rogue officers that are there to basically bring things into the prison unit to supply illegal stuff for the offenders," said a corrections officer, on conditions of anonymity.

The veteran corrections officer says he handed over evidence months ago, but only after Local 2 Investigates broke the story did this prison transform into one big criminal investigation scene.

One corrections officer arrived for work to find this roadblock and he quickly turned around to avoid it like he had something to hide. Investigators chased him and searched his car. Another officer's home was searched. This lockdown caught many officers by surprise.

Along with the employee pat downs, every prisoner was ordered out of his cell, spreading all his belongings out for a search. TDCJ says it did find cash and other banned items the inmates had somehow gotten from the outside world.

Some inmates also had DNA samples taken to see if there's any proof of sex with corrupt prison guards -- just one of the many allegations to surface from inside this lockup.

So far, there have been no arrests, but investigators say some corrections officers could be fired or disciplined based on some of the routine contraband found in their possession.

Kelly Medora, a petite preschool teacher who weighed about 118 pounds,
went out with a friend in North Beach one Saturday night in 2005 for
some fun.


Instead, San Francisco police officer Christopher Damonte, who weighed
about 250 pounds, arrested her for jaywalking, twisted her arm behind
her back and broke it with an audible crack.


Although Damonte and the city denied wrongdoing, the city recently
mailed Medora a check for $235,000, the largest amount ever to settle
a lawsuit claiming San Francisco police used excessive force not
involving a weapon.


The Office of Citizen Complaints, meanwhile, has found that Damonte
used excessive force in the incident and that another officer failed
to investigate Medora's complaint.
Damonte faces a disciplinary
hearing at the Police Commission and potential punishment including
dismissal.

Damonte, 41, a six-year veteran of the department, has been the
subject of other misconduct complaints, according to city sources. He
was admonished in 2003 for inappropriately threatening to arrest a
woman without authority, and he is
among more than 18 officers
disciplined for their role in the controversial 2005 Bayview Police
Station videos,
which Mayor Gavin Newsom denounced as racist, sexist
and homophobic.

Damonte declined to comment. Matt Dorsey, spokesman for City Attorney
Dennis Herrera,
said the officers in the Medora case did nothing
wrong,
and the city settled only to avoid a potentially more costly
jury verdict.


Eileen Burke, Medora's lawyer, said the case showed police failed to
properly investigate misconduct claims.


In a 2006 series, The Chronicle reported that the Police Department
had a history of failing to control officers who repeatedly resorted
to force.
Chief Heather Fong said at the time that she was developing
better ways to identify problem officers.
"We've made a lot of
progress,"
said Sgt. Neville Gittens, department spokesman.

The North Beach arm-breaking incident highlights the kind of police
misconduct records that have become secret under a recent state
Supreme Court ruling known as the Copley case.
Gittens cited the
ruling in saying the department would have no comment on the Medora
incident.

Details of the incident became public because Medora filed a lawsuit
in federal court accusing Damonte of intentionally using excessive
force
. In defending the suit, the city was required to make public
some evidence.


Broadway encounter


According to court records, the evening of Jan. 23, 2005, began
serenely for Medora, 27, a teacher at the Helen Diller Family
Preschool.
After dinner in her Russian Hill apartment, she and a
friend walked down to a club on Broadway, where each had two
single-shot vodka and soda drinks, according to testimony.

They left at about midnight and walked west on Broadway, which was
crowded with revelers. Her friend stepped from the sidewalk between
two parked cars to hail a cab. Medora stepped off the curb behind her.
There was no oncoming traffic.

Seconds later, Damonte approached. From this point on, the officers'
and teacher's accounts diverge.


Robert Bonta, the deputy city attorney representing the police, said
in court records that Medora and her friend had endangered themselves
and others by walking into Broadway.
He said Damonte and another
officer asked them to get out of the street and said they would be cited.

Medora walked away. When Damonte caught up to her, he said, she
refused to give him her driver's license. When police detained her,
she allegedly screamed, struggled and struck an officer. The city
later said she was drunk, but the officers didn't cite her for that.

According to Medora's account, Damonte seemed
"irate" and "angry" from
the start.

"I was fearful just of his demeanor," she testified. "He was
definitely very threatening with the questions he was asking and his
body language and his facial expression, the tone of voice he was using."

