RECUAR NÃO É SER VENCIDO…

O blogue de Timor-Leste The Díli Insider foi forçado a encerrar devido
a insistentes ameaças de morte que têm vindo a fazer ao seu autor. The
Díli Insider é um blogue que tem publicado curtas mas incisivas notas e
fotografias que denunciam as actividades ilegais e muitas vezes
passíveis de criminalização de elementos ligados ao governo da AMP, de
Gusmão.

A situação não é nova mas parece que desta vez é muito mais séria e
perigosa por terem identificado o autor do blogue e terem realizado
ameaças telefónicas, para além das costumeiras ameaças por email.

Identificado e localizado o autor, tornou-se evidente que este corria
verdadeiro e evidente perigo de morte, por essa razão, porque Timor é
um país em que os crimes praticados pelos que são afectos ao actual
regime beneficiam de impunidade, não restou ao autor de The Díli
Insider outra alternativa senão encerrar o blogue e recuar.

Para muitos este facto poderá parecer algo de somenos importância,
contudo, para nós, equipa do TLN, não é novidade. Consideramos
seriamente as ameaças e tentativas de silênciamento que são feitas aos
que procuram denunciar o Estado de Crime que prevalece em Timor-Leste,
onde a liberdade de expressão e de informação é deficitária, excepto se
caminhar de acordo com os interesses da clique que predomina nos
Poderes, no seu Poder Legitimo e nos que invade ao arrepio da
Constituição.

O autor de The Díli Insider anuncia que pretende regressar à sua função
de defender a verdade sobre Timor-Leste, é provável que o consiga, mas
o efeito pretendido pelos autores das ameaças foi conseguido, até
quando não se sabe bem.

Uma vez controlada a comunicação social em Timor-Leste, eis que os
“censores” se voltam para os blogues inconvenientes que insistem em
produzir o debate e mostrar que o regime de Horta-Gusmão está
apodrecido pelas suas próprias imoralidades, ilegalidades, e não
observância dos direitos fundamentais de uma sociedade democrática,
cujas convenções internacionais assinaram mas se lhes convier não
cumprem.

A atitude maisreles de procurar identificar autores de blogues para de
seguida os fazer passar pelo crivo de ameaças não é novidade para o TLN
nem para os que procuram fazer prevalecer a legalidade em Timor-Leste
em prol de um estado verdadeiramente democrático, em que a justiça
funcione sem peias ditadas pelos mais poderosos mas também os mais
criminosos, apesar dos seus actuais elevados estatutos na sociedade
timorense. Um dia a impunidade deverá ter um fim em Timor-Leste, pois é
desse país assolado pelo crime que estamos a falar. Pela nossa parte
saberemos dar a resposta afirmando que vêm para nos tosquiar mas vão
acabar tosquiados. Pela legalidade faremos vencer a verdade. A
solidariedade dos que nos lêem, dos que liam o The Dili Insider, é
imprenscindivel, e agradecemos toda a que nos dispensam. Recuar não é
ser vencido, simplesmente ganha-se balanço para conseguir vencer e
trazer a verdade a público.

Dili - O Governo de Timor-Leste, decidiu assinar acordo com as companhias Petrolferas da Malaysia para cooperao cuja objectivo o de trazer Pipeline Greater Sun Rise (GSR) para Timor-Leste. A visita do ex-PM nos dias (10-11 Dezembro), trazendo consigo empresrios Malayu para investir em Timor-Leste, assinou os MOUs entre o Governo de Timor-Leste e as companhias Malayu, como: Company Kencana HL SDN (KHL), Company IBEX Cooperation Amalgamated e Janar Resources SDN BHD.

Nos contactos de alto nvel entre o Governo Timor-Leste e representantes das Companhias Petronas e Petrokimia da Malaysia, aos quais o Jornal teve acesso, O Governo est procura de uma companhia alternativa para trocar com a Woodside, para explorar a possibilidade para trazer o Pipeline GSR para Timor-Leste.

A Malaysia demonstrou o seu empenho em ajudar Timor-Leste, nos aspectos tcnico-cientfico, para trazer o Pipeline GSR para Timor-Leste. As empresas como Petronas e Petrokimia iro apoiar Timor-Leste em todos os aspectos; alem do vector tcnico-cientfico, esto tambm prontas para criar infra-estruturas para as plataformas petrolferas, a capacitao dos recursos humanos nas reas do petrleo e gs natural. E tambm para ajudar a criar a companhia de Petrleo e Gs de Timor-Leste.

Timor-Leste aproximou-se tambm da companhia KOGAS, da Correia do Sul, a maior compradora de gs do mundo, que tambm est pronta para a apoiar o Governo de Timor-Leste, no aspecto tcnico-cientfico, nas reas de Petrleo e Gs. A KOGAZ ir ajudar Timor-Leste a criar a LNG de Timor-Leste.

Austrlia, atravs de Woodside, quer levar Pipeline GSR para Austrlia:

O Governo da Austrlia, atravs da companhia Woodside, desenvolveu o mximo de esforos para levar o Pipeline GSR para o seu pas, principalmente para Norte da Austrlia. Atravs da Woodside tem procurado enfraquecer o Estado de Timor-Leste nas negociaes. Segundo fontes deste Jornal, a Woodside, uma companhia que pretende aumentar o seu oramento extra para desenvolver actividades como suportar os grupos na sociedade civil Timorense para enfraquecer o Estado Timorense, favorecendo os interesses da Austrlia e da Woodside. Como ltimo recurso, pode tentar alimentar a crise poltica e militar para criar instabilidade em Timor-Leste!

