Dear Sri Vashistha,

I went through your post and believe that though you are working for Human Rights, Child Rights and Right to Free and compulsory education to all children is also a part of your Agenda. All India Forum for Right To Education is opposed to Neo-liberal agenda of the Govt and PPP, esp. in the field of Education. We have planned to organise a Rally and March to Parliament on 24th Feb 2010 against the issues related to RTE. I attach a few documents for your kind perusal that will explain our stand on the subject. 

I request you to please read them and point out the points of agreement (or disagreement) and whether you can join the Rally on 24th Feb. Some of us shall be in Delhi from 12th Jan and may like to discuss the issues and the programmes with you if you are interested.

Thanks Vikas for that encouraging support and i hope it doesn't become a knee-jerk reaction. Governments can not surrender their duty to ensuring fundamental rights of children to education to private players. This would mean privatisation of Fundamental Rights of Children for all private entities work for profit. We are with Anil Sadgopalji together on this issue.
 
Having seen the interest of urban middle class and even those who can afford to send their children in private schools in education forms, I have come to following conclusions:
 
(a) No urban middle class seem to be concerned about quality of education in Govt. School because their children do not go to these schools.
(b) The urban middle class is more concerned on fighting for agitating the fee-hike in private schools and prefer their children to go to private english medium schools and the truth is more than 90 percent of us connected on various forums don't send our children to government schools due to concerns of low quality of education.
(c) People who children go to these schools are from lower income groups which no awareness and lack of support  to take up such issues. Not many are IT friendly and they work very hard to make their two ends meet and left with no time and initiative and hence reduced bargaining power.
(d) In rural areas even, especially in towns and kasbas, Private schools are flourishing because no media or political leader take up the issue. People who are send their children to these schools are looking for means even by selling their properties, eating less leading to malnutrition, in order to send their children to private schools and not challenging the degenerating government schools.
(e) Whole effort of the parents across nation whose wards are going to government school is not to challenge the education system but to find means to get their children in to good private schools. It only indicates hopelessness and lack of leadership and mass movement.
 
(f) To get this in to a movement we need to find ways to reach out to the population whose children go to these schools may be with use of media- both print and electronic, pamphlets and block/ward level gatherings of the stakeholders across nation using laws and UNCRC, CRPD and Right to Education in our favour.  Else, this may continue for many more years.

Dear Friends.
When are we going to give up our kumbhakarni nidra? There are people
(actually activists) like Anil Sadgopal, who have been struggling for
fundamental reforms in education consistently during last forty years.
There are many similar other fighters. However, instead of leading to
any progressive change, the sphere of education is being deteriorated
further. Now it is high time, because demand for reforms would remain
alive only till that day, when we have Government schools. If there
are know Government schools, all demands for reforms would become
meaningless.  How can we sleep quietly when thieves are stealing  our
property and selling it to other thieves? Ruchika case gives me two
feelings. First, media can mobilize people. Second, why cant a
revolution takeplace on the issue of education?

New Year at this political juncture, for me, is to challenge and confront the Neo-liberal state to protect , if not all  human rights but basic rights such as right to decent livelihood, right to equitable and meaningful education, right to good health and right to shelter .

 

I wish a very happy New Year that would give more energy and courage to fight this bankrupt, inhuman and faceless greedy state which is lusting for profit and commoditization of every single  aspect of human life including love and affection.

 

Let us work together.

am a doctor working with Medecins Sans Frontieres (MSF or Doctors
without Borders) in Chhattisgarh state in India. The project we run
here primarily targets communities caught up in the ongoing conflict
between the government and the Maoists rebels in central India, and
offers access to healthcare for the vulnerable, distressed populations.
Christmas Eve this year will be spent running one of our mobile
clinics. For these, we drive 75 minutes from our base in four-wheel
drive jeeps, get out and don our backpacks (which contain all our
clinic supplies such as drugs, weighing scales, patient registers and a
lot of water) and then walk for about 8km (90 minutes at a brisk pace)
through the forest.
We wade through rivers, pass by grand old trees, fields shocked with
wildflowers, skip over snakes, lizards, and salute members of the local
Adivasi tribes we meet on the way. These wizened, hardy people, dressed
in loin cloths and leaning on bows almost as long as themselves watch
on nonchalantly as we finally stop in a small glade and set up our
clinic under the shade of gnarled towering trees.
And then within minutes, slowly at first, but then from every
direction, where no-one seemed present just minutes ago, mothers emerge
cradling their children, or men step past carrying palanquins holding
infirm elderly relatives.
After returning home, plans are usually made for the mobile clinic
the following day, but it being Christmas Day, it will instead begin
with a ward round of the inpatients in our mother and child clinic in
Bijapur town, and then a morning outpatient clinic till midday.
Later on, I’ll return to our house and have a Christmas curry with
the team and take some time to reflect on how lucky I am to be able to
live this life and do this work in the raw heart of this subcontinent.

Jharkhand Assembly Election is over. The people of Jharkhand did not give a clear mandate to any political party or alliance, which surprises many people across the country precisely because there was a hue and cry on corruption prior to the election and it was also an assumption that the people are fed up with the corruption, instability and uncertainty created by the unholy alliance, small parties and independent MLAs therefore the expectation was for a clear mandate. Unfortunately, everything went just the opposite. The corruption icon Madhu Kodas wife Geeta Koda, Enos Ekka and many other corrupt and tainted candidates won the election. In fact, among 81 elected members, 59 of them (73 %) are tainted with pending criminal cases like murder, kidnapping and theft. Therefore, what kind of governance is expected from these people other than corruption, crime and corporate terror?