Damonte grabbed her friend's arm, held it up by her face and demanded
she tell him her age
, Medora said. Damonte said he would cite her, but
didn't say why.


Medora saw the name "R. Fitzpatrick" on Damonte's jacket - he had
borrowed it from another officer - and asked if that was his name.
This seemed to set him off, she said. He said yes and demanded why she
wanted to know.


"I don't believe you're treating my friend appropriately," she
replied, court records show.
"You haven't told us what we're being
cited for. Please let go of her arm."


Medora said Damonte started to scream at her. Fearful, she said she
turned and walked up to another officer and complained about Damonte.

By her account, Damonte then demanded Medora's driver's license.
Medora said she'd give him her license if he told her what she did.

Instead, Damonte said
"detain her," by this account, and he and two
other officers surrounded her. She said she did not resist them, but
merely clutched her purse. Then Damonte grabbed her right arm.

"It all happened very quick," she testified. "Like he physically took
my arm and twisted it up back by my neck to a point where I was
completely immobilized. And I said 'ow, ow.' And he pulled even
harder, and he snapped it."


There was an audible "pop," according to a police report.

The city's lawyer said in court papers that Damonte used an approved
method of holding her arm
, but she struggled. Then
"in an effort to
escape,"
she squatted down and "broke her own arm."

Lawsuit's claims

Medora cried out in pain. Police called an ambulance and cited her for
jaywalking.


At Kaiser Hospital, she was treated for a spiral fracture to her right
humerus
. Medical records state she was
not intoxicated.

Medora said she phoned police from Kaiser to file a misconduct
complaint, but
no one responded.

Instead, an officer delivered a new citation for resisting, delaying
and assaulting an officer.
The charges were later dismissed.

In her suit, Medora said Damonte had used excessive force, and that
another officer, then-Sgt. Timothy Oberzeir, failed to investigate the
incident.
Oberzeir did not respond to a call seeking comment.

After U.S. Magistrate Judge Elizabeth Laporte ruled there was enough
evidence for the case to go to trial
, the city settled.

Laporte ruled that a jury could find that Damonte
"intended to cause
her extreme pain and distress by breaking her arm."
There was even a
question of whether the officers had cause to arrest Medora for
jaywalking
, the judge ruled.

Police Commission staff refused The Chronicle's request for a copy of
any disciplinary charges pending against Damonte.
Such records used to
be public, but in an August 2006 decision urged by police groups, the
state Supreme Court ruled them confidential personnel files.


Assemblyman Mark Leno, D-San Francisco, introduced a bill last year to
make police misconduct findings public, but the measure failed after
police officers' groups lobbied against it.


As a result, while Californians can readily learn about sustained
disciplinary actions concerning doctors, lawyers and judges
, similar
information about police officers is secret, said Terry Francke, a
First Amendment lawyer with Californians Aware, a nonprofit group that
advocates open government.

Meanwhile
, Damonte has filed a $1 million lawsuit against the city,
saying Fong unfairly disciplined him for his part in the Bayview
police videos.
His suit is similar to a pending case brought by 18
other officers disciplined in the video case.
The city denies the claims.

Hello everyone,

I am too "heart-broken"  to arrange a two year memorial on June 6th for Asa's death:(

Please think of how much happiness Asa gave to all of us who knew him when he was alive with us here on Earth.  I know Asa wants us all to enjoy our lives and have as much fun as we can while we are still able. I'm asking everyone to think about this question: How much fun are you to be with? I know we all have obligations but please find some way to fit humor in your life. Asa always did.

Make LOVE a prioity.  What's life for if we never learn from our mistakes and move forward?

For those who know of Asa through others, he would be making you laugh right now. He has a big heart and loved joking around. He had a lust to learn about many subjects and was one of the best console gaming system players I've ever seen. At least I'm sure he was enjoying the television before his last moments of his life in one way or the other.

He died in his beloved San Francisco.  He was born at home in a small apartment in the City.

He will always be alive to me even though I know he is gone.

I will be eating French Fries in his honor on June 6th. He always requested French Fries with his fast food and thought the meal was not complete unless they were included. You can do the same and tell others why.

I will light a candle in rememberence of him.

PLEASE LET ME KNOW YOUR THOUGHTS ABOUT ASA...anytime.  On this upcoming June 6th, and always, I will be thinking of him...

