The 2nd year Anniversary of Msia Indian Awakening Day - 25 Nov 2009.

A mass gathering we went and we welcomed with shower of tear gas and chemical laced water cannon 2 years ago in the heart of the nation in front nation tall icon,KLCC.
Msian FRU set a record, the highest number of personnel deployed in a single gathering, the highest number of tear gas used, the highest number of chemical laced water used, the longest rally they confronted (6pm-5pm).
The PDRM too set their own new records as well.
But most of us went there to set the expectation right to the govt then and throw our support for HINDRAF's objective.
All Msian Indians from many layers of ideology, NGO, civil servants, ruling party members as well opposition party members with ordinary people gather for once to show unity that this community need GREAT ATTENTION and were left in the main stream of nation development.
As the result of that historical day, many event took place without much anticipation and planning; from the detention of H5 under draconian ISA, the flee of Waythamoorthy to UK to continue thru international lobby, the arrest and court cases more than 200 people whom took part in the gathering and finally the appointment of 10 people coordinators to run and hold the momentum of HINDRAF locally.
Today the Hindraf's wave of change did played siginificant role in nation politics landscape and in the rights awareness among Indians as well other communities.
Today all the H5 were released and each are running and coordinating the Hindraf's struggle in their way.
The 10 man interm team too dropped and took their own path as their mission completed.
Even the celebration of this day are also celebrated from 3 main segments in 3 different way.
Where is the unity that we saw 2 years ago ?
Did the gathering brought us the unity we seek or split the community to more segments ?
I must admit from my personal view that, the gathering did brought us to temporary unity that we must be united to show our power of unity and being the kingmaker in nation politics thru the GE12. We did by throwing support to PR without much expectation and worked for their success. We did had small hope that the change will come to the community. It came in many small ways; The BN did realised the importance of the minority n marginalised community support to win crucial seats. The PR flew high with major swing of support to them from voting to volunteers. But are they differ from previous govt in their attention to the need of the most needy society that supports them ? Some key events did disappointted us.

Meantime in KEMTA, our heroes under ISA were already not united within a month. The 10 coordinators including myself have to hide this truth and continue to ensure the community support them and the idealogy of unity for change. Now all are free, thanks to the nationwide prayers, continuous pressure activities and personal appeal by frens and family.
I really hope that they would come back in unity and respect each other with mutual respect.
I respect their personal view and way in resolving the Msian Indian issue. Each of them do have their strength in their way.

Let all hands work in various ways to solve the many issues within our community with mutual respects in order to resolve the issues faster and effectively.

We urgently need your help to stop the slaughter of hundreds of thousands of animals next week during the Gadhimai Jatra festival in Bara, Nepal. Humane Society International is working with our local partners, Kathmandu Animal Treatment Centre (KAT) and Animal Nepal, to prevent this reckless animal cruelty before the festival takes place November 24 & 25.

Every five years, hundreds of men are licensed to kill buffalo, pigs, chickens, rats, goats, and pigeons, receiving a fee for each animal they take. Cruelly, the animals are chased and hacked to death with knives in a competition to kill as many as possible within two days. According to Animal Welfare Network Nepal, the real beneficiaries are the festival organizers and business community, who drive up prices for animals in the lead up to the festival and then pressure local people to contribute livestock to the event.

Animal advocates are asking that the community provide fruits and vegetables instead of animals for the festival. KAT and Animal Nepal are organizing a counter-campaign of peaceful meditation, and together we are petitioning the government, which has reportedly paid for an enclosure to hold thousands of buffalo ahead of the event, to stop the slaughter. Please take action immediately by writing to Nepal's Prime Minister and Minister of Tourism to request a halt to this outdated tradition, considered barbaric by many local people who would like to stop it but feel helpless to do so.

Then, ask your friends and family to help, too. We need to let Nepalese leaders know that the world is watching and considers this bloody practice tragic and shameful.

GEORGE TOWN: Veteran lawyer Karpal Singh has disputed Inspector-General of Police Tan Sri Musa Hassan's statement that the High Court ruling confining the interrogation of witnesses to office hours is not applicable to the police.
Karpal said the police, more than the Malaysian Anti-Corruption Commission (MACC), were bound by the ruling in accordance with Rule 20 of the Lock-up Rules 1953.

He said specific provisions in Rule 20 stated that suspects must be placed in the lock-up between 6.30pm and 6.30am.

"This is a clear ruling that suspects cannot be questioned or interrogated at such times. If such protection is granted to suspects, there is no reason why it should not be extended to witnesses," he said.

Karpal, who is also the MP for Bukit Gelugor, said there was no reason for police to interrogate witnesses at unearthly hours as this was tantamount to torture.

He cited a High Court judgment in the murder case involving former Youth and Sports Minister Datuk Mokhtar Hashim where a co-accused was set free after the judge ruled that the cautioned statement recorded by the police was inadmissable.
"In that case, the judge ruled that the police had breached Rule 20 of the Lock-up Rules when recording the cautioned statement as it was done at odd hours.