The fact of the matter is the people did not give their mandates to the corrupt and tainted candidates but they got elected only because our democracy is on sale, which was clearly seen during the election. Now even the voters know that they can sell their votes at least once in five years. There is a major shift noticed in the villagers minds. The slogan no development, no vote has changed into no money, no vote, which the political parties have legitimated by openly distributing cash and kinds in the villages. According to Narottam Kumar of Dharampur village comes under the Mandu assembly constituency in Hazaribhagh district, a candidate of the national party gave Rs.50,000 to the villagers, carpets and Rs.10,000 to women group and provided liquor to men. Similarly, in Singhbhum region Rs.1000 packed in envelops distributed to each family and even the first time contesting independent candidates spent Rs. 5 to 10 lakh and secured 5 to 15 thousand votes.

According to the latest report, the corporate houses have spent more than Rs.300 crore in Jharkhand Assemble Election by giving money to the political parties so that they can buy the votes and bring policies in favour of them. Interestingly, the fourth realm of the democracy -the Media also adopted the culture of coverage package, with the principle of no money, no news. The media houses had told to the candidates that if they want good election coverage, they must pay them in forms of ads. Now, it is socially accepted that a candidate can buy the votes, voters can sell their right to vote and the elected members are free to bargain for money generating miniseries. But the most shocking fact is the Adivasis who are known for their honesty are also involved in buying and selling the democratic rights and also favouring the corrupt politicians.

Ironically, the holy priests are also in the part of unholy business of democracy. Will you be surprised if someone tells you that the corrupt politician Enos Ekka won the election and Benjamin Lakra with a clean image contested on the ticket of the Congress lost election only because the holy priests wanted that to happen? It is fact that the holy priests mobilized the people in favour of Enos Ekka on the basis of the work and benefits that he has ensured for the holy priests when he was minister before going to jail. Indeed, many Congress candidates lost the election only because the holy priests wanted to teach a lesion to the Congress. They believe that the Congress is the real culprit for Adivasis plight, which is of course not wrong. But the question is will they welcome the operation white hunt of Sangh Parivar against the Christians only because they hate the Congress? If the Christians are attacked in Jharkhand, they should not cry foul or pray to the almighty God to save them because they have handed over their houses to the devil for taking care of.

However, the things in the state have gone extremely wrong despite the strong secular forces prevailing in the state; the communal forces could able to grab the power. In the Jharkhandi market of democracy, the Congress, JVM, AJSU and JMM are the gainers and the BJP, JDU and RJD are the losers but the biggest loser is the BJP, who has lost 12 seats despite having favourable climate for winning the election. Ironically, the BJP was not ready to concede the moral defeat and formed government with the JMM, AJSU and JD(U). The BJP has become shameless party, who can do anything for grabbing the power. The Congress-JVM alliance did not go for any kind of horse trading despite emerging as the biggest alliance with 25 seats. It seems that they are looking for the long term politics. If they could be able to maintain their alliance, they would be in the driving seat next time.

Jharkhand is really an unfortunate state, where an independent MLA can become the state head, any one can manipulate the public opinion for grabbing power and swallow the huge public money. Take the example of the BJP, who defended its tie-up with tainted JMM leader Shibu Soren though they had tirelessly criticized the Congress for giving him ministry in the UPA-I. The BJP president Nitin Gadkari defended the partys decision of supporting JMM leader Shibu Soren to form the next Government in Jharkhand saying that stability and interests of the people of that state were the only concerns. Gadkari said it was Congress and not Soren who was responsible for corruption in politics. But he forgets that the JMM was the part of Madhu Koda government and not the Congress. It was supported from the outside but of course the Congress can not be given a clean chit. Both the parties BJP and JMM seem to be the power hungry therefore they can justify everything. Another twist is Bandhu Turkey, who is supporting Sibu Soren to ensure that the investigation on purchase of games and sports materials for the national game halted. Most important question is will the BJP who tirelessly cries foul on the issue of corruption, shield Bandhu Turkey?

Guruji Sibu Soren is also unique in many ways. In the Assembly election of 2005, he had ensured the defeat of the JMM by adopting the dynastic politics and now he became another Jai Prakash Narayan in giving secular certificate to the BJP, who was the key player in the demolition of Babri Mosque, Gujrat riots and Kandhmal violence. He repeatedly said, BJP is not a communal party. After joining hands with the BJP, now he knows that the BJP is a secular party at least better than the Congress. The question here would be if the BJP is a secular party why he was the part of the Congress alliance earlier and also did not go for the pre-poll alliance with the BJP? Can he be allowed to portray a lion as a lamb merely to grab the power? Most of the MoUs (54) are signed by Arjun Munda to sell forests, rivers and lands of Jharkhand in the hands of the MNCs and Sibu Soren fought to save these. Will he be able to save land, forest and water with the BJP supported government? Can he say that the BJP is not a capitalist party or only the Congress sold the Adivasis resources? How long Sibu Soren will carry on unholy politics for grabbing the power?

Jharkhand has been victimized by unholy politics right from the beginning. The state has witnessed the unholy politics brought by the BJP, flourished during the regime of the UPA and supported by the JMM. In these circumstances, Jharkhand can be saved only through two ways i) a new regional party emerges with the understanding of Jharkhandi culture, socio-economy and politics of the indigenous people and ii) the almighty God, who can throw light over the power hungry and corrupt politicians for resurrection of the state. The unholy politics must be stopped if the state has to address the peoples issues, engineer its destiny and grow with prosperity. Though Sibu Soren seems to be enjoying on his political move at this moment but he must be ready either to be jailed or leave the chair of the chief minister within next 6 months because he would be surely facing investigation agencies and one more Tamar test (election) as well and Jharkhand would be on sale, loot and robbery once again. Indeed, the future of Jharkhand seems to be dark under the unholy politics.

Woh desh main kya hain?

      “Who desh main kya hain?”, Kopa asked me. (What is there in that country?)

      “Wahape bara bara makaan hain, rasta achcha hain, bohut  saare gariya hain,” I responded, “lekin aadmi aadmi se etna aasani se mil nehin sakte, jo yahape mil sakte hain.”(There are big buildings there, the roads are good, and there are many cars, but it is difficult for people to easily interact with each other, as is possible here.)