Good Evening,

Tomorrow, June 6th, 2008 will be the two year marker of Asa's death.

I have decided (as I mentioned in the last post) to have time alone on
this day to morn the loss of Asa.  Asa was part of a unit of my beloved
children. It is hard to have him gone.

Some friends and family have made t-shirts and sweatshirts with Asa's
photo on them in the past. I was thinking that if anyone does have a
shirt with Asa's photo or Justice4Asa on it, that tomorrow would be a
good day to wear it. I will be wearing black tomorrow afternoon. The
only t-shirt I have with Asa's photo on it was given to me and it is
faded from washing. It is going to be put into a frame for my wall in
the future.

We thank everyone for all the support our family has received over the
past two years. Asa was only 25 when he was killed. He had a full life
ahead of him. I think of him and I see his smiling face; his heart "on
his sleeve" and the best intentions to help people in the world on his
mind. Of course if he was not joking around, he was not being himself.

The world has lost a man whom I know would have done great things in his
life; especially with those who loved and knew him best. He was a loving
father, brother, uncle and cousin. Some of his cousins were never able
to meet him.

I am proud to say I would have Asa live with me again (in a quick
second) because he had earned my respect by changing his charater and
staying on a good path. It was an honor and a pleasure to have him with
me and I am thankful for the times we did have.

The tragic reality of the world's biggest corrupt legal system

America's rigged courts, bribed judges, fake and phony trials, extortion by lawyers, and over 2.2 million prisoners in the USA gulag.

Right now, about 1 out of every 45 working age males in the US are BEHIND BARS inside the US empire - Many of those millions of US prisoners are innocent.

The corrupt USA legal system, is a danger to every traveler, visitor, and guest worker from overseas, and to every individual who takes the risky step of entering upon American territory.

The reality is that the United States of America has the most dishonest, dangerous and crooked legal system of any developed nation. Legal corruption is covering America like a blanket.

The corruption of the USA legal system is well-known, but also well-hidden, by the news services of America's corporate-owned media.
America has the largest prison gulag in the entire world - The starting point for understanding anything about the USA, is to digest the fact that just this one country, the United States of America, has twenty-five percent of ALL of the prisoners in the entire world.

More than 2.2 million prisoners - more than 1 out of every 150 people in America - are behind bars in the American gulag. American "justice" is especially focused on jailing people who US government thinks might organize into opposition to the government.

No one imprisons people as casually as America, tossing innocent people into prison. The USA jailing of more than 2 million people is also a revival of slavery and slave labour. The expanding system of USA prison slave labour is not only a major source of business profit, but also a wedge to drive down the wages of workers outside the prison walls.

This culture of mass prisons and slave labour is sold to US citizens by creating a psychology of fear. This climate of fear is nourished in the USA by both the media and the government, who work together with the judges and lawyers to maintain the whole crooked game.

Before you set foot in America, you should have a clear picture of the terror of America's legal system - the judges and lawyers and money and bribery, that have made this system of fear so pervasive.

The situation is so bad, that a social explosion is beginning inside America. You can read some news stories - about people murdering judges, or attacking the families of judges, or people setting fire to courthouses in the USA - and see the pattern that is emerging, even though the news media are afraid to connect the dots and suggest what might be behind all these events.

American prisons are often horrible, with lots of torment of prisoners, like you would expect in some petty dictatorship. Rape and beatings are common, and there is little help for abused inmates. In addition to the many official USA executions, numerous people are also illegally killed in jail cells, "mysteriously" found hanged or stabbed to death.

In the regular functioning of the USA courts, America's domestic lawyers and judges, threaten people with illegal jailing, and rape, torture and murder in jail.

Theoretically, torture and abuse is totally outlawed by America's Constitution, but some of the nice words in America's Constitution hold little power anymore, despite how often people quote them.

America's Bill of Rights and Constitution are nearly dead, not just because the judges will no longer enforce them, but even more because America's lawyers will not even fight for them. The two American "political parties" are not fighting for them, either, and America's news media are also very passive. This means that America's legal system has become largely a tool of government terror, and of bribery for the rich and the powerful.

The words of the law don't protect you in the USA, because American judges and lawyers have no scruples about bending them to mean the opposite of what they say.

America's lawyers are controlled by the judges, and don't really work for you - that's why they sell you out to the government, or to the big companies that pay bribes.