"Therefore, the IGP should be cautious in making statements regarding the High Court ruling on the interrogation of witnesses," he said, adding Musa should be well advised to abide by the recent High Court ruling.

Karpal said those who were subjected to interrogation at odd hours by the police in the last three years could file suits against the force in accordance with the Public Authorities Protection Act 1948.

Musa was reported to have said the High Court ruling confining the interrogation of witnesses to office hours was not applicable to the police and that the force had not received any instructions on the matter.

On Thursday, in the lawsuit brought by Kajang municipal councillor Tan Boon Wah challenging MACC's interrogation procedures, Judicial Commissioner Mohammad Ariff Md Yusof ruled that the MACC could only interrogate witnesses between 8.30am and 5.30pm.

Karpal also urged the Attorney General to issue a fiat (written consent) to enable him to prosecute Datuk V. K. Lingam for allegedly lobbying for the appointment of judges.

Karpal said the Royal Commission formed to investigate the "Lingam affair" had established that Lingam and several others were clearly guilty of a number of offences.

"However, despite all this the A-G has still decided that no case can be made against them. In my mind there is no doubt that a case of sedition can be framed against Lingam and I will take on the challenge to prosecute him," he said.

 This evening, the students of the Sri Sathya Sai University presented their Convocation drama. Bhagavan arrived for darshan at ten minutes to five and came to the bhajan hall where the students were seated in costumes. Interacting with them for a few minutes, He moved down the aisle and up the verandah to go to the interview room. From there, He emerged to come onstage and begin the presentation at a quarter to six. The hour-long drama 'Vidyaamrutam' brought out Swami's ideal of providing education free of cost, against all odds. Swami blesssed the participants with group photos and clothes at the conclusion, He had blessed the protagonist of the play with a chain during the drama itself. He asked for some songs to be sung, so the students sang a bhajan and a group song before Swami accepted Arati. He interacted with the students for some time even after Arati and it was past 7.30 pm when He returned to His residence. An announcement was made about the 28th Convocation of the University which is to be held tomorrow morning.

KUALA LUMPUR: National football legend Santokh Singh has lapsed into a coma at the Kuala Lumpur Hospital after collapsing at his home on Monday.
FA of Selangor secretary-general Datuk Hamidin Amin said the 59-year-old former Selangor defender was warded on Monday and fell into a coma the following day from an apparent viral infection.

“After speaking to Santokh’s wife, he apparently suffered from chills and fell in his home on Monday. After being admitted to hospital, he fell into a coma on Tuesday from which he has yet to recover,” Hamidin said after visiting Santokh at KLH today.

Santokh formed a formidable defensive partnership with Datuk Soh Chin Aun for both club and country in the 1970s and 1980s and starred for Selangor alongside the legendary Mokhtar Dahari and goalkeeper R. Arumugam.

After being plucked from the Selangor Burnley Cup team by coach Datuk Ghani Minhat, the burly defender went on to win the Malaysia Cup with Selangor nine times from 1972 to 1985.

He made his national team debut in 1972 and featured in the side which qualified for and played at the 1972 Munich Olympic Games.
Santokh helped Malaysia win a bronze medal at the 1974 Teheran Asian Games and back-to-back Sea Games triumphs in 1977 and 1979.

Santokh would have made a second Olympic appearance after the national side qualified for the 1980 Moscow Olympics, but Malaysia’s subsequent boycott denied him the honour.