      FRETILIN wants to find a real solution, with consensus, for the appointment of someone who can commence the role of competently and effectively build the anti-graft capacity of the Anti-corruption Commission, we all voted for in the National Parliament.

      Prior to the nomination being tabled in parliament, FRETILIN was not consulted with respect to any potential candidates.

      FRETILIN continues committed to finding a Commissioner who will be able to do the job independently and competently. It seems however, that the AMP in the parliament, led by the President of the National Parliament is resisting any consensus being reached. This is counter-productive to our mutual aspirations of establishing an independent and competent anti-graft body to commence its much needed work as soon as possible.

      Parliamentary President Fernando Lasama de Araujo said they did not need to have consensus with Fretilin in appointing commissary for leading the approved anti-corruption, as the law did not allow.

      We are talking about the law which only allows the Government to nominate its candidate for the commissary, Lasama said.

      Lasama stressed that they also talked about the content of the law in which it regulated the work of the commissary and said there was nothing about consensus.

      Lasama called on PUN, PPT and KOTA benches to keep appearing in the Parliament to attend the Parliaments follow up activities.

      Fretilin wants Deputy PM Carrascalo to take up KAK commissary

      Fretilin MP Aniceto Guterres said although they had not officially determined their nominee, but they prefer Deputy Prime Minister for Management and Public Administration, Mario Viegas Carrascalo to take up Commissary for KAK.

      Guterres said they decided to continue absent from debating about the appointment for KAKs commissary, as they wanted to reach consensus with the AMP.

      Guterres stressed that it was important for the Government and other political parties in the parliament to have consensus with the nominee presented by Fretilin, adding that they [Fretilin] would never agree with Aderito de Jesus to take up the post.

      We have our own candidates, one is Deputy PM Carrascalo if he agrees to take up KAKs commissary, but if he refuses then we still have another candidate that is Mr. Sebastio Ximenes in PDHJ, but it has not been formally decided yet by the party room, Guterres said.

      FRETILIN held a peaceful, lawful demonstration against corrupt and

      Yesterday, the de facto government disseminated a media release that was
      simply a fabrication, claiming there was no demonstration against the AMP de
      facto government (please see email below).
      
      There was indeed a demonstration as everyone who was in Dili could see for
      themselves, and it was clearly the largest demonstration since FRETILIN's
      demonstration during the 2007 parliamentary election campaign. ( Images

      FRETILIN showed the way yet again of how Timorese can express their
      political discontent against the dismal and corrupt fashion the country is
      being governed, by demonstrating publicly in peace and according to the law.
        It is a marked contrast to the violence utilized by many of those now
      comprising the so called AMP against innocent people and especially FRETILIN
      supporters in 2006 and 2007.  We are informed, and are happy to be corrected
      if our information is incorrect, that the de facto government spokesperson
      was not even in Timor-Leste last Sunday.
      
      As for the reports of the numbers of persons attending the conference,
      around 5,000 party members were registered and present as delegates.  The
      lawful and peaceful demonstration which ensued involved between 8,000 to
      10,000 people.
      
      It is simply a lie for the de facto government spokesperson to state what he
      stated in the media release.  It is very much the head in the sand
      mentality, and arrogant approach we have come to expect from the de facto
      AMP government, and which they displayed in the last three weeks during the
      budget debate.

      Timor-Leste: Thousands Protest Against the Government

      Thousands of people marched today, Sunday, through the streets of Dili, the capital of Timor-Leste, in a March for Victory organized by FRETILIN, the largest Timorese political party in opposition.

      Having come from the various districts to Dili where they participated in aconference of party delegates, the militants afterwards paraded through the main streets of Dilion bicycles, motorcycles, cars, buses and trucks waving FRETILIN flags and posters of their leader, Mari Alkatiri.

      The meeting and the march were accompanied by police but there was no incident in the capital according to a UN police source contacted by LUSA.

      According to Mari Alkatiri, the popular mobilizationanswering FRETILINscallshould serve as a sign to the government and the majority alliance in parliament that supports it, of the populations discontent with how things are going in the country.

      The attendance wasbeyond wehad planned forwith about eight thousand people participating. If they (the government and AMP)are politicians and rent blind, they will see this mobilization as a sign, and if they are not, they will not understand said Mari Alkatiri to Lusa.

      The FRETILIN leader stated that thedemonstration today marked the beginning of a new phase for the party and a change of strategy,with a view tothe next elections:

      Up to now we have spoken of a Peace March, and peace can beachieved without victory. Now we are introducing a new strategic concept, the March for Victory.

      FRETILIN has claimed that it has contributed its share towards establishing peace in the country, with its leadership now saying that the moment has arrived to shift its attention to strengthening the democratic contest, so as to emphatically win the next set of elections.

      The March for Victory is not just a march: it is a consolidation of FRETILIN structures and will prepare us for all upcoming challenges, namely the comingmunicipal,parliamentary and presidential elections, Mari Alkatiri commented to Lusa.