Even if you are paying an American lawyer huge amounts of money, he or she doesn't really work for you, and may sell you down the river to the jailhouse.

American lawyers are directly under the thumb of the judges and the government. Lawyers, just like any other victim, can be instantly jailed by an American judge on flimsy pretexts, and American lawyers can be quickly stripped of their right to practice law. Lawyers who try to fight the system can find themselves dis-barred, criminally charged and jailed.

American lawyers are afraid to do things in court, that the judges don't want them to do. America's nearly 1 million lawyers, are almost totally under the control of a few thousand judges, with their entrenched culture of bribery and miscarriage of justice.

That means that any time you hire an American lawyer, he already is in a conflict of interest. He has to make the judge happy first. And if the judge wants to make the government happy, or make some corporation happy who is paying a big bribe, then guess what? You are destroyed. It doesn't matter what you paid the lawyer. He works for the judge, first and foremost.

People accused of serious crimes have the "right" to a lawyer, but this may only provide a crooked lawyer who is stage-managing the victim to help the government and prosecutors. If the lawyer does not betray the victim to help the government, he can be put out of work.

This legal fraud is the core of the danger to those who visit America. A lawyer who is "representing" you in the USA, whether the government is paying him, or even if you are paying him yourself, may just be a stooge who is helping the prosecutors to put you in jail, even though you are innocent.

The judges of America gave every accused criminal the "right" to a lawyer, because it helps stage-manage the victim, with a lawyer who has to do things the judge's way. In America, such government-appointe d lawyers are the means by which hundreds of thousands of poor people are railroaded into prison.

Most American court cases never go to trial, never see a jury; it is the job of the victim's lawyer to "sell the deal" that the judge has decided will happen, or else. This is how people accept a "plea bargain" so they accept going to jail for 3 years even though they are innocent, instead of going to trial before a jury: The victim is warned: you accept a "bargain" of a few years in jail, or you go to jail the rest of your life.

Often, both "sides" of lawyers are actually working together for the government, or for the big corporation or rich person who is bribing the judge.

In the American legal system, you essentially have no recourse against wrongdoing by your own lawyer. A lawyer can sell you out, betray you, steal your money, engage in malpractice, help out the other side, hide the evidence that proved you were right, or commit felony crimes against you, and there is almost nothing you can do about it.

Part of the reason America has so much crime, even with more than 2.2 million people in prison, is because the people who actually committed the crimes were never arrested.

Any innocent person can get railroaded to death in America.

Multi-millionaires and big corporations, vs. everybody else

The only people who really can expect some fairness in American courts are multi-millionaires and big corporations who pay political contributions and bribery money, and who protect the interests of other rich people. Nobody else really matters to American judges and lawyers.

There is a huge amount of bribery in America. Rich people pay huge amounts of money to law firms with connections, the lawyers walk around with a certain amount of cash in their jacket, and they pass it to the judges in their quiet moments together. Mostly all cash of course.

As an average person, there's no real way to out-bribe a big corporation, regardless of what your lawyer promised you. That's why big companies win most of the time.

Judges set up a trial in all sorts of ways, giving orders that all sorts of evidence be hidden from a jury, for example. The judge may declare, for example, that the evidence that proves you are innocent or right, will not be allowed at the trial.

Jury trials are actually very rare in America, unlike what you see in the movies. Most cases are "settled" through some deal or extortion or intimidation. If there is a jury trial, they tend to stack the jury with un-educated idiots who will tend to believe whatever lies they are told by the judge and the government.

Yes, there are "appeals" courts, but these are just more judges, who are usually friends with the lower court judge who originally sold you out.

Americans love to talk about "taking it all the way to the Supreme Court!", but this is a nearly empty hope for real people. The U.S. Supreme Court simply refuses to consider most cases that are presented to it.

If you are a little helpless nobody, the appeals judges often barely reply to you, and sometimes don't reply at all. Sometimes people have been strapped to a table and given the lethal poison and put to death in America, with the victim's appeal never even answered by the judges.

The Hollywood image, versus the grim reality

Around the world, people derive an image of America, and its legal system, from these fictional creations on film. America's propaganda about having "the greatest legal system in the world" is one of those phony stories that Hollywood is helping to sell.

In the Hollywood version, the judges in American courts are like kind uncles, smiling and being wise and calmly dispensing justice. But in reality, American judges sometimes scream at people like disturbed perverts, and show off their bribed corruption right there in the courtroom.