      We were sitting in a wayside small tea stall in Bairamgarh. There were only twenty or so odd kilometers to our destination of Lingagiri, and we had felt that it would be good to have a break and have lunch. Kopa knew the area well, and the shop keeper served us delicious warm idlis and hot steaming tea soon after we took our seats. The long ride in from Dantewada on Kopa’s motorcycle had left us exhausted, and the food gave us renewed energy and strength.

      “To aap kyon udhar hain?” (So why are you there?)

      Why? And, the hidden question, why I am not here? Why are you here if you stay there?

      “Mera kuch kaam hain, wahape kar raha hoon, lekin haan, is desh ko bohut yaad aata hain”, I said. (I am doing some work there, but yes, I do keep on thinking about this country.)

   Aayein, aayein, aap idhar chala aayein”, he said. “Idhar aap ko sab kuch mil jayaga.” (Come, come back to this country. You will get everything here.)

      “Haan, main aunga, kuch saalon mein”, I said. (Yes, I will return in a few years.)

      “Mein bhi giya tha shahar. Raipur giya tha training mein. Lekin bilkul achcha nahin laga. Udhar sab chota ghar hai, kamra bandh rakhne ko hota hain. Aur aadmi bhi sab apna kaam mein rahta hain, dusro ke liye wakt nahin hain”, he said. (I also had been to Raipur. I never liked it there the rooms are small, and one has to keep the rooms all closed up. People are busy in their own lives, and do not have time for others.)

      “Yeh to baat hain”. (Yes, what you say rings of the truth.)

      And if that is Raipur, what about Delhi? Mumbai? London? New York? The closed quarters, the isolation in a city of millions, the desperate rush all the people have to do what it takes to fulfill their own dreams?

      “Mera idhar hi achca lagta hain. Ketna hara hain, khulla aasman aur zameen. Aur humko aadmiyon ka beech mein kaam karne mein achcha lagta hain. Yeh social work karne mein mera dil hain.” (I like it here. The open skies, the green expanse. And I like working with people. My heart is in social work and working with the people.)

      And no wonder the people love you too.

      I saw it in every place I went with him. He was the voice of authority, to whom the villagers listened, yet he was at all times eagerly listening to any of their problems, and encouraging them, sharing a laugh with them. When in Lingagiri, he would be telling an eager and excited crowd of villagers about the upcoming health training programs, the passion and dedication came through in his voice. He genuinely believed that it was through the bettering of the lives of the people that the problems could be solved.

      I never heard him singing, but I had heard that his voice mesmerized people. He could spread his word of joy and happiness, yet convey his message, in the most pleasing tones. The Gondi language is a tonal language, and its sing-song nature makes songs even more appealing.

      And little did he know that in a few months, he would be languishing in the corner of a dark prison cell in Bairamgarh itself, perhaps only a little distance from this shop, mercilessly beaten and bruised, for some trumped up crime that he never committed?

      Does he know why this has happened to him?

      “We are not interested in those stupid crimes you have committed – the thought is all we care about”, O Brien told Winston Smith in George Orwell’s 1984.

      Does the state at all care who killed Punem Honga? Even if they claim that Kopa did it, which they very well know he did not, like they knew Binayak Sen had absolutely nothing to do with Maoists, does it matter to them?

      You see, Kopa, the problem is not that you might have committed such and such a murder or something as irrelevant as that. The authorities know that very well. Do not worry, some day you will be set free. Even if you are found guilty and asked to serve a long sentence, or perhaps after several years some “evidence” suddenly turns up proving your innocence. You will eventually be set free. Maybe, if they are feeling generous, with a word of apology.

      For you have committed a thought crime. You have dared to hope, more so in your own way. You have dared to imagine a world in which the people of Bastar live in harmony with their surroundings, as they have every right to. Gantala Baby, Adavi Ramadu’s mother, also dared to hope that she might not have to move again.. This is your crime. And Gantala Baby also has committed a crime by hoping - maybe she will have to be punished as well.

      As O’Brien went on the explain Big Brother’s ideology in 1984, “Humanity is the Party. The others are outside – irrelevant.”

      You are irrelevant. Yet, you are unable to see it and are intent on spreading the illusion. Therefore you must be stopped.

      Now, did you really not like Raipur? Why not? Are you sure? Don’t you think that the pattern of development that banishes people like you to the fringes of Indian cities is the correct way society should function? That there will be people who have everything, and some nothing, and that is the pre-destined order? Can’t you see the grand scheme of things? And for heaven’s sake, what is this nonsense that you are singing about green fields and open skies? Cannot you be happy watching the television, even if you have not learned to browse the internet?

      Or will some more blows with the rubber tipped bamboo cane convince you?

      You see, development cannot be stopped. In this world everything has its place, every person or object must be viewed as a resource. If that resource is not economically productive, it will be deemed unnecessary and will have to be eliminated.

      If you do not like going to Raipur, Raipur will come to you. And you will like it. We tried to make model cities by putting people into camps, even opened schools for the children there, but most people did not seem to like it! Perhaps it was because of misguided people like you? Don’t you know that it costs a lot of money, and we owe large amounts to certain mining interests who will not be named – these things do not come for free?

      Yes, there were one or two incidences of people being killed in camps like Matwada and in places like Singaram, but could you not see that those were an inevitable part of the process? We do not think you were able to understand the big picture. And who asked you to open your big mouth and talk about these killings to the whole wide world? What would they understand? Do they know what it is like in the forests of Bastar? Have they ever bothered to come here in all these years?

      No, they have not. Because they do not care. But we do! And we love you Kopa, just as much the people in Bastar do. It is just that you are unable to see it at this time. But we are sure you will understand. It just would take some time. And it would be good for your own future. Think of it. Say when you are older, and stumbling along like a lost soul in a street of some megapolis, you might still look up with a clouded vision to the lights that shine from the rooms in the buildings above, and perhaps ask yourself the same question again - “Kya hain us desh mein?” 

      You do not want your life to come to that!