      Despite being the party with the most votes in the last legislative elections, butin which it did not obtain absolute majority, FRETILIN was not invited to form government by the President of the Republic, who opted to designate as Prime Minister, Xanana Gusmao, the CNRT leader, who with other small parties createdthe Parliamentary Majority Alliance (AMP).

      FRETILIN has repeatedly questioned the legitimacy of the Xanana Gusmao government and declared victory in the recent local elections (called suco elections), in which political parties were not allowed to officially nominate candidates. FRETILIN claimed a majority of those elected were its registered party members.

      In contrast to the suco elections, the forthcoming municipal elections will have competition of political party candidate lists for mayor and municipal assemblies.

      Adérito de Jesus como candidato para se tornar o primeiro Comissário da recémestabelecida

      Comissão Anti-Corrupção.

       

      O Sr. Adérito de Jesus tem um registo notável de excelência académica e profissional.

      O Sr. Adérito de Jesus possui um Bacharelato em Direito da Universidade Satya Wacana da

      Indonésia, bem como um Mestrado em Direito da Universidade de Nova Iorque. Trabalhou

      para diversas ONGs internacionais e nacionais em Timor-Leste e na Indonésia, foi um

      professor de direito respeitado na Universidade Nacional e serviu as Nações Unidas de

      forma importante na qualidade de consultor.

       

      O Sr. Adérito de Jesus possui um conhecimento aprofundado sobre o quadro jurídico da

      nação; enquanto agente eleito da Assembleia Constituinte de Timor-Leste em 2001, foi

      instrumental na redacção da Constituição da República Democrática de Timor-Leste. Está

      actualmente a tirar um Doutoramento no Centro de Justiça e Governação Internacionais da

      Universidade Nacional da Austrália.

       

      “O Sr. Adérito de Jesus é um candidato deveras aprazível para o cargo de Comissário da

      Comissão Anti-Corrupção”, afirmou o Primeiro-Ministro Kay Rala Xanana Gusmão. “É um

      homem de integridade inquestionável, possuidor de qualificações profissionais notáveis, e

      representará os melhores interesses da Nação e do Povo de Timor-Leste de acordo com os

      padrões mais elevados.’

       

      ‘Solicitamos ao Parlamento Nacional que considere esta nomeação com base no mérito,

      qualificações, capacidade profissional e dedicação e serviço à nossa nação.”

       

      De acordo com a Lei que estabelece a Comissão Anti-Corrupção, o Comissário é nomeado

      pelo Parlamento Nacional mediante recomendação do Governo. A nomeação do Comissário

      será feita por maioria absoluta dos Deputados, desde que estejam presentes pelo menos três

      quartos dos Deputados com assento parlamentar.

       

      Caso seja nomeado, o Sr. Adérito de Jesus deverá conduzir os assuntos da Comissão,

      contratar funcionários e nomear até três Comissários Adjuntos para o ajudarem com as

      operações da Comissão.

       

      A Comissão Anti-Corrupção será um órgão independente que reportará ao Parlamento

      Nacional, estando mandatada para conduzir investigações relativamente a actos de

      corrupção, levar a cabo campanhas de educação e aconselhar todos os departamentos e

      instituições públicos sobre formas de prevenir a corrupção.

      nação; enquanto agente eleito da Assembleia Constituinte de Timor-Leste em 2001, foi

      instrumental na redacção da Constituição da República Democrática de Timor-Leste. Está

      actualmente a tirar um Doutoramento no Centro de Justiça e Governação Internacionais da

      quartos dos Deputados com assento parlamentar.

       

      Caso seja nomeado, o Sr. Adérito de Jesus deverá conduzir os assuntos da Comissão,

      contratar funcionários e nomear até três Comissários Adjuntos para o ajudarem com as

      operações da Comissão.

       

      A Comissão Anti-Corrupção será um órgão independente que reportará ao Parlamento

      Nacional, estando mandatada para conduzir investigações relativamente a actos de

      corrupção, levar a cabo campanhas de educação e aconselhar todos os departamentos e

      Last week a young boy became a victim of the PNTL (National Police Timor-Leste). A PNTL officer shot the youth in the upper left chest during a party in Dili, Timor-Leste.

      The youth was immediately hospitalised in Dili National Hospital and will be transfered to Indonesia for an urgent operation. The family of the youth are demanding an in depth investigation and want to see the case taken to court as soon as possible.

      The PNTL, the leading law and order institution in Timor-Leste has broken the law on many occasion in the past, often with the misuse of their weapons. Investigations almost never result in police officers being penalised. The issue of the management of PNTL weapons has be raised by many people, including MPs, over and over again, but little appears to happen.

      This PNTL action has angered FRETILIN Member of Parliament David Dias Ximenes. Ximenes has criticised the PNTL for being irresponsible with its weapons and has called for all rifles to be removed from PNTL, leaving them with side arms only, in addition to tear gas equipment. He further complained that PNTL is increasingly seeming like a army as opposed to a law and order institution. Despite 10 years of UNPOL assistance and the Political Security Crisis of 2006 PNTL continues to seek military style rather than a community police style. The wander around Dili and districts carrying all manner of semi-automatic assault paramilitary rifles including HK33s, Steyrs, and FNCs.
      Recently according to Tempo Semanal source within the Council of Ministers informed this Newspaper that the PNTL has recently sought to procure more weapons but the Government refused the request.
      In 2008 a young boy was killed by his brother in an accident with their fathers PNTL issue weapon in the Audian area of Dili. Since then Fransisco Guterres the Secretary of State for Security has ordered that all police never take their weapons home, however PNTL does not obey orders and many continue to bring their weapons to their homes, to parties and to bars in Dili.