MACC can’t quiz witnesses beyond office hours, High Court rules

KUALA LUMPUR, Nov 19 — The High Court here today delivered a stunning rebuff to the Malaysian Anti-Corruption Commission’s (MACC) investigative procedures by ruling that it has no right to question witnesses in an investigation beyond normal office hours, namely from 8.30am to 5.30pm.
It also found the MACC to have acted illegally when it detained Kajang town councillor Tan Boon Wah overnight at its Selangor head office in Plaza Masalam, Shah Alam.
Judicial Commissioner (JC) Mohamad Ariff Md Yusof stressed that the meaning of the phrase “day to day” as laid down in Section 30(3)(a) of the MACC Act – which is at the core of the dispute between Tan and the MACC – “cannot mean round the clock” investigation, which includes recording statements from the witness.
Mohamad Ariff explained that to do so would “offend the legislative purpose” and limit the fundamental liberties of a person, which are clearly laid down in the Federal Constitution, under Article 5, and which the Federal Court had recently upheld must be interpreted in the “widest sense” possible.
He remarked that the MACC may have realised this when they ordered Tan to return to help in further investigations at 10am on July 20, which is well within normal working hours.
The High Court ordered the MACC to pay damages to Tan for “false imprisonment” between 9.45pm on July 15 and 2.53am on July 16, but left it up to the court registrar’s office to determine the amount, which will include interest.
Tan was taken in for questioning as a witness by Selangor graft busters investigating claims of an abuse of state funds involving DAP state executive councillor, Ean Yong Hian Wah, about 9pm on July 15, the same day as political aide Teoh Beng Hock.
Teoh, who was Ean Yong’s secretary, was also interrogated overnight and found dead the next afternoon on a fifth-floor landing outside the MACC office in Plaza Masalam, Shah Alam. His mysterious death is currently the subject of an on-going inquest.
Tan was interrogated until nearly 3am the next day and then told to go home, but stayed on to have his statement recorded later at about 11am. He finally left the MACC office around lunch time.
The suit against the national anti-graft body was filed on July 22.
Tan’s lawyer, Karpal Singh, told reporters later that it was a landmark case which held great consequences on how interrogations of both witnesses and suspects in an investigation would be carried out in future.
“This affects across the board every investigation in the country; every police investigation and even the Criminal Procedure Code,” the veteran said and added that it was no longer limited to the MACC’s way of handling things.
“For the first time, we get a definitive ruling to the phrase â€day to day’,” Karpal added, referring to the JC’s stress that the law was silent on how the phrase should be read and resorted to consulting the dictionary meaning of it.
Asked to comment on the impact the High Court’s decision in relation to the dead political secretary, Karpal said: “In the case of Teoh Beng Hock, death was involved. The MACC has to be sued in a wider range and not limited to just the questioning.”
Karpal, who is also the MP for Bukit Gelugor, noted that the authorities had always thought they could question anyone at any time.
He marked that today’s ruling paved the way for others who had been similarly affected in the past to sue the authorities for holding them beyond regular hours.
But he said that those looking to claim damages must do so quickly because the Public Authorities Protection Act limits legal action being taken against such public institutions to within the last three years.
The Kajang councillor who was in court when the decision was read out looked highly relieved. He said he had filed the suit hoping to stop the MACC’s practice of questioning people at odd hours, especially after what had happened to Teoh.
“It’s good for all Malaysians,” Tan said.
It is unknown at this point if the MACC will appeal the High Court’s decision.
While lawyers from the Attorney-General’s Chambers representing the commission did not indicate whether they accepted the ruling or not, Karpal thinks they are likely to appeal because of the implications on other public authorities.
He added that they have one month to file their appeal.
In an immediate reaction, DAP Parliamentary Leader Lim Kit Siang lamented that political aide Teoh Beng Hock would still be alive if the MACC had followed the law.
“Teoh Beng Hock would not have died if MACC had followed the law,” the Ipoh Timur MP said in a statement.
He said the landmark decision today was an added reason for MACC Chief Commissioner Datuk Seri Ahmad Said Hamdan to resign, following Malaysia’s worst Corruption Perception Index (CPI) ranking and score in 15 years in the Transparency International CPI 2009.

This afternoon we received a telephone call from our Johor State HRP Chief
(pro tem) Y.Mohan who informed us that the body of J.Saravanan (22) which
his uncle Mr.K.Selvaraj in his police report No:- JBS/020804/09 had
alleged was killed by the Air Molek prison personnel within four (4) days
of him being imprisoned. Upon calling the complainant Mr.K.Selvaraj and
then Mr.K.Chandran ( another uncle of the murder victim) this afternoon we
were informed that (UMNO’s number one Mandore) Indian political party
chief (and UMNO’s special branch) had “turn them over” and that they are
not to make this issue any bigger but to close and hush up this matter.

A post mortem was rushed and hurriedly performed from 6.00pm to 9.00pm
yesterday. The body was rushed to the family home after 9.00pm for prayers
that was rushed through and the body sent back to the hospital mortuary as
it could not be buried at that late hour.

By 10.00am today morning (17/11/09) the body was hurriedly cremated and
all evidence of the prison brutality of beating the victim with a cane,
kicked and punched were all wiped out by the a single light of the
UMNO/police SB vis a vis their Indian mandore’s match stick.

We believe all this was under pressure from UMNO and their police special
branch, We were told that UMNO’S number one Indian Mandore political
party’s number one leader stepped in to do this perfect mandore’s job as
he had successfully been doing for 30 years by hushing up this most
serious case of human rights violations.

All the above was hurriedly rushed through despite the family agreeing to
our proposal even up to yesterday evening:-

1)      That the body should be buried and not cremated so as not to destroy
the evidence in case the body has to be exhumed for a second post mortem
etc like in the case of Teoh Beng Hock.
2)      That after the first post mortem, a second post mortem will be
conducted in Singapore.
3)      The family was never allowed to take any pictures by the hospital and
police authorities from the word go right up to the end.

Res Ipsa Loquiteour ( The facts speak for itself  about UMNO their police
special branch and their Indian mandore number one political party)

All these only possible under UMNO Prime Minister Najib Razak’s One Malaysia.

Last night at about 10.30 p.m the Air Molek Prison authorities telephoned
me to say that my nephew (my own sister’s son) Saravanan a/l Jeganathan
(22) had died in the said prison at about 10.00 p.m by hanging himself. I
do not believe this.

My nephew who is a Supermarket general worker was arrested on 16/10/2009
and detained at the Desa Cemerlang, Ulu Tiram police station up to
11/11/2009. From 11/11/2009 to 15/11/2009 ie within four days at the Air
Molek Prison, he is now dead. How is this so?