      Look at the tribals who have joined Salwa Judum, if they could believe in the vision, why not you? Ok, we had to pay them a bit. But we were willing to give you a lot more, and even “requested” you after administering ten of the best with the heavy stick; You were not “forced”, as the VishwaRanjan, the DGP of Chhattisgarh was, during his visit to Berkeley, when he signed the petition urging for Dr. Binayak Sen’s release after being offered a pen and a piece of paper by a member of the audience. Yet you hold on your dreams, your aspirations, and the misguided notion that people can live within each other in the midst of nature and have a fulfilling life?

      “When you finally surrender, it must be of your own free will”.

      Dreams die last, but die they must. The civilized world has lost that power to dream in which humans can reside in nature, and along with each other. Yet dream people must.. For that, they must recreate those imagined worlds, through the internet and television and other appliances. But in that world, people who have dreamed on their own will be considered threats, something that must be eliminated or sidelined.  And it would be the dream only of a few select people, for there are not enough resources to make these dreams for all.

      Kopa, it will be difficult for you to surrender, but you can try. Only you can set yourself free.

      The dreams of the developed world requires metals and other resources. Like the iron ore that comes from Bailadila in Bastar. The ore is washed in the river, as a result of which it flows red through Dantewada. As if the life of the tribals is ebbing away. Operation Green Hunt is meant to destroy everything that is verdant and vibrant, to hunt out what is green and living. It is not meant to capture this person or that; it is meant to break the will of the people and purge their minds of their false dreams and illusions, because of which they seem to stand against development.

      Kopa, even after this, you might never find the answer to the question – “Woh desh mein kya hain?”

      But it is because of you that I can question “development”, and somebody else will do so as well. And maybe, someday many more people will.

      I hope your spirit will always be that light in the dark, which will shine in other people’s mind as it has done in the minds of the people you have lived for.

NHRC ISSUES NOTICE TO CHHATTISGARH POLICE FOR ILLEGALLY DETAINING AND BEATING A YOUNG LAWYER 

Amidst ever-growing agitation of the civil society and lawyers, human rights activists over the illegal detention and beating of young human right lawyer of Human Rights Law Network, Alban Toppo, at Bhairamgarh Police Station in Bijapur District of Chhattisgarh on the eve of Human Rights Day 10.12.09, the National Human Rights Commission has taken cognizance of the complaint made be Senior Advocate Colin Gonsalves in this regard and has issued notice to SSP- Dantewada and SSP- Bijapur.  

In past two weeks, the issue of brutality committed upon young tribal Lawyer Alban Toppo by Chhattishgarh Police has invited sharp criticism  by eminent lawyers like Senior Advocate Prashant Bhusan, Senior Advocate Colin Gonsalves, activists like Medha Patkar, Justice Rajinder Sacchar among others. People’s Vigilance Committee for Human Rights wrote to Chief Minister Raman Singh in this regard. Chhattisgarh Bar Association has also raised this issue with State Authorities. 

Advocate Alban Toppo was illegally detained and badly beaten up by Police at Bairamgarh Police Station on the evening of 10.12.09 and was released on 11.12.09. 

NHRC had received a complaint in this regard by Senior Advocate Colin Gonsalves on 12.12.09 and this complaint was placed before the Commission on 18.12.09, on which NHRC issued notice to concerned SSPs  who have to file their reply within two weeks.

India minister seeks 'negotiations' with Maoist rebels

There has been a surge in Maoist violence in recent months

India's federal home minister has said he is ready for "serious negotiations" with Maoist rebels.

P Chidambaram said the rebels were not "terrorists" and had raised "serious issues" about the lack of development.

Last month, the minister said security forces were getting ready to launch a massive offensive against the rebels.

The rebels are fighting for communist rule in many Indian states. More than 6,000 people have died during the rebels' 20-year fight.

"They are not terrorists attacking India from outside. They are rebels who have raised serious issues like lack of development specially in tribal areas. We are prepared to discuss alternative structures of governance with them," Mr Chidambaram told a meeting.

"I am not asking them to surrender weapons. I am only asking them to abjure violence. That will set up the ground for serious negotiations."

'Critical issues'

The minister said he was all for "serious negotiation".

"The Indian constitution can be amended to create alternative structures of governance in the backward tribal areas to facilitate the cause of development," he said.

"I appeal to the Maoists to stop violence and come out to negotiate these issues. We are prepared to examine their perspectives on these critical issues but we cannot allow any breakdown of law and order."

The minister said the governments in the states where the Maoists were active would be involved in the talks.

Reacting to Mr Chidambaram's proposal, a Maoist leader said the minister was indulging in "double talk".

"He is offering peace and talks but he is sending federal forces everywhere we are operating. He cannot take us for a ride," Koteswara Rao told the BBC.

Last month, a Maoist leader said the rebels were willing to talk to the government if it put off the planned offensive against them.

The rebels have a presence in more than 223 of India's 600-odd districts across 20 states, according to the government.

There have been more than 1,400 cases related to violence by Maoists between January and August, according to official records.

Nearly 600 civilians have died over that period.

The insurgents wield most influence in areas which are poor and dominated by tribes people.

They are also areas widely seen as being rich in mineral wealth which the Maoists say is being handed over to corporate firms while the poor remain deprived.

India: Chhattisgarh authorities must stop torture and arbitrary 
arrests of peace activists and human rights defenders

Amnesty International urges authorities in the central Indian state of Chhattisgarh to immediately stop the torture and arbitrary arrest of peace activists and human rights defenders belonging to the Vanvasi Chetna Ashram (VCA) and drop all politically motivated charges against VCA member Kopa Kunjam, who was arrested on 10 December. The government must investigate reports of torture immediately, and bring those responsible to justice. 

The VCA, a group professing the Gandhian ideology of non-violence, has been campaigning for the last four years against human rights abuses of Adivasi communities in the ongoing armed conflict in Chhattisgarh. The VCA also works for the return and resettlement of some 10,000 Adivasis who have been internally displaced by the conflict between the security forces and the Salwa Judum, a militia widely believed to be supported by the state government, and the armed opposition group the Communist Party of India (Maoist). 