      UN resolution on Myanmar welcomed: T-L Government abstention on vote condemned

      FRETILIN, as the political party holding the most number of seats in the Timor-Leste National Parliament, welcomes the adoption by the United Nations General Assembly last week of the resolution on the situation of human rights in Myanmar/Burma.

      However, we condemn the Timor-Leste de facto governments decision to abstain from the vote in the UN General Assembly on the Myanmar/Burma resolution last week. During this weeks budget debate session, in the presence of the de facto Prime Minister, Xanana Gusmao and Foreign Minister, Zacarias da Costa FRETILIN clearly stated its support for the resolution, in keeping with our voting record since 2002 of support for similar resolutions.

      The UN resolution "strongly condemns the ongoing systematic violations of human rights and fundamental freedoms" of the people of Burma and calls on the military regime "to take urgent measures to put an end to violations of international human rights and humanitarian law."

      The resolution was adopted by the Third Committee of the United Nations General Assembly, responsible for the promotion and protection of human rights, with a record of 92 member States voting in favor and 26 member States voting against. By abstaining, the Timor-Leste government has once again demonstrated its tolerance of impunity in relation to human rights violations.

      The UN body expresses its grave concern over the recent trial and sentencing of Daw Aung San Suu Kyi, Nobel Peace Prize Laureate, and the current imprisonment of more than 2,000 political prisoners, as well as the restrictions imposed by the junta to rights of freedom of expression, assembly and association.

      Moreover, the resolution "expresses grave concern at the continuing practice of arbitrary detentions, enforced disappearances, rape and other forms of sexual violence, torture and cruel, inhuman and degrading treatment, and strongly calls upon the Government of Myanmar to allow a full, transparent, effective, impartial and independent investigation into all reports of human rights violations, and to bring to justice those responsible in order to end impunity for such crimes".

      Article 7, line 1) of the Constitution of the Democratic Republic of Timor-Leste states that: On matters of international relations, the Democratic Republic of Timor-Leste shallgovern itself by the principles of national independence, the right of the Peoplesto self-determination and independence, the permanent sovereignty of the peoplesover their wealth and natural resources, the protection of human rights.

      The people of Timor-Leste struggled for 24 years against a foreign occupation and were greatly assisted and protected in our struggle by international human rights law. Our human rights prevailed and we are an independent nation state today because the international community recognized our human rights.

      Our people are deeply committed to promoting and defending human rights abuse wherever it occurs and our constitution enshrines that in law. Timor-Leste has ratified all United Nations Treaties and conventions as a consequence. Unfortunately the actions of this de facto government do not reflect that commitment since the restoration of our independence on 20 May 2002.

      It is however, regrettably very much in keeping with the AMP de facto governments contempt for human rights and the rule of law, and its tolerance of impunity, which it demonstrated on 30 August last by illegally freeing a prisoner (former militia leader Maternus Bere) who awaiting trial for gross mass crimes against humanity in Timor-Leste, and then assisted him to leave the country.

      [Dear readers, My guest blogger rightly fears reprisals, so even a pseudonym is out.]

      At the development partners meeting a few weeks ago I was reminded of a line from a the book Outliers, where the First Officer says to the pilot the weather radar has been very useful suggest that other devices apart from the naked eye could be used to land the plane as they are about to crash into a mountain.

      Except that not one of the development partners would even hint that there was such a thing as a weather radar. At this meeting the government, the DSRSG congratulated the government on its excellent progress to date, especially on matters such as food security and security sector reform what the hell?!

      The World Bank also appeared to be in an extremely congratulatory mood. When the national priorities of justice and governance came up, not one development partners raised a question about the Presidents, Prime Ministers, and Minister of Justices alleged breaches of the constitution with regard to the Martenus Bere case, nor did any of the development partners raise any questions about the lack of accountability, transparency, and apparent unlawfulness and outright craziness of the misappropriation of the $70 million from the now postponed(?)/cancelled(?) heavy oil plant for pakote referendum.

      The excuse appears to be that these issues are raised privately in meetings between high level representatives of the development partners and Ministers. I know that these issues are not raised or even hinted at.

      Why are the development partners so afraid of offending their hosts? I understand that bilateral partners have a long term relationship to think about, but what about multilateral partners. What is the worst that would happen if they do offend their hosts by telling them the truth about what they are doing wrong? Would they get kicked out of the country?

      Unlikely as people like the President are too cautious about their international image for that. What is the worst that will happen if they dont inform their hosts about what they are doing wrong? The country may descend into civil unrest again. And isnt the raison detre of a DPKO mission to keep the peace?

      Why wont the UN openly state: security and justice sector reform in Timor-Leste is a joke. Today some government civilian staff who were trying to uphold some administrative systems were threatened by senior FFDTL members and PNTL officers waving weapons in their faces because they would not just handover cash to the FFDTL and PNTL.