Today at about 12.30 p.m myself and my brother Chandran saw the body of my
nephew which was full of blue black marks on his back, (Spine area) legs
and hand as if he was beaten with a rotan, hit and also punched. His right
toe has bruises. The police and hospital personnel including Dr. Mohd
Hasnah have refused to allow us to take photographs of these injuries. I
now demand my right to take the photos before it disappears or any
evidence of this murder is tampered with by the police, prison and
hospital authorities..

I believe that my nephew was beaten up and killed by the Air Molek Prison
personnell.

I want the police and/or prison personnel responsible to be prosecuted for
murder forthwith and criminal action to be taken against the police and
Johor Baru General Hospital doctor and personnell for trying to cover up
this murder.

62 Years Of Friendship Renewed

CYBERJAYA, Nov 17 (Bernama) -- Sixty-two years of friendship was renewed when 21 former students, including former Prime Minister Tun Dr Mahathir Mohamad and his wife Tun Dr Siti Hasmah, from the Class of 1947 of the former King Edward VII Medical College met for a four-day, three-night retreat from Monday.

The retreat began early Monday with the old students of the college, now known as the National University of Singapore, converging at the Cyberview Lodge here.

Most of them came from Malaysia and Singapore and made their journey to Cyberjaya despite their age, just to renew ties with their classmates of 62 years ago.

One who is residing in Toronto, Canada came for the retreat with assistance from his daughter.

On Monday, the class of '47 , including Dr Mahathir, 84, and Dr Siti Hasmah, 83, went on a tour of Cyberjaya, visited the Multimedia University and took a stroll in Putrajaya, the federal administrative centre.

They had a small dinner Tuesday at the Cyberview Lodge. The group will go on a boat tour in Putrajaya, visit the Wetlands and have another dinner at Dr Mahathir's residence in Cyberjaya Wednesday.

The entire retreat is being organised and sponsored by Tan Sri Mustapha Kamil Abu Bakar, the executive chairman of MK Land Holdings Bhd and EMKAY Group.

Mustapha also attended the dinner tonight and is expected to be with the class of '47 until the end of the retreat on Thursday.

In her welcome speech, Dr Siti Hasmah said she was glad to renew ties with her classmates, who studied medicine in the college over 60 years ago.

"It is nice to meet old friends...watch their children all grown up. This is very exciting for all of us," he said.

Last night at about 10.30 p.m the Air Molek Prison authorities telephoned
me to say that my nephew (my own sister’s son) Saravanan a/l Jeganathan
(22) had died in the said prison at about 10.00 p.m by hanging himself. I
do not believe this.

My nephew who is a Supermarket general worker was arrested on 16/10/2009
and detained at the Desa Cemerlang, Ulu Tiram police station up to
11/11/2009. From 11/11/2009 to 15/11/2009 ie within four days at the Air
Molek Prison, he is now dead. How is this so?

Today at about 12.30 p.m myself and my brother Chandran saw the body of my
nephew which was full of blue black marks on his back, (Spine area) legs
and hand as if he was beaten with a rotan, hit and also punched. His right
toe has bruises. The police and hospital personnel including Dr. Mohd
Hasnah have refused to allow us to take photographs of these injuries. I
now demand my right to take the photos before it disappears or any
evidence of this murder is tampered with by the police, prison and
hospital authorities..

I believe that my nephew was beaten up and killed by the Air Molek Prison
personnell.

I want the police and/or prison personnel responsible to be prosecuted for
murder forthwith and criminal action to be taken against the police and
Johor Baru General Hospital doctor and personnell for trying to cover up
this murder.

SUB: EMERGENCY MOTION IN PARLIAMENT FOR POLICE SHOOTINGS                                                                     

 

Good Day to you all.

 

I refer to the recent spate of cold blooded shootings by the PDRM of suspected criminals. At least 11 people have been shot dead in the last 30 days or so – and all of these killings follow a repeating pattern which suggests a definite scheme. The police have decided that they will shoot to kill off suspected criminals, to meet their KPIs of crime reduction. For public consumption they make the shootings look like they were doing all of this, in self defence and in compliance with the law of the land. Please do not ask me for proof for what I am saying, for I have none. I am not arguing a legal case, I am arguing a moral case.

 

Almost all of you YB, YBs have remained silent on these killings. If you have chosen to remain silent on this, I presume, it can only be because of one of two reasons. One is that you are probably not cognizant of the larger issues that these episodes really represent. Or two, maybe it is not politically expedient for you to get involved. Also given the sectarian mindsets so prevalent in our politics, it does not help the case that most  killed in these shootings were Indian youths. And recent history seems to reinforce the idea that Indian lives are cheap in this country.