On 10 December, the Chhattisgarh state police arbitrarily arrested Kopa Kunjam and Alban Toppo, a lawyer working with the New Delhi-based Human Rights Law Network (NRLN) at Dantewada. They were taken first to the Dantewada police station and then to the Bhairamgarh police station in the neighbouring Bijapur district. 
Alban Toppo reported that the police tortured him and Kopa Kunjam that night at the 
Bhairamgarh police station. They were beaten with thick bamboo sticks and rubber canes for 30 minutes. Toppo was forced to sign a letter stating that they had come to Bhairamgarh police station of their own accord. As a result of the torture, Toppo sustained injuries on his right elbow, biceps and back, causing severe pain and swelling. He could not move his hands and back because of the pain. Kopa Kunjam sustained serious injuries on his chest, back and leg, which left him unable to walk. 

Although Toppo was released that night, he remained at the police station, as he had no means of returning home. Accompanied by police personnel, he was able to return the next morning. On 12 December, Kopa Kunjam appeared before a local court where he was charged,under Section 302 of the Indian Penal Code, with the murder of Punem Honga, a local leader and member of the Salwa Judum, who had been abducted by the Maoists on 2 June 2009. 

Amnesty International believes that Kopa Kunjam is being targeted because he exposed 
human rights violations by the security forces, including the extrajudicial executions of 15 Adivasis at Singaram on 8 January and three Adivasis in front of the Matwada police station on 18 June 2009. 

Amnesty International has received further reports that the Chhattisgarh police disrupted a peace march organized by the VCA on 14 December at Dantewada. On that day, the Kanker police prevented a group of 30 activists from proceeding to Dantewada and forced them to return to the state capital, Raipur, citing security problems. The VCA is now planning to hold the peace march on 25 December. 
The arbitrary detention of the VCA activists clearly violates India's Supreme Court guidelines issued in the D. K. Basu vs State of West Bengal case and the International Covenant on Civil and Political Rights (ICCPR), to which India is a state party. Article 9 of the ICCPR guarantees the right to liberty, which includes freedom from arbitrary detention. 

Amnesty International calls upon the Government of Chhattisgarh to: 
 drop all politically-motivated charges against Kopa Kunjam; 
 ensure a prompt, impartial, independent and effective investigation into the 
allegations of torture and ill-treatment of Kopa Kunjam and Alban Toppo. Those 
suspected of involvement including persons with command responsibility should be 
prosecuted, in proceedings which meet international standards of fairness. Also, the 
two victims must be awarded full reparation. 
 take all necessary measures to guarantee that human rights defenders are able to carry 
out their legitimate human rights activities without fear of torture and harassment.

I would like to complain about the most insensitive, horrendous and atrocious advertise on the issue of female infanticide called “Dadi Maa ke Nuskhe “in Rajasthan Patrika, dated 9th dec 2009, on page 2.

The advertisement informs the reader the various methods to kill a newly born girl child, which include giving her a table spoonful of salt, to put her in a utensil for a half an hour, to keep a wet cloth her on face for few minutes , and to keep a newly born girl child in a wet towel for half an hour. I was horrified to read these methods, which I even was not aware of, and even you might be not aware of, but thanks to the advertisement now it is easy to kill a newly born girl child.  Right in the end of the advertisement, like we have a warning below a cigarette packet it says “Because of these methods lakhs of girls are killed, let’s stop female infanticide “I wonder what the creative team was thinking while giving this advertisement and what were the judges thinking while giving the award.

On top of that the advertisement totally screams of patriarchal language as the heading being. ;Daadi maa ke Nuskhe’, are we trying to r tell people that our grandmothers ( women ) do not want granddaughters  ( women ) and want to get rid of them in any manner. We all know the discriminatory practices against girl child are not perpetrated by the women but the patriarchy.

 To my utter disgust, I do see that advertisement has been given a “Concerned Communicator Award “instituted by the Patrika Group. According to a press release by Rajasthan Patrika, This ad campaign by Rajasthan Patrika made a place among 157 newspapers from 43 countries that participated in Inma Awards. Judging was based on concept, creativity, copy/graphic design, production, and overall effectiveness, as well as results. The not-for-profit International Newsmedia Marketing Association (INMA) has 1,200 members in 82 countries.

The Concerned Communicator Award has been instituted by Rajasthan Patrika, in 1997, with the intent of identifying and honoring the creative geniuses in the field of social advertising. The contest invites advertising professionals across the world to prepare the social print ads based on any social issue that they feel for. Ad world mavericks including Piyush Pandey, Prasoon Joshi, Prahlad Kakkar, Bharat Dabholkar and Kashia Roy adjudged the 10th CCA that received 4000 entries.

Patrika group is publishing 4 newspapers including 2 evening newspapers encompassing 7 states Rajasthan, Madhya Pradesh, Gujarat, and Tamil Nadu & Karnataka among Hindi newspaper.

 

The advertisement agency which did the advertisement is Euro RSCG is the global agency network and the largest brand of Havas, the 5th largest global communications group. Spread over 75 countries, 221 Agencies and 14,000 people, Euro RSCG is a custodian of some of the world's leading brands.  The creative Team include Nilesh Vaidya, Ajit Shukla and Manasi Bindal of the agency

I do ask you to take strict action; this advertisement actually is very dangerous and goes very much against the PCPNDT ACT, which does not allow advertising of sex selective discriminatory practices in any form.

I am ccing the complaint to State Women Commission, Rajasthan Patrika and EURO RSG advertising agency.