In the Hollywood version, there are brave lawyers who will fight for your rights, to win justice for you in the American courts. In reality, you can't find an American lawyer brave enough to fight judicial corruption, even if you are innocent and the judge's friends have threatened to murder you, or threatened to send you to jail for the rest of your life.

In the Hollywood version, the average person is also helped by the "brave investigative reporter" at some newspaper or television station, who shows great courage in exposing the truth, and bringing powerful wrongdoing to face justice. However, the brave "investigative reporter" in America is now as fictional and non-existent as the "brave lawyer" who will fight for your rights.

In America today, reporters are little timid people who are afraid of getting fired, and who almost never write a story on government corruption, unless some other part of the government is officially investigating or prosecuting. That goes triple when judges or lawyers are involved. The owners of the newspapers and television stations are afraid of revenge by the judges if they have to go to court.

No recourse against crime and fraud by judges and lawyers in America

In reality, there is almost nothing you can do against misconduct, and even open felony crime, committed against you by American judges and lawyers. All of the official complaint procedures you find on the internet, or at the courthouse or in the law books, turn out to be a joke, a farce and a fraud.

Complaints about lawyers in America, usually go to the "Bar", which is itself run by the judges who are involved in bribery with the lawyers. And complaints about judges go to other judges, their friends.

Nearly all the complaints about lawyers and judges - tens of thousands of them - are kept secret. Nearly all are dismissed or ignored. They are generally only used if the judges or politicians want to specially destroy someone. Otherwise, criminal acts by lawyers and judges get a smiling cover-up.

The police and FBI almost certainly will not help you, either. They all know the bribery game, and they rely on the same crooked judges to help send innocent people to prison.

The newspapers and television and media won't help you. They hear stories like yours all the time. The USA media are afraid to help you, afraid of revenge if they expose judicial corruption.

America's politicians will not help you. You can also forget about most of America's human rights and civil liberties groups. Many are just money-raising groups which don't help victims. They are all scared of the legal system, too.


The growing American nightmare

It can't go on like this forever, but it may get a lot worse first. Perhaps, it will not be until after America has had a major economic or social cataclysm, that the big American machine of legal corruption finally comes to be reformed, after a complete revolution in American life has swept away the old order.

American lawyers have become both the mafia and the Gestapo of American life.

American freedom is already largely lost. Americans who imagine they are still "free" are the ones who have not yet seen the lawyers and judges who smirk and laugh as they deny victims the most basic human rights. The truth is that, inside America, a nightmare has begun.

Tonight, between the hours of 9-11 p.m., marks two years of my
brother's murder by the San Francisco Police Department and the lies
and cover up that followed. Today, we still do not have the answers
of what transpired that night. The public has not been given a change
in police policy, tactics and procedures that would stop anyone from
being murdered by vicious and unsympathetic public servants. And yet
we all continue to endure with our day to day lives: waiting,
listening and being cautious while mourning, as we remember our
family members. Today, I think of my brother and all of the families
who remember loved ones and ask everyone to say a prayer, meditate,
or keep a thought of life and peace as we reflect about their time
here with us.  Please do not digress in this struggle for the truth
and justice for those we have lost. We will have Justice for Asa,
Oliver, Idriss and the mounting others who have fallen, or will
continue to fall, in the hands of a flawed system by those who
believe in it.  Accountability is a word that should be adopted and

I can imagine how extremely difficult it has been for your family since that terrible day. I pray that you and your family get justice somewhere down the line, despite this criminally injust

Hi Kahil!

 

I can imagine how extremely difficult it has been for your family since that terrible day. I pray that you and your family get justice somewhere down the line, despite this criminally injust "just us" sysytem. In the article written by Carol Harvey following Asa's death, I meant what I said that "I could've been Asa." To this day, many people know that what happened to Asa should not have happened.

Thank you so much for lighting the blue candle in Asa's honor. It is a
big help to me and I am honored you have placed it next to Idriss's
ashes on your alter.

I know Asa and Idriss would have been good friends if they were alive
today. As it is, we are morning the losses of our beloved sons killed
by some SFPD members only one week apart in the month of June but in
different years.

Idriss and Asa are what brought you and I together. Justice for their
deaths is bittersweet because no mater what, nothing will ever bring
them back to life again for us or anyone else.