 

In any case, your continuing silence on this issue, will only project a picture of your ineptitude and of ineptitude on the part of the Pakatan Coalition to speak up when you all should be speaking up. The killing represents just the tip of an iceberg of very much more significant underlying ailments in our system. If you can see all of this, then it behooves you to speak up and to act. Otherwise the unavoidable conclusion, we have to come to is that you all are inept and your ineptitude does not allow you to perceive the significant issues of governance and social justice involved here. This also raises the spectre of a mistake we may have made in placing our trust in you and in PR. The recent Merdeka Centre surveys also indicate a general erosion is support for the Pakatan coalition, because of insensitive handling of issues of importance to the Rakyat.

 

Let me attempt to explain the larger implications of this issue, and pardon me for any presumptions on this matter:

 

1) These summary executions by the PDRM represent a breakdown of the processes of governance in our country. There are processes and there are institutions to deal with the law and order problem in the country and there are clear provisions in the Federal Constitution and laws to deal with such situations. There are various roles prescribed for the different arms of the government to maintain law and order, including for the PDRM. In committing these summary killings all these have been transgressed with impunity by the PDRM. The Federal Constitution and the relevant Acts of Parliament are quite explicit on the rights of individuals and limits of action  on this:

 

          

      (1) Article 5(1) of the Federal Constitution provides that:-

No person shall be deprived of his life or personal liberty save in accordance with law.

(2) Section 15(3) and of the Criminal Procedure Code provides that : -

“Nothing in this section gives a right to cause the death of a person who is not accused of an offence punishable with death or with imprisonment for life”.

 

The PDRM has ignored all these provisions in the Federal Constitution and the law and have usurped the role of the Judge, the Jury, the Prosecutor and the Executioner in carrying out these summary killings. We only have the word of the Police that they are criminals and they are hardcore ones at that and therefore they are justified in their act of shooting to kill. Can any citizen just engage in similar acts, and then justify their actions by claiming that they targetted criminals. This is the express purpose of having the laws and the due processes.

 

This is an extremely serious act by the PDRM that has the effect of usurpation of State Power by one branch of the government and this undermines the sanctity of our entire system of governance. Should all of you legislators remain silent when such a major transgression is happening?

 

It is my opinion that this situation presents a tremendous opportunity to all of you Pakatan Rakyat law makers to present an alternative approach to addressing this issue that is happening now, right under your noses.

 

This is not an isolated incident. The same thing is happening elsewhere too but only it manifests itself differently -  the usurpation of State power in Perak and in the Upper court’s scanty treatment of Dato Seri Anwar Ibrahim’s various appeals. It is the  same underlying issue of a breakdown of the system of governance in the country.

 

 

2) The other significant point about the summary killing of suspected criminals is that you cannot expect to eradicate Malaria by killing off the mosquitoes. The recent actions by the PDRM is akin to curing the country of its law and order problem by killing off suspected criminals. Which country in the world has sustainably been able to cure its law and order problem with summary executions. Countries which do that only see they have to spend increasing amounts in more jails, more guns and more law enforcement. This really exposes the superficial approaches to complex problems of our society by the Barisan Nasional Government.

 

It is my opinion, this situation presents a tremendous opportunity to all of you Pakatan law makers to present an alternative approach to addressing complex issues such as this. That is if you choose to. Political expediency seems to be the defining character of current day politics. But we would like to see the Pakatan lawmakers rise above the lesser considerations of expediency and act based on principles of justice , democracy and  leadership and with a view to solving society’s problems not just meeting some KPI targets. In fact by taking a principled approach on this, you can show up the inefficacy of the BN Government’s policy of driving improvements in Government performance by the blind use of devices such as KPIs.

 

IN summary, we the rakyat would like you to do the following in the current session of Parliament:

1) To pass an emergency motion calling for an immediate moratorium on all police killings, whether encounter killings or killings in Police custody

 

2) In that same motion to include a call for setting up of a Royal Commission of Inquiry much like the one set up for Teoh Beng Hock’s case to investigate all these extrajudicial killings of suspected criminals, during the tenure of current IGP Musa Hassan.

 

3) In that same motion to also call for the prosecution of the police who are responsible for the killings, because it is non prosecution of such police personnel responsible for the killing that results in a continuation of the killing.

 

 

In my opinion such an act of support for the people is what will make the people look up to Pakatan Rakyat. Over the last 20 months since the last General Election the Pakatan Rakyat Legislators seem to have moved away from being the Rakyat’s party and looking more and more like the Barisan Nasional. Here is an opportunity to turn the tide. That is if you choose to.

 

We hope you all will rise to this challenge.

Saya ayah kepada membuat laporan ini kerana saya syaki polis cuba
memutarbelitkan keadaan anak saya R.Seetha yang minum paraquat.

Pada 8/11/09 lima orang remaja dibunuh/tembak mati secara kejam termasuk
anak saya Surendran 24. Kenapa mereka yang bunuh anak saya tidak ditangkap
tapi suami Seetha, Manimaran ditahan.

Pada 11/11/09, polis juga menganggu, geladah dan tahan keluarga kami di
Balai Polis Kapar untuk soal-siasat.