      What can these civilian staff do?

      If they complain about the unlawful behaviour of these FFDTL and PNTL to the PNTL or the Prosecutors Office either 1) nothing will happen or 2) they will be faced with reprisals by the people they have complained about.

      If they just handover the cash to these FFDTL members and PNTL officers they will be accused of maladministration and may face investigation by the Provedor or the Office of the Prosecutor.

      If they just handover the cash it will also give courage to others trying to violate the system.

      So where is the progress on security sector reform the DSRSG was so effusive in his praise about? And what kind of lawless state are we living in when the FFDTL and PNTL can pull their weapons on civilians and because the formal justice system is so dysfunctional and both institutions are so unaccountable (despite millions of dollars of bilateral and multilateral support) that only the civilian will be punished?

      Malaes continue to privately bemoan the lack of accountability and responsibility of Timorese for anything whether it be for not turning up to work, stealing fuel from generators and vehicles, handing out millions of dollars of contracts to companies which only exist in the scrap of paper in the back pockets of Ministers wives/husbands/brothers/sisters/sons/daughters, paying tens of thousands of dollars in spurious medical costs of convicted murderers who tried to overthrow the state, or providing clemency to mass-murderers.

      And malaes also complain that Timorese will not honestly tell each other NO, ENOUGH IS ENOUGH. YOU CANNOT TAKE A 50% CUT OF EVERY CONTRACT THAT COMES THROUGH THIS MINISTRY. But why should Timorese be accountable, or responsible, or honestly tell each other anything, if their malae partners, and especially the biggest malaes the UN, World Bank, and other development partners will not provide the same courtesy?

      Ukun rasik an is a term that many in the Timorese in power like to bandy about. I am not sure what is so rasik about the fact they still have malaes to police the state, malaes to provide external security, malaes to write the budget, malaes to manage the countrys wealth (the Petroleum Fund).

      The only thing that seems to be done rasik is to fail to execute the budget, fail to tender for or oversee contracts, and to violate every single law in the country on a daily basis.

      As one commentator has suggested, if the Minister of Finance and Prime Minister are so delusional as to believe that Timor really can ukun rasik an, maybe its development partners should let them do it for a while and see how they go.

      How much more of the Petroleum Fund is left?

      This fund that was supposed to last more than 50 years (and probably would have if Fretilin had not been forced out) will be lucky to last 8 years.

      Who will pay the FFDTL and PNTL then? (let alone all the other civil servants). How many other countries have descended into civil war because the government was so corrupt and so inept that it could not only not provide basic services, but could not afford or was incapable of paying the people with weapons? What will the UN and other development partners say then? Sorry, we knew this was going to happen but because we held your delusional ukun rasik an in such high regard we did not want to offend you?

      The plane is still descending through the storm clouds, and there may still be time to remind the captain about the weather radar and even better suggest an alternative means of landing before the plane crashes, and everyone on board, development partners included, becomes incinerated by the flatulence of their own egos.

      FRETILIN women MPs call for greater justice for women

      On the International Day for the Elimination of Violence Against Women, FRETILIN deputy leader in the National Parliament, Josefa Pereira, called on the President of the Republic, the de facto Government of Xanana Gusmao and the National Parliament to honestly accept that they have failed to practice what they preach on this issue, and to mend their ways.

      Josefa Pereira MP is a woman of the national resistance against Indonesian occupation. The International Day for the Elimination of Violence against Women, was established by the United Nations General Assembly in December 1999, just after the trauma of the independence Referendum conducted by the UN on August 30 that year.

      President Dr Jos Ramos-Horta saluted the occasion: Today we celebrate the International Day for the Elimination of Violence Against Women. It is an opportunity for especially the youth to remember, but also men, that women our mothers, wives, sisters, daughters deserve greater respect and dedication in Timor-Leste, the worlds youngest democracy, in a way that serves as a reference of the social peace and stability of its citizens.

      Ms Pereira commented: These are fine words but where has the President put this into practice in performing his function as head of state? It was after all he who pressured the de facto Prime Minister to illegally release the former militia leader Maternus Bere, who was indicted, arrested and awaiting trial for crimes against humanity including the murder, rape and sexual slavery of women and young girls. These are crimes of extreme violence against Timorese women and girl children. Are they not deserving of justice? Does respect and dedication not include striving for justice for women victims of violent crimes? Yes, they are deserving and yes, justice must be sought.

      As for the government, the de facto Prime Minister made himself clear before parliament, that he thought that the women victims of the rape and murderous conduct by Bere came a very far second place to diplomatic relationships with Indonesia, and his warped perception of national interest. In this he was supported by the women MPs from all political parties in the National Parliament, except for FRETILIN and PUN. The President of the Parliamentary Womens Group and Vice President of the National Parliament, Maria Paixao, said nothing to advocate for justice for Beres victims. It seems after this weeks debate in parliament that the main focus of the Parliamentary Womens Group is international travel, Ms Pereira said.

      UN Secretary General, Ban Ki-moon also protested against domestic violence, referring to unforgivable crimes, that plague some parts of the world: such as the use of rape as a weapon of war, sex trafficking, 'honor' killings, and genital mutilation."