I am here for you as I know this is a hard week for you as everyday
must be. I will be thinking about you and Idriss all this week as I do so often
as it is. Seven years your dear Idriss is gone from you...the would has lost
another great young man. I wish I had known him in person while he was alive. I
know him in my heart forever as a sweet young man just as Asa was. Nothing will
bring Idriss back to us and it is heartbreaking.

I am speachless with the death of our children and loved ones in the manner in
which we have lost them.

This is a special SHOUT OUT  for MESHA who has been there for all of us, especially for those who have lost their loved ones by the hands of police.

My thoughts are with you always and on the 7th marker tomorrow, June 13th, of the death of your only son IDRISS, whom I have grown to love through you.

I grieve with you. I hope you will be surrounded by loving friends and family (if you so wish to be) to make this unfortunate day easier for you to get through.

This month of June is so much more full of markers of various significance for myself and others that I wish sometimes to skip it all together. As it is, we are still here on earth to be the representives of those who are no longer here and for events that have past and that are still unforgetable.

I will also be lighting a candle for Idriss in his honor tomorrow.

Yesterday I was consciously trying to block the upcoming dreaded 7th anniversary date of my child death, and went to bed around 2 am after working on Idriss Stelley Action and Resources Center tasks of the day.

Then I was jerked out of bed every hour by terrible leg cramps and walked around the bedroom all night  to alleviate them, to no avail, then gave up and  started working again...


Then reading your wonderful message, I understood and remembered why the night was so gruesome:

The physical pain, fear and anguish of our Loved Ones,
especially if we were not by their side during these unspeakable last seconds  to hold them during their violent, sudden transition,
haunt us and live in our bodies and souls for the rest of our lives,
more intensely when, as you put it,
the
"markers" strike,
Birthdays,
"holiday season", "thanksgiving", "Valentine",
and for me the worst of the worst,
"Mothers Day"

Grief has no set deadline...
But disquiets many people not impacted by similar fatality, uncomfortable with our lingering pain, which  prompts them to tell us,
often times with the most candid intentions:

"Forgive and Forget"
"You do not have enough faith in God, and must rejoyce for your Blessings"
"Why do you continue to be such an angry person?"
"You need some Healing !"
"Don't be so selfish and self absorbed, c'mon, there are people who suffer way more than you do"
"You need professional help"
"It is time for you to move on and get on with your life"
"Why don't you just adopt another child./ get married again /  move to another city/country  / get a hobby / focus on the living"

So we go to yet another church
(trying  to dispell the lingering feeling that we are tiny marbles spun by the hand of God all over this planet), and are told that pastors are not social workers,
we pray;
meditate;
attend "healing" support groups;
go to psychotherapy;
pay spiritual healers, "clairvoyants"  and massage therapists,
and receive (or not) support from friends and families,
while Grief and loss continie to run havoc on our (ungrateful) souls.

I am unfortunately estranged  from
"biological" family, (irated by embarrasing publicity around Idriss' death in their respective countries ),  and have precious but rare friends,
the enormity of our organization's task not leaving time for personal socialization.

But I have gained thousands of professional allies and invaluanle kinship with countless of our local, national and global Grieving Families ever since Idriss' passing.

Kathy,
Akila, Big Mike, Corinna, Danny, Donnie, Frank, Julio, Khalil, Leroy, Malik. Marlon, Marylon, Mirna, Nate, Regina, Sanhg, Shannon,'T', T-sha, Toni, Vira, Wendee,
(you know who you are...)
and the countless of other impacted Poor, Black & Brown Sisters and Brothers across our world,
we ARE
"Extended FAMILY", forever.

Our grief can and  is  transmuted into a Driving Force
of Transcending Love, Courage and Solidarity !

In the worst moments of doubt, despair and adversity,
we must remember that we NEED EACH OTHER,

and as
Frank Rosenberg,
(now in his mid 70's, unabatingly showing up in support of all of us at vigils and rallies, and transcending beyond  the killing by Hayward Police of his child Mark), invariably remind  us with his winning smile:
"
NEVER GIVE UP !"

To navigate the dread of today, I will go to SF City Hall and bring my application for a seat on the SF Drug Policy Review Board.