Saya dapat tahu bahwa pihak polis dan pihak hospital memaksa Seetha
menanda tangan satu surat yang memgatakan Seetha minum racun paraquat
bukan kerana adiknya yang ditembak mati oleh polis dan polis tidak
kena-mengena dengan cubaan membunuh diri oleh anak saya.

Saya tuntut agar pihak polis tidak menganggu ahli keluarga yang kini dalam
keadaan sedih kerana kehilangan Surendran anak saya yang ditembak mati
oleh polis dan Seetha anak saya dan 4 cucu saya dalam keadaan tenat.

Sebab utama Seetha minum racun paraquat adalah kerana dia tidak boleh
terima yang polis tembak mati/bunuh adiknya Surendran secara kejam. Seetha
terlalu sayang kepada Surendran. Dia selalu nangis dihadapan gambar
Surendran yang meninggal.

Saya mohon agar polis jangan putar-belit dan cuba mempersalahkan suami
Seetha, Manimaran. Manimaran amat sayang kepada anak saya Seetha. Semua
ini berlaku kerana polis tembak mati anak saya Surendran dan saya tuntut
agar tindakan diambil terhadap pembunuh anak saya dan pecat IGP Musa
Hassan dan CID Director Bakri Zenin juga dipecat.

Without availability of data needed, it has proven difficult to develop strategies on the future of Hindu places of worship in Malaysia, especially on matters related to the defending against demolitions of Hindu places of worship.

 

The Shakti Foundation and with the support of the Malaysia Hindu Sangam (MHS) along with other NGO’s initiated a community-based nationwide joint project  to collect data on Hindu places of worship in the country.

AFPpicIN his first public remarks since being appointed as economic adviser to Selangor, Malaysian opposition leader Anwar Ibrahim said he would do battle “to the end” against Umno-Barisan Nasional  forces bidding to destabilize and wrest power from the state’s Pakatan Rakyat government.
“I have officially now entered the ring,” Anwar said in reference to his new job. “If you try (to seize power), we will go all out and fight to the end,” Anwar said in Shah Alam when opening the
state-level National Justice Party convention.
On Friday, Anwar, a former Deputy Prime Minister and Minister of Finance, was appointed Selangor’s economic advisor, a job for which he will be paid a norminal salary of RM1 a month.
The appointment is to help the state government formulate new economic initiatives as well as improve the implementation of existing policies that directly and holistically benefit people.
Anwar used the convention to galvanise party members into ensuring the state remained in opposition control despite simmering diffirences within Pakatan ranks which, according to insiders, the coalition has been able to contain so far.
Prime Minister Najib Razak, who recently took over as Selangor Umno chief, has made public his party’s intention to retake Malaysia’s most developed state by the next general elections.
The Selangor state government has since become a punching bag in the mainstream media on several issues, ranging from the relocation of a Hindu temple to the sale of beer in 7-Eleven outlets.
Anwar admitted that despite some success, the opposition has been unable to deliver all of its promises to the people.
He attributed the problem to elements within Pakatan who still practise what he called the “Barisan Nasional politics”  of  corruption and racial based politics.
“This culture and way of thinking is outdated and must be rejected at all costs,” he said. “We will also not tolerate corruption within our ranks. Those caught will be sacked, make no mistake about this.”
At  a press conference after his speech,  Anwar said he had received positive response from investors abroad, especially in the Middle East, on his appointment as Selangor’s economic adviser.
He said a group of Arab investors had asked to meet him after the Hari Raya Aidil-Adha on November 27.

DAP blames BN for cops playing cowboys with Indians

IPOH, Nov 15 – A DAP politician has accused the Barisan Nasional (BN) government of waging a war of revenge against the Indian community by ordering the police to kill suspected criminals.
Ipoh Barat DAP secretary P. Sugumaran (pic) lambasted the action, saying that the police had no right to pass judgement without first asking them to surrender.
“Their actions are clearly the BN’s political agenda to take revenge on the Indian community in the country.
“But how different are they from the suspected criminals they murder when their actions are tantamount to a criminal act in itself?” Sugumaran said in a statement here yesterday.
He cited the Nov 8 incident in Klang when the police had shot dead five robbers during a high-speed car chase and the recent shooting of the Deva Gang leader in Penang.
The incident involving the five had raised public outcry over similar killings in the past, particularly of Indian suspected criminals, especially after the sister of one deceased attempted suicide along with her four children.
Since then, questions have been raised over the methods used by the police to curb crime by sending suspected criminals to their deaths instead of giving them their right to justice.
The police have however come out in their own defence, with Federal Criminal Investigation Department director Bakri Zinin claiming in a statement that in all shootouts, the police were fired at first.
He also claimed they did not respond in kind to kill the suspects but rather to “stop the deadly threat from causing hurt to innocent bystanders”.
Sugumaran rubbished these claims and said that the trigger-happy cops were just proving their incompetence in carrying out their duties.
“And each time a suspect is shot dead by the police, heaps of stories would be created to defame the name of the dead individual and justify the police’s action.
“Why is it that the police seem to enjoy killing these suspected Indian criminals without first ascertaining if they are alone or in a group?” he said.
He urged the government to respond to the outcry over the police’s “uncivilised” method.