Thanks Gladson.Every word of your statement is true to the core and has always
been so.This applies not only to the civil societies but also to all other
agencies including governments,educational and other institutions.Nothing has
changed in 63 years of Independence and has gone worse in Jharkhand since its
creation 9 years ago and our so called tribal leaders have been party to it.
But why have we depended on others so long. Is it because, we have become used
to hand outs? Or may be the centuries of exploitation and sub jugation has left
us helpless, voiceless and ruderless and struggling for two meals in a day and
roof over our heads. What ever is the reason,its about time we should wake up
and stand up and fight for our share of benifits in emerging India.We the
educated Adivasi people should spare some time for the benifit of the rest of
the community because we have depended on others too long.Its about time we form
our own NGOs and work for our own people. But it takes time to know the ropes
and need financial support and training in the beginning.Similarly our tribal
leaders need to know how to govern and do useful work for all the people.
You have a good start and we support your efforts but we have to involve others
as well.

Now voting compulsary, negative votes in Gujarat polls by: Sikander kushwaha VOTING IS now compulsory in Gujaratafter the state assembly on Saturday passed the landmark bill that also allows a negative vote. The Gujarat Local Authorities Laws (Amendment) Bill, 2009 seeking to amend the Bombay Provincial Municipal Corp Act 1949, the GujaratMunicipalities Act, 1963 and the GujaratPanchayats Act 1993 was passed by the Assembly on Saturday, December 19, making Gujarat the first state in India that has made voting compulsory in elections to local bodies. The new law has made voting compulsory in all seven municipal corporations, 159 municipalities, 26 district panchayats, 223 taluka panchayats and in 13,713 village panchayats of the state. There are many pros and cons of this act like what will be the consequences, if eligible voters do not cast their votes and the like. Still, I strongly feel that citizen of Gujarat first time will get the chance to use the provision of which gives right to say No Vote or Zero Vote and marginalized people will be maximum benefiter of this act. In the present scenario, candidates win the election with the support of only 10-20 per cent of the total population of concerned constituencies because a large majority of the people do not visit the polling booth. This act will empower the citizens of Gujarat to use their voting right as their duty. They can even reject the worst candidate. The government of Gujarat also has to keep some fundamental point while framing the rules of this act to get the anticipated fruit like: how to monitor the voter list, how to deal with the migrants and feasibility of punishment.

Activist fights for rights of Dantewada tribals

The central government has launched Operation Greenhunt against the Naxals in Chhattisgarh, even as human rights activists in the region step up their campaign against it.

Human rights activist Himanshu Kumar has been weaving khadi thread, the symbol of peace, in Dantewada a naxal affected district in Chhattisgarh. As the region prepares for a fierce fight between the Maoists and security forces, there has been an uneasy calm in these jungles.

Himanshu Kumar's Vanvasi Chetna Aashram accuses both the forces and the state sponsored Salwa Judum of perpetrating atrocities on the tribals. Salwa Judum, a section of the tribals in Bastar, see Himanshu as a Naxal supporter.

“That may be because the forces have committed so many crimes against the tribals. They killed innocent people, raped women and burnt houses. we will be bringing out such incidents and expose such cases, and perhaps the government is scared of that," said Himanshu Kumar, vanvasi Chetana Ashram.

Recently Himanshu got marching orders from the government, asking him to vacate the ashram. He alleges that the authorities did not allow him to hold a padyatra in the naxal affected forests.

The police meanwhile justify doing so, saying that it would have been difficult to provide security cover to him and his colleagues.

Himanshu, however, is supported by the likes of Sandeep Pandey who was awarded the Magsaysay Award for social work.

"It is very clear that because Himanshu Kumar is questioning the actions of security forces and the SPOs, he is being branded as a naxalite,” said Sandeep Pandey, social worker.

Himanshu also says that his colleague Kopa Kunjam was recently arrested by the police, when he raised voice against the atrocities. Kopa’s wife wants her husband back.

"I want my husband back, my family wants him back. My children remember him and want me to bring him back home," bemoaned Rita Kunjam.

But, Salwa Judum is vehemently opposing Himanshu as he opposes the proposed Operation Greenhunt. "What has he done for Bastar? For its development? We don’t want such exploiters. He should run his ashram in his own region,” quips Chetraam Atta, a Salwa Judum activist.

Dantewada Police also deny the allegations of human rights violation levied by Himanshu Kumar.

"I think they should all visit this place and see how difficult the life of police officials here is. Regarding the allegations of human rights violation, most of them are baseless,” said Amresh Mishra, SP Dantewada.

Himashu Kumar now seems to be uprooted from Dantewada, and the lone voice that has been raising the issue of human rights violation might be gagged forever.

Uncivilized Practices of the Civil Society

The term Civil Society is mostly used for voluntary organizations, non-governmental organizations and non-profit institutions. These are also called as civil society organizations. Interestingly, most of these organizations are always busy in criticizing the state (which is of course not wrong as the state is a failure), but they themselves behave like the state when it comes to the issues of Adivasis, Dalits and Women of D-section (deprived sections), even though they have also failed in delivering justice to marginalized peoples. Most of these organizations are led by elites even after 62 years of Indian independence. They enjoy corporate rate salaries, luxurious accommodations and air travel in the name of Adivasis, Dalits and women of D-section. The misappropriation of funds in the name of marginalized groups remains uncounted, despite that they are masters in lecturing on the issues of responsibility, transparency and accountability.

There are very interesting kinds of so-called civil society organizations 1) based in the small cities or villages and getting less funds, 2) headquartered in Delhi and other big cities and bagging huge funds, and 3) NGO federations called peoples organizations. Perhaps, the secretary, director and chief functionaries of these organizations are never replaced against their will, though they talk much about democracy. These civil society organizations also bring the mass organizations, social movements and displacement movements into their clutches and cash these in dollars, euros and pounds. Dont be surprised if some organizations based in Delhi show you a beautiful power point presentation about the Adivasi movements against displacement in Jharkhand, Orissa or Chhatishgarh.

There are also the holy cows called funding agencies (national and international), who love to be called civil society organizations, whose prime job is to collect the money, enjoy most of it and give the rest to other organizations. Ironically, these organizations fund those NGOs headed by non-Adivasis for the revival of Adivasi tradition, culture and ethos, but at the same time they avoid joining hands with Adivasi-headed organizations for the same purposes. The sad part is, the Adivasis are still unqualified for the funding organizations; therefore, a few Adivasis can be seen in the lowest strata of these organizations, despite their professional qualities, commitment and dedication. There are also some organizations who advocate for the Adivasi Chief Minister for the state of Jharkhand, but when it comes to the matter of their organizations, they cannot bear to see an Adivasi in the driving seat. They also advocate for promotion and protection of Adivasi languages, but their doors are always closed for the non-English speaking, marginalized people.