      Ms Pereira said that this embodied the real meaning of how to celebrate this day - advocating the eradication of such violent crimes against women, by insisting on justice for the victims and prosecution of the perpetrators of such crimes, not their impunity, and hopes that the UN too lived up to their words.

      During the last few months of 2009, Timor-Leste's Government began a number of legislative, diplomatic and financial actions to move the country toward borrowing money from foreign governments and institutions. La'o Hamutuk believes that this would bring huge risks to this country, especially to future generations. We are providing these links and analysis to help ensure that the decision is made with as complete information as possible.

      Overview

      The people of many undeveloped countries have found, to their horror and suffering, that previous governments signed contracts committing public funds to repay loans. Money flows out of the country to foreign governments or international financial institutions (IFIs), while at the same time the state cannot afford adequate levels of essential services for its citizens. The loans, which primarily benefited rich people or foreign companies, failed to support the people or to develop the economy. Even when loan interest rates are "concessional" (less than market levels), the legal obligation to repay the principal before spending money on local needs deprives people of health, education and security. This led to a "debt crisis" in the late 1990s, with some loans being cancelled and some reforms, but the basic dangers and economic injustice still exist. Future generations of poor people are obligated to pay for the financial and political benefits of the current generation of policy-makers.

      Although Timor-Leste was fortunate to begin life as a sovereign state without owing anything to anybody, the nation was encouraged to borrow in 2004 to meet a predicted "gap" between oil revenues and necessary public expenditures. The Prime Minister at that time resisted the pressure, and the "gap" never occurred.

      Today, the Government is planning to borrow to pay for its dreams, such as highways, airports and centralized electrical generation. Although these mega-projects built by foreign companies could make our leaders and people proud, there is no magic connection between building them and increasing the strength of the local Timorese economy.

      Petroleum-dependent countries like Timor-Leste are particularly likely to borrow, as the state already receives money without much effort or planning. But they are also especially endangered, as petroleum revenues may decline while loans are still being paid back. When Timor-Leste's oil revenues run out in 15 years, and debts still must be repaid, our children and grandchildren will suffer the consequences.

      The 2005 report Drilling into Debt: An Investigation into the Relationship Between Debt and Oil by OilChange International discusses how these risks and consequences have affected other countries. Timor-Leste should learn from their unfortunate experiences.

      Budget and Financial Management Law

      On 21 October 2009, Timor-Leste published a new Budget and Financial Management Law, Law No. 13/2009, replacing UNTAET regulation 2001-13 which had defined budgetary processes for the last eight years. The UNTAET regulation previously in effect did not authorize Timor-Leste to borrow, because UNTAET did not want to burden the future independent state with debts incurred during the UN transitional administration. However, in the new law, Article 20 describes how the State can borrow, and Article 21 creates a process for the State to make loans to people or businesses.

      While the draft law was being debated in Parliament, La'o Hamutuk and other NGOs suggested improvements. Regarding borrowing, the NGOs recommended the following, although most of our suggestions were not incorporated in the law:

      1. Fundamental reason for the Government to borrow. Timor-Leste already has five billion dollars in our Petroleum Fund, and the Government needs to explain why it wants to borrow. This law only defines how to borrow and how to manage this debt in the state budget. Timor-Leste does not need to take a loan from an international financial institution or another nation. We recommend that the National Parliament has the right and obligation to audit and monitor, and must discuss, know about and ratify loan agreements, including the conditions of the loan and how it will be repaid, limitations on increasing the debt, the capacity to pay it back, and the consequences for Timor-Leste if it is not paid.

      2. Capacity to pay back loans, and sources of revenues to pay the loans. Many nations in the Third World have fallen into financial crisis because they do not have the capacity to repay loans, and the borrowed money wasn't used to develop sustainable sectors of their economy which produced a return. The National Parliament should insist that the Government demonstrate that it will be able to repay the loan without placing a heavy burden on future generations. Government also must show the results from investing the loan in sustainable development and their good returns, the conditions for using the money, and real indicators of implementing the development program, so that Timor-Leste is not made to fall into the resource curse, with a heavy, long-term debt.

      3. The Petroleum Fund cannot be collateral for borrowing. This law does not mention what money will be used to pay back loans. Article 20 of the Petroleum Fund Law states that petroleum revenues cannot be used as debt security. With this Budget and Financial Management Law, perhaps we will use the Petroleum Fund as a debt guarantee, which contradicts the PF Law. This law also does not have good provisions for transparency and public consultation. We suggest that this law should follow the example of the Petroleum Fund law, which contains provisions for transparency and accountability for using petroleum revenues. If the BFM Law does not refer to the PF Law, it will create legal confusion and increase institutional instability, opening the way for political polemics and court cases.

      4. Article 20: Guarantees and borrowing by the State. We recommend that Parliament use its legislative power to amend the draft law so that future Parliaments will have the right to know and approve debt agreements, the conditions for borrowing and repayment, the schedule for repayment and an estimate of how much it will cost. We suggest that the National Parliament eliminate this article, because Timor-Leste has enough sources of revenue to finance our state.