The father doesn’t want the police harast them. The Klang hospital
authourities in coalition with the police did not allow HRP and HINDRAF
supporters to meet and speak to the suicide victims.

Seetha, could not take the grief of her little brother Surendran’s death . Surendran was shot dead by the police on the 8th of November. In her grief she decided to take her life and those of her 4 children yesterday morning. At about 8.30 am she gave everyone Paraquat to drink, telling her children that they will be able to meet their Uncle if they all drank the medicine. All of them drank it. Their lives are now in limbo as I write this article. They are all in the ICU.

 

Can you imagine Seetha’s state of mind that she should make such a decision. Not only her life but all her little ones as well. Can you imagine?

 

It pains me even to think about the state of her mind as she was giving them all the poison. Can I ever imagine doing this myself – what would make me ever to do such a thing. You kill the people you love and take your own life when you feel it is totally the end of the road, that there is no more hope or purpose to living. Is this what Seetha had in her mind when she decided at that fateful moment?

 

I do not know enough to write about the exact circumstances. But some facts are undeniable. Attempted suicide here happened in a circumstance of relative poverty. Seetha’s husband is a lorry driver. Her father is a Security Guard. She was a housewife. This is so typical of the Indian poor , Security Guards and Lorry Drivers are all what they can get up to.  Surendran was 24 years old like so many others of his age group who fall victims to crime.

 

How did Surendran get involved in crime – what took him there. For young Indian men who do not see much upward mobility in a life as a lorry driver or as a security guard(that is all that is available to them for their academic accomplishments in the Apartheid Malaysian system), crime seems to be an answer. Young as they are, they are oblivious or just plain unthinking about the incumbent risks and this is where they land up .

 

I cannot but conclude that this is really a crime committed against this family and against so many others like them , This story is not about Surendran’s crime or about Seetha’s attempted suicide but about the racist UMNO regime’s crime of causing the literal obliteration of Seetha’s family. You may accuse me of being mad, of being totally foolish to say this, to assign blame wily nily. Audacious as my blaming may be, give me an alternative esxplanation for this repeating pattern in these problems.

 

It is so blatantly clear to me that it is UMNO’s policy of continuing and total neglect of the Indian poor that leads the Indian poor to this end. They pay no attention to this problem. They are in total denial. They just do not care. They sentence these Indians to a life of deprivation and abandonment.

 

Why does the UMNO regime not acknowledge this line of reasoning and open up opportunities for the young Indians in this high risk group. There are thousands of development programs that the UMNO regime administers in the country – why do they not open them up and allow these young men into that mainstream.

 

My answer is plain and simple. It serves UMNO no purpose to do that. In fact the opposite effect serves them a better purpose. As more Indian young men go crime’s ways, they are all condemned one way or another to the dregs of Malaysian society to be finally disposed off like this. End of story for UMNO, no more problem. UMNO has divided up this country for that, the result being such tragedies.

 

Why does Seetha for her part see this as the end of the road? What is her background? How does she see this world? What is her state of knowledge? What is she looking at being a mother of 4 at the age of 31 and a wife to a lorry driver? Lorry driving is back breaking, long hours, away from home for long stretches, a low social status. What is the implication of all this to her? What does her brother mean to her? Is she not entitled to a luxury of some love for a little brother, no matter that he may be all wrapped up in crime now? I do not have answers to all these questions but having been through life myself I can venture some guesses. It comes back to the same answer. Seetha has been denied an even shot at life.

 

I hope Seetha and her little ones come through over the next few days. What this maens to the rest of us is that we have to wake up from our slumber and start asking some real hard questions. It is time that the likes of Seetha get what is their due.

No, today, it is not going to be a long cheo ng hei article. Today, it is
going to be short, though not sweet. Today is about how my son is going to
be turned into collateral damage.

To those who walk in the corridors of power, I wish to inform you that I
know you are beating up my son in the Sungai Buloh Prison. Every day he is
being subjected to beatings to force him to withdraw his not guilty plea
and to plead guilty to the various charges he is facing.
I also know he is being subjected to these daily beatings to force him to
withdraw his not guilty plea and instead plead guilty because there is no
evidence against him and the charges are merely trumped-up charges.

Furthermore, I know he is being threatened with six additional charges to
the ones he is already facing and he is being beaten up to force him to
plead guilty to these charges as well.

My son has informed me he can no longer stand these daily beatings and he
wants to plead guilty to the charges. I have advised him to do so although
we both realise that this means he will be spending at least ten years or
so in jail.

My son is aware he is being subjected to this torture to induce me to
surface and he is prepared to plead guilty and spend ten years in jail if
that means it will save me from the powers-that-be.

Today, Barisan Nasional is in power so it has the power of life and death
over its citizens. Well, who knows, one day Barisan Nasional might be
kicked out and Malaysia will see a new government.