Whether I get elected or not,

I will continue the work of the SF Black and Brown Equitable Drug Policies Coalition that I started last month,

to contribute in decreasing odds for Poor, Black & Brown criminalization,
and hopefully help saving lives,
whether suddenly and brutally Stolen,
or slowing fading through life sentences without parole.

In the same fashion, our agency is actively involved with,
just to cite a few, (SF Based actions) :

* La Voz Latina
* NO_2_Gang_Injunctions
* Ban Tasers
* Brigada Contra Las Redadas (Stop the Ice Raids)
* End_ROTC
* Cultural Awareness Trainings for Code Pink and Global Exchange
* The Mycellium Garden Project (Environmentl remedial Justice)

* and soon with Pueblo in Oakland

I seat on the national Board of Education Not Incarceration
and help with Cindy Sheehan (
R.I.P. Cassey) for CA Congress Campaign.

When I return home this evening,
I will share a playful, quiet moment with Idriss' now old dog Nanok,
and pick fresh flowers from the yard to place on the Altar,
where Idriss' 12 pounds of ashes rest in a shrine in my living room,

By nightfall, I will lit candles throughout the apartment and keep the electricity off, except for the DVD to play Idriss' favorite  song
"One Love",
and his beloved Mile Davis 'Aranjuez Concert',

while  looking  at our Vidas Robadas  picture album, portraying all our Lost Angels in the greater Bay Area, at least the ones we know of.

I am fasting today to celebrate their loving memories,
and your Lives in the Struggle.

HIP HOP COMMUNITY TACKLES POLICE BRUTALITY

No Stranger to the so-called “Long arm of the
law”, the Hip Hop community is proving that as
the politically charged rap group dead prez
stated, “it’s still bigger than Hip
Hop”. Lately, it seems the climate has shifted
to a defensive position for many Hip Hop
notables. From the Congressional Hearings to the
Jena 6 calamity, many artists are beginning to
utilize their microphone muscle to battle social
injustices. The latest battle is an age old
quandary: police brutality. Over the years we
have witnessed outrageous brutal attacks by the
“Boys in Blue”. We have observed everything from
the beating of Rodney King and the unthinkable
sodomy of Abner Louima, courtesy of NYPD armed
with their weapon of choice: the common bathroom
plunger. We were also devastated by the case of
Amadou Diallo, Sean Bell, Kathryn Johnston and others.

In 2007 the alarm has been sounded and the Hip
Hop Community is responding. Nationwide, a number
of organizations and individuals from the
National Hip Hop Political Convention to “The
Peoples Congresswoman” Cynthia McKinney have
endorsed a new crusade called Cease Fire: Stop
Police Terrorism. Cease Fire: Stop Police
Terrorism is 5 days of resistance scheduled to
kick off November 21, 2007, marking the
anniversary of the Atlanta Police slaying of 92
year-old Kathryn Johnston and it will conclude on
November 25, 2007, marking the anniversary of
Sean Bell the 23 year-old who was murdered by New
York Police on his wedding day. EDI from the
Outlawz, the Hip Hop group founded by Tupac
Shakur has stated, “We as a people have to
address this issue, in a more hands on
approach. I’m not talking about violence, but we
definitely got to address this situation, when
they’re shooting down our young Brothas and getting away with it”.
“They’re off the hook, grandmothers aren’t even
safe in their own home, there has to be
accountability”, declared Jalil from the legendary rap group Whodini.

Plans for Cease Fire: Stop Police Terrorism
includes vigils, press conferences, rallies,
panel discussions, teach-ins, poetry and
concerts.
The goal of the Cease Fire Campaign is
to educate and inspire people to rally around the
countless victims of police murders, misconducts
and false arrests in their areas. “There are
plenty of organizations, artists and individuals
that have been working around these issues, we
are simply saying let’s fly under one banner…”,
stated one of the key organizers, Kalonji Jama
Changa of FTP Movement, “…this is something that
is affecting all of us, so it has to take a
collective effort”. A few other Hip Hop
representatives that have endorsed the Cease Fire

US District Judge Jeffrey White ruled Aug. 5 that there were enough unanswered questions for the case to be heard by a jury after both parties filed motions for summary judgment.
The city has since taken that decision to the Ninth Circuit Court of Appeals, meaning it may be well past October before a trial begins.Asa's mother, Kathleen Espinosa, says she has nothing against the police and that one of her close relatives works in law enforcement.