      Repaying loans from Petroleum Revenues

      Article 20 of the Petroleum Fund Law says that the Petroleum Fund cannot be used as collateral for borrowing. As all petroleum revenues to Timor-Leste must be deposited into the Petroleum Fund, some have interpreted this to mean that debts cannot be repaid from petroleum revenues.

      Unfortunately, this is incorrect. Once money has been transferred from the Petroleum Fund to the Treasury, it can be used for any purpose included in the General State Budget. Since 98% of Timor-Leste's state income comes from petroleum revenues, and since debt repayments have the first claim on the Budget, it is inevitable that money transferred from the Petroleum Fund will be used to repay debts. To put it another way, who would expect Timor-Leste to be able to repay $3 billion dollars if we didn't have any oil resources?

      When the Petroleum Fund Law was being debated five years ago, La'o Hamutuk made several suggestions, including that Petroleum Fund money should be prohibited from paying to service debts. Unfortunately our advice wasn't followed, and any nation or IFI considering lending money to Timor-Leste knows that the money in the Petroleum Fund will pay off the loan, after being transferred to the state. If Timor-Leste fails to repay and goes into default, the lender might not be able to take money directly out of the Petroleum Fund, but neither would the Government of Timor-Leste, as the lender would be able to seize any money transferred into the Treasury.

      The Ministry of Finance plans to revise Petroleum Fund law before July 2010. One reason for this is to enable a riskier investment strategy which could produce a higher return on investing the Petroleum Fund, but once the law is open for revision, any part of it could be changed. If this revision process is undertaken, we hope that Government and Parliament will incorporate the suggestions La'o Hamutuk made in 2005. However, we are concerned that the current Government appears more interested in spending money rapidly than in protecting the long-term interests of Timor-Leste's people, and hope that they will not weaken the already limited protections of the Petroleum Fund Law.

      2010 State Budget

      In October 2009, Timor-Leste's Government presented its proposed General State Budget for 2010 for Parliamentary approval. This is the first budget to be enacted under the new Budget and Financial Law, and the first to include a chapter on Financing, reproduced at right.

      The budget does not include authorization for Timor-Leste to borrow, but indicates that Government will present a mid-year "budget rectification" to revise the budget and include loans, including up to $3 billion for infrastructure projects.

      The 2010 State Budget drastically reduces the appropriation for the Heavy Oil Electricity Generation and national distribution network, from $375 million to $73 million over the life of the project. At the same time, the Prime Minister has made several "corrections" to the project which will significantly increase its cost. It seems likely that at least half a billion dollars of proposed borrowing will be a loan from China which will be used to pay Chinese Nuclear Industry Construction Company No. 22 for the ill-conceived heavy oil project.

      La'o Hamutuk's submission to Parliament on the 2010 State Budget explained our concerns about borrowing, including the following:

      The proposed 2010 State Budget does not ask Parliament to approve Timor-Leste taking out a loan, but it implies that such approval has already been granted, and that only a directive is required before the Government can borrow. It also discusses an already-signed MoU with Portugal which would arrange and pay for agreed infrastructure projects to be repaid at a later date but which would not be part of the General Budget of the State. Another paragraph says that the Government will seek approval from Parliament when it decides how much to borrow, which is expected to be around $3 billion over a project life of several years.

      It makes no sense to take out a loan while oil revenues are coming in, only to have to repay it after the oil is used up. Although Article 9 of the Budget and Financial Management Law pays respect to equity between current and future generations, the borrowing that it enables does the opposite wasting our childrens future to pay for current-day whims. It undercuts the basic objective underlying the Petroleum Fund to use todays non-renewable resources for lasting benefit, rather than squandering them now and imposing the burden of loan repayments on our grandchildren.

      The important question is not how to borrow, but why:

      • What will the money be used for?
      • Is it guaranteed to increase economic growth and domestic revenues enough to repay the loan?
      • Does the money have to be used to buy from the country which gave the loan?
      • If hiring a Portuguese company makes the road twice as expensive as it would have been to hire someone else, we will effectively pay 100% total interest.
      • How much has to be repaid? When?
      • Where will the money to repay come from?
      • If Timor-Leste cannot repay, what are the consequences?

      Even at concessional interest rates, repaying a loan will permanently lower the amount of money Timor-Leste has to use from the Petroleum Fund. For example, suppose we borrow $3 billion in 2010 at 2% interest, and pay it back over 30 years. When the loan is fully repaid in 2040, we will have paid back $4.14 billion. We will have depleted our Petroleum Fund, reducing the long-term ESI by $125 million every year after that.

      Pressure to borrow

      On 21-22 October 2009, Parliament Committee C held a workshop on Central Bank, Government Borrowing and Lending, and General Budget of the State 2010.

      Speakers from the World Bank, Banking and Payments Authority, the Japan International Cooperation Agency (JICA) and others encouraged Timor-Leste to, in the Bank's words, "Assess options for creating fiscal space and financing the budget deficit, ensuring quality of expenditure." Only La'o Hamutuk reminded participants that the important question is not how to borrow, but why. Several presenters argued that Timor-Leste should borrow because the interest rate might be low, but even a zero-interest loan has to be repaid. Nobody discussed the paradox of borrowing when oil revenues are high, only to have to repay when they are low or zero.