These organizations tirelessly use the connotation empowering the marginalized, voice to the voiceless and women empowerment, but when it comes to the question of leadership, they just escape in one way or the other. Why did the civil society organizations fail in bringing up the Adivasi leadership was the most important question repeatedly asked in the National Consultation on Adivasis of India organized by the National Centre for Advocacy Studies (NCAS) in Delhi on December 15-16, 2009. A noted Gandhian and founder of the Ekta Parishad, P.V. Rajgopal, accepts in denial mode that the civil society organizations have failed in bringing up the Adivasi leadership but he also advocates for a united fight by saying, The issue like displacement is not just limited to the Adivasis but it is also hitting the farmers, vendors and fishermen. But does it mean that the question of Adivasis get less priority?

Ironically, the non-Adivasi leaders of the civil society organizations not only respond diplomatically but also justify their leadership of the Adivasis. While responding to the questions of Adivasis leadership, a prominent social activist from Jharkhand, Sanjay Bosu Mullick, says, Since the Adivasis do not know about the exploitative system and structure of our (non-adivasis) society, therefore we are fighting with our people on behalf of them. One can only appreciate this diplomatic response and thank the God who has given wits, wisdom and knowledge only to the non-Adivasis for not only understanding their society but also the Adivasis, and shame on those Adivasis (like me) who do not even possess the wisdom to understand their own society.

The reality is that the Adivasis are racially discriminated, exploited economically and denied their rights in the civil society organizations. Similarly, the Dalits are treated like untouchables, uneducated and inhuman, and the women of D-section are not only exploited socially, economically and mentally but they are also exploited sexually by the Big-bosses of the civil society organizations. The irony is, our participation is for them is to listen to our sorrows patiently through their tongues in a conference hall, give our consent to their words and always make sure that they are our messiahs. How would you explain it when your wisdom, commitment, dedication, capacity and efficiency do not matter for them but your race, caste, class, colour and relationship possesses multiple values for them instead?

When the Adivasis enter into these organizations, especially in the funding ones, their years of work experience are counted as one or two years (so that they can be kept in the lowest strata), they are compared with their counterpart (always a non-adivasi is used as a parameter for them) for further promotion and their ten achievements are not enough to beat the couple of achievements of a non-Adivasi. When one raises these issues in the organizations, they would manipulate, manufacture consent with their colleagues and dilute the whole debate to ensure that the Adivasis lose the game. Finally, if the Adivasis leave these organizations, they would frame them as opportunists, non-committed to the Adivasi cause and counted as one more enemy of the Adivasis.

One can question that why are the marginalized people of these organizations keeping quiet in these circumstances? The instant answer is, a wage labourer bears all kinds of discrimination, exploitation and torture only because he/she knows that the day a question is raised, he/she would be thrown out of the job. Similar theory is applied to the marginalized people, who are ensuring their daily bread from these civil society organizations. How can one dare to question the big-boss, when he/she is just struggling for survival? Can you imagine how the marginalized people are being exploited, denied and discriminated against in those organizations, who tirelessly talk about participation, empowerment, rights, equality and justice?

The fact of the matter is the perception, attitude and behaviour of the elite heads of civil society organizations towards Adivasis, Dalits and women of D-section are no different from the common people of the so-called civilized society. They talk much about participation, empowerment, rights, equality and justice merely to ensure themselves a luxurious life, bag awards and become a role model in the name of Adivasis, Dalits and Women of D-section; therefore, they also play the game of words just like the politicians do. Can anyone remind me about how many Adivasis, Dalits and women of D-section were awarded (megasese) for their extraordinary work and became a role model for all Indians?

Interestingly, the vision of these organizations is more or less the same formation of an equitable and just society, but the pertinent question is how the utopian vision can be achieved through discriminatory, inequitable and unjust practices? In fact, the elite heads of the civil society organizations should stop their uncivilized practices, which they are carrying out for decades. It is the right time to let the marginalized people play their own game, become umpires and take over as the match referee. And the elites should only become the fourth umpires rather than playing match for the marginalized people. Then only their talks about the empowerment, equality and justice can be fulfilled.

Before civil society organizations organize the next consultation, convention or conference on Adivasi, Dalit or Womens Rights, all marginalized people should stand up and say strongly that enough is enough, let the Adivasis, Dalits and women of D-section speak for themselves. The time has come to tell them (non-Adivasis heads) that we are grateful to you for advocating on behalf of us for the last six decades, but no more manipulation please. We are tired of hearing about our grievances through your holy tongues; therefore, we want the world to listen to our grievances through our mouths. We want to speak for ourselves and we are capable enough to save our culture. But the question that may remain unanswered is, will you, the Messiahs of the Adivasis, Dalits and women listen us?

Now who is hiding, Mr. Vishwaranjan?

      The long wait. The pips. And then the phone rang.

      He picked up the phone on the fourth ring.

      “Hello?” a gruff voice inquired.

      It was a voice of authority. After all, Mr. Vishwaranjan, the person I was calling, was the Director General of Police of Chhattisgarh, the person at the top of the law enforcement institution in the state.

      “Sir, my name is Siddhartha Mitra, and I am calling from New York. I am a computer professional working here.”

      “Hem”. He cleared his voice. And waited. Evidently we both knew where the call was going. So I dived into the topic, without further ado.

      “Sir, I am calling regarding the arrest of Kopa Kunjam”, I said.

      “We have been getting many calls regarding this. He has been arrested on a six month old murder case. He was hiding in Himanshu Kumar’s ashram, and when he came out during that time, he was arrested”, the DGP placidly explained.