"I've never been through something like this," Espinosa said.The funeral director told Espinosa he'd never seen a body in worse shape  than Sullivan's and that the reconstruction for an open-casket ceremony was tedious. "I've never had anybody in my family die in such a horrible way. It's been really hard. I've been on jury duty once in my life, when I was in college."
Espinosa placed sunglasses on his face because his eyes were gone. She says Sullivan never wanted to die.
"I want Asa to be vindicated.... He never meant them any harm," she said.

The SF Quezar Stadium might be a suitable avenue... although it is right next to Park Police precinct.
Author and Ecologist Starhawk hosts the yearly Spiral Dance at Quezar (where we customarily build a Stolen Lives Altar on event day), that has drawn up to 2000 peeps, and could help you secure the location

The Women's Building would be better attended by activists, but also 1 block away from Mission Police Precinct. Their auditorium is much smaller, probably holds up to 700, not sure...

The Brava Theater in the Mission District is the best avenue, but also smaller. JavierReyes, artistic director of Colored Ink, is your man to secure it probably rent free

Bill Graham auditorium is much more suitable as far as capacity goes, but we have no connections there.

She probably won't be favorable since your family member Asa Sullivan's federal case comes up in SF in October and she might deem the concert as strategically unfit and a logistic conflict,  but if you draft an outreach appeal including fallen officers, she might consider. But Fong is also under heavy scrutiny and pressure from the Police Officers Association, 2 law suits filed by Officer Cohen and 17 colleagues, another by fired deputee chief Tacchini, and her failure to take target practice for the past 5 years, so likely she will be opposed to any controvertial event with her department.

That angle to include tribute to fallen officers might not be welcomed by your biological and extended family at large, the constituency of their allies and other grieving families whose Loved Ones have been disabled or killed by law enforcement.

are possible avenues, City Hall open space is probably excluded, open space would mean renting commensurate portapotties that are very expensive.

You also have to factor in Sound Permits, Health Department Permits, and a 1 Million Health Insurance Policy what can be a check held by DPH until after the event, then cancelled if there were no injuries or destruction of public property.

The city might require hiring cops to provide security.
You would need to meet with the captain of the related precinct to plan for mutual safety. We have found it especially crucial to fend off the usual infiltrators on payroll, posing as young anarchists with masked faces under black bandanas, paid to throw rocks and bottles at cops and store front to justify arrests. It is a You Know We Know You Know We know
kinda strategy that prevents most cops foulplay.

We can try to secure security through SF ANSWER, Critical Resistance or NOI, some free, some at cost, which does not prevent the city to demand rent-a-cop services at $75 per capita.

Clean up after the event has to be done by your own crew, any trash left behind leads to a prohibitive, huge  fine.

Our Bang4Change Civil Rights Revival Festival in front of SF City Hall in Feb 2006, between permits, props, sound truck, securing vendors space, publicity, outreach, flying some speakers from across the country, etc. costed us about $12,000.
With little over 1000 people in attendance, which was great but not financially sound.
We also had a problem with a "volunteer" who was a City Hall plant, hired by officials to sabotage and crash the event, who disappeared with the sound truck one day prior, claimed to moderate "Bang4Change" website but would ignore inquiries on the site in terms on vendors, performers and speakers, Fortunately we were able to keep him at bay on the day of the concert and pull it together.

The SF political climate in SF is bleek in terms of staging the concert in our City:
even "progressive" officials are pushing for beefing up police salaries (in spite of a 25% pay increase last year), and benefits to increase recruitment and retention,

The City Attorney Dennis Herrera is extending Gang Injunctions and related restaining orders in all gentrifying areas,

Mayor Newsom revoked Sanctuary protections on Juvenile undocumented offenders, and illegally reel then  into the Criminal Justice Systen instead of Family Court,

and "Quality of life" officials are increasingly pushing for criminalization of the Homeless all over the city.

Deprioritization of the Marijuana Offenses Ordinance is widely circumvented by precincts,

and Newsom is shutting down myriads of shelters and social services, while Executive Directors of the Public Sector salaries are beefed up to obscene levels.

So much for the "most Liberal City of the World"

I do not want to discourage your plan, but brace up for hords of administrative barriers and muddled agendas from assumed "allies"

If you draft an initial appeal to City officials, we can help you process it through assumably supportive channels, and see what falls back your way,