Those behind the effort of torturing my son with these daily beatings had
better hope that Barisan Nasional stays on as the government for a long,
long time to come. If not, and if Barisan Nasional falls, then rest assured
it will be retribution time and all those people who are using my son to
get to me will be made to pay for it.

And, please, this is not a threat. This is a promise. And that is all I
wish to say about the matter

A National Tragedy In The Making.

There is a terrible decay occuring in our system. This decay shows itself up in so many ways. The latest situation which warrants this comment is about the increasing crime rate in the country. The crime situation that we see is really only the tip of the iceberg of our system. And the police are trying to blow that tip off every now and then with a spate of encounter killings. The ice below that tip just comes up afterwards every time and replaces the blown off tip without any effort. So, what has been achieved.

 

Hindraf is and has always been at the forefront of things. Our analysis of the social and political situation and the conclusions we come to are the same conclusions that the larger sections of our society come to, only later. Take the way we focused on UMNO as the main protagonist in the Malaysian political scene just before the 12GE – when everyone else was running scared of confronting the giant.  Everyone after that then jumped on the bandwagon in targeting UMNO..

 

Then after PR took over in four States, the conclusion that we came to, that there is really no substantial difference between PR and BN policies as far as the working people are concerned, was an early one, within a year of its taking over. Then we have others getting on to that band wagon now.  Yong Teck Lee, Jeffrey Kitingan from Sabah to name two significant personalities, and now even pro-PR political analysts are beginning to reluctantly admit it.

 

Uthayakumar has been saying for several years now that the Police are the ones really running this country. Najib tries to keep the people mollified with his histrionics while Musa Hassan manages the real power that runs the country. Take Hitler, take Saddam Hussein, now take the Myanmarese Junta . They are all just  raw versions of what is happening in Malaysia. The people have to realize this very soon. More and more people are coming to this awareness. But the racial angle to all this hubris makes it more difficult for all to see what is happening clearly.

 

In the last thirty days at least 10 suspects have been brutally killed by the police. In today’s Utusan the PDRM issued an explanation.  They say, the police had no choice. I say this is the usual police lie. They say the police did it in self defence. I say show me the police dead. They say that this kind of killing will teach other potential criminals a lesson. I say this does not make any sense as the crime rate has not gone down.  They say that if the police hesitated and the suspects shot back that could harm the bystanders. I say, so how many times have the suspects shot back and how many bystanders have been hurt? They say that if a policeman is killed they will not be sung as heroes. I say, if they were killed honorably, surely we will sing them as heroes. Not when they act worse than the criminals they are supposed to protect us from. Then they say why do we question these police actions for such questioning will hurt the morale of the police. I say the only thing that I know that will hurt the morale of the police is a reduction of their incomes. They do not care two hoots about all this questioning. They know they reign supreme..

 

You may in turn ask me - why am I standing up for these terrible criminals. Where is my sense of rectitude. Let me first say, that even if they are criminals, they are citizens of this country, only wayward citizens. They are victims of the system in more ways than one. Killing them off is no answer. What we need is a real problem solving approach. What we need is to understand the sources of this phenomenon of crime. As what the Malay elite keep repeating about the suicide bombing Islamic terrorists – we need to understand the root causes, we need to understand the root causes, they say. They ask why would anybody want to kill themselves by blowing themselves up. They keep repeating this in the media, in International Fora, everywhere. What we need is something similar here at home.

 

But that is far from happening here.

 

Most of the suspected criminals are Indians. This logic of looking for the root cause doesn’t apply here with the Indians in Malaysia. The Indian criminals and suspects are to be shot like dogs. They deserve no better. This is a way of hastening the process of self destruction of a community – a way of killing it off without trying. At the lower sections of Indian society this self destruct process is well under way. It is indeed gathering momentum – as evidenced by the many deteriorating social indicators. Now who is taking this up for a solution? Who will protest that nothing is being done?

 

Do we simply allow it to happen and beg and plead for a solution. Haven’t we done enough of that for the last half century. What has been the outcome, an acceleration of this deterioration –that’s all. That is all, that strategy can get. We have to change our tack now. We have to change strategy to really change this situation.

 

We need now a strong voice to change this state of affairs. And we need to demand it as a fundamental right, only we are asking it half a century late. If we want a real say in determining our destinies, and if our fundamental rights are to be guaranteed, then we have to fight to get it. We have to coalesce under one big umbrella to struggle for what is ours. We need to put in place a government that will give us all a say in determining our destinies. We have to learn how decadent this system really is from every single episode such as the recent encounter killings and equip ourselves to do the needful to bring about change, when the time comes. We have not to be taken in by the lies that the mass media carries. We are not to be taken in by the promises that politicians repeat every general election and every by election.

 

Hindraf/HRP offers that umbrella. How many of you can see this. How many of you are willing to subscribe to this. If we want change, we have to make it happen. It is not going to happen by itself. We, in Hindraf/HRP have signed up to lead change. If you want real change come join us. Only through uniting under an umbrella that truly represents the wishes of the Indian people can we hope to gain control over our destiny. The alternative scenario is a tragedy waiting to happen.

 

There is no other way.