      No doubt this was something he had prepared in advance, and must have repeated it several times by now.

      However, there was a big catch to it.

      “But I know that is not true. I myself was there in Dantewada two months ago, and I went with Kopa Kunjam to Lingagiri. He came and went from the ashram as he pleased, and he was very much out in the open. He was not hiding there.”

      There was a distinct pause at the other end of the line. This was clearly an unexpected and unwelcome counter.

      “Look, I do not know the exact details, the SP Bijapur is handling this case”, he paused, desperately thinking of something else to say. “At least, this is what Kopa has confessed. He said he was staying at the Ashram”, he seemed to be trying to backtrack. No, Kopa was not hiding there, but was staying there. And yes, I do not know all the details, so I cannot answer all your questions.

      “I know that he was not staying at the ashram at night, because I was there”, I persisted.

      His voice took a soothing tone. He condescendingly explained, hoping to clear my ignorance -  “Kopa himself has said so.. That is why we know he was staying at the ashram. “

      “But he might have said so because he was beaten” , I responded, offering the reason why such allegations might have surfaced.

      Slander! Calumny! There was a notable shock in his voice. “That is not how the Indian police system works. Nobody is beaten. The arrested make their statements before the magistrate. I am telling you what Kopa has himself has said during his confession.”

      “There was witness to the fact that he was beaten. Mr. Alban Toppo, the lawyer who was with him saw him getting beaten up.”

      Click.

      And then a silence.

      We shall have to wait another day to know why Mr.Toppo was making up this egregious lie. Perhaps the blows with the cane that he had received himself before he witnessed Kopa’s beating must have caused him to have hallucinations.

      Anyway, the conversation had gone a lot longer than expected. After all, my call on the same issue two days earlier to Amresh Mishra, the SP of Dantewada, had lasted only a few seconds. Mr. Mishra, prior to disconnecting the line, had hurriedly mentioned that this case was out of his region of control, and Kopa was in the custody of the Bijapur police, and I should contact SP Bijapur.

      And of course, the SP Bijapur was on “vacation”.

      At least Mr. Mishra had some excuse. But the DGP is the overlord of the entire police force in the state. In the end, it is his sole responsibility on how law is enforced in Chhattisgarh. He has no SP Bijapur or vacation to excuse himself with.

      Now who is hiding, Mr. Vishwaranjan?

Note: This is by Ms. Ivy Miller Chahal, Director of Tribal Research
and Development Institute, Bhopal .
She seeks inputs on health interventions in tribal areas by communities,
Government and NGOs that have facilitated development of that area. The inputs
will enrich the National Consultation on ‘Best Practices in Tribal
Areas’ scheduled in mid- January 2010. We invite members to write and look forward to
a rich discussion. Thanks.

Dear Members,

Tribal Research and Development
Institute (TRI), Government of Madhya Pradesh, a nodal Tribal Research and Development
Institute of Ministry of Tribal Affairs, GoI for Chhattisgarh, UP, Himachal
Pradesh, Rajasthan. TRI and United Nations Development Programme (UNDP) are
planning to organize a two-day National Consultation on ‘Best Practices in Tribal Areas’ under
the theme of ‘Continuity and Change’
at Bhopal in
early January 2010.

The theme will look at successful/
innovative cases of how communities independently as well as with support from
facilitating agencies/ organizations have been able to ensure continuity in
their culture and practice while bringing about a process of change (with
respect to development) .

The objective of the consultation
is to bring together various successful interventions and experiences in the
areas of Poverty, Governance, Health and Climate Change
in the V and VI Schedule Areas, which have facilitated the process of tribal
development by building on their traditional knowledge systems and practices
for helping them live in continuity during the process of change. It is also
intends to draw-out suitable mainstreaming approaches for inclusive growth and
development of tribal areas and improvement in their economic and social
conditions.

Members are requested to share
experiences and examples with regard to:

Local
health traditions and their dovetailing with mainstream medical systems;

Interventions
that have led to significant decrease in the expenditure on health for
communities;

Innovative
interventions for addressing the food and nutritional insecurity among
tribal communities;

Interventions
that mainstream health concerns within community based natural resource
conservation strategies.

We also invite people to share such
practices, which were not very successful but were promising enough to throw up
vital learnings for informing policy.

The interventions will be analyzed
through a gender, capacity building and human rights lens and short-listed
based on their innovativeness and ability to address the challenges created.
Individuals and agencies engaged with these will be invited to present their
approach and learnings at the workshop. We also intend to bring out a knowledge
product on this theme after the workshop.

An interaction on Farmers suicide and Mining Scam

Dear Friends,

Our state is undergoing drastic changes in all aspects of development process whereas the concern of the civil society had not been taken up seriously by the state and market due to its fragmented nature. The recent issue of Farmers suicide and the mega mining scam have posed serious concern before all of us.

You may also be aware that since the Earth Summit in 1993, the term Civil Society has become a catchword and mantra for those seeking an alternative between absolute reigns of the state and competing agendas of the market. Very recently, CIVICUS- the World Alliance for Citizens Participation, a UN nodal body, had undertaken a study of the fragmented Odisha Civil Society covering four important aspects namely its structure, environment, values and impact. One of its recommendations is to establish an inclusive state level mechanism for systematic interface among the 40 plus sub sectors of Odisha civil society. NGOs are just one of these 40 sub sectors.

Since then, some right thinking and well meaning citizens of the state have been discussing the idea of bringing together all the sub sectors for building an inclusive civil society which could collectively articulate the legitimate interests and concerns of the state, a little more forcefully. In this context, a concept outline of the proposed Odisha Nagarik Samaj is enclosed herewith for further your reference.

Initially, on 18th December, 2009, we are meeting in Jayadev Bhawan at 10AM( Suchana Bhawan) to listen to some affected farmers families & civil society groups about their field report on farmers suicide and possible civil society response. We will also be discussing the mega mining scam and what can we do about it.

Therefore, we would request you to participate in the discussion, share your insights and join the process which will go a long way in the history of development of the state.