      La'o Hamutuk does not have access to private conversations between the IFIs, other nations, and Timor-Leste's Government. But we imagine that what they say in private is similar to what they say in public, and that technocratically-oriented economists are pushing Timor-Leste to go into debt. Long after these highly-paid "experts" have gone home, generations of Timor-Leste citizens will suffer from the consequences of their advice, which serves their employers rather than this country.

      MoU and negotiations with Portugal

      On 21 September 2009, the Ministers of Finance of Portugal and Timor-Leste signed a Memorandum of Understanding for a "Soft Line of Credit" which is the basis for Timor-Leste to borrow up to 500 million Euros (US$ 750 million), in installments of 100 million. Details of the loan will be worked out in a "Framework Agreement" to be signed in January 2010.

      Although the MOU has not been made public, some information was posted on a Portuguese website encouraging Portuguese companies to apply for contracts. In addition, we have learned that loans from Portugal will be used for yet-to-be-defined infrastructure projects and are likely to be tied, with 40% of the loan paying for companies and goods from Portugal, 40% from Timor-Leste, and the remainder unrestricted.

      Consideration of China

      The government of China, which has a lot of money because of its large exports to Europe and North America, is short of natural resources to supply its huge population and industrial base.

      In mid-October, Timor-Leste's Prime, Finance and Foreign Ministers, Secretary of State for Natural Resources and other officials visited China, discussing loans, which the Prime Minister called "investment." Macauhub reported that "
      Foreign Affairs Minister, Zacarias da Costa, has said that East Timor is negotiating a loan from China to fund the countrys large infrastructure projects. "

      One logical destination of Chinese loans is the Heavy Oil electricity project, but Chinese companies could also be contracted to build highways, dams, airports, ports and other infrastructure here, importing Chinese workers and using Timorese only for low-paid manual labor. It remains unclear whether such projects would expand Timor-Leste's domestic economy enough to repay the loans, and what other conditions China would require in return for lending money to Timor-Leste.

      China has been going around the world, especially in Africa, offering loans to countries rich in oil and minerals. Often, these loans are designated for infrastructure projects to be built by Chinese companies. And often, the repayment and conditions of these loans get countries into trouble. Several recent examples are described on our web page.

      Other possibilities

      More traditional lenders, such as the World Bank, IMF, ADB, Japan and other nations, are also attracted by Timor-Leste's petroleum wealth, inexperience, and appetite for mega-projects.

      We believe that borrowing is one of the most critical and dangerous decisions a government can take, burdening future generations with paying for perceived short-term political or financial gain. It should be undertaken only with extreme caution, careful and realistic planning, full public discussion, and total transparency about the conditions, terms and repayments of the loan.

      On pages 12-13, Timor-Leste is celebrated:
      Timor-Leste was the top reformer in 2008/09. A new tax law came into
      force in July 2008, transforming the tax regime for businesses. It cut
      the profit tax rate from 30% to 10%, allowed all depreciable assets to
      be fully written off in the year of purchase and abolished the
      alternative minimum tax and the withholding tax on interest. Corporate
      income tax is now paid in quarterly rather than monthly instalments
      when turnover is less than $1 million, with simple rules for its
      calculation. The time required for paying taxes fell by 364 hours a
      year.
      
      This would be funny if it weren't so sad.
      
      According to page 88 of the new World Bank report, Timor-Leste has by
      far the lowest "Total Tax Rate" for businesses in the world -- 0.2%.
      The next lowest is Vanuatu with 8.4%. Indonesia (around the global
      median) is 37.6%, while our other neighbor, Australia taxes at 48.0%.
      
      The World Bank lauds Timor-Leste for reducing the amount of time
      required to pay taxes, down to 276 hours per year.  Vanuatu requires
      120 hours, Indonesia 266, and Australia 107 hours. Dividing the time
      spent by the percentage tax paid, we can calculate that Timor-Leste's
      "taxpaying inefficiency" is 1380, Vanuatu 14.3, Indonesia 7.1, and
      Australia 2.2.  In other words, Timor-Leste requires nearly a hundred
      times as much bureaucracy per dollar of taxes as Vanuatu, and more
      than 600 times as much as Australia.  Is this something to be proud of
      -- no revenues to the state, but lots of wasted time for businesses?
      
      No wonder the Government feels compelled to overstate the amount of
      domestic revenues in the 2010 State Budget (see

      When the proposed Tax Reform law was being debated in March 2008, La'o
      Hamutuk's submission (

      We will withdraw the CSP members from Ministers and Secretaries of State, because we are reallocating them, and we will determine which ministers and which ministers or secretaries of state do not need the CSP, the PNTL Commandant General, Longuinhos Monteiro said to journalists upon his return from a work visit to Indonesia, Thursday 19/11.

      He said that up until now the bodyguards have not been performing the role of security but instead have been acting more like helpers or assistants to carry ministers or secretaries of states briefcases and not to provide security to them.

      Because of this we will recall all CSP members and propose a proper and clear Job Description and it will be the general command who will decide to reduce members of CSP allocated to Ministers and Secretaries of State, Longuinhos said.

      He also revealed that the PNTL Command now has a new mechanism and new guidelines regarding Close Protection to government members.

      For this reason Command will decide which members of government need bodyguards and which dont, according to the analysis of risk to members of government is not the same and not all need security protection. car/jes
