(Mathaba) Yahoo isn't happy that a detailed menu of the spying services it
provides to "law enforcement" and spy agencies has leaked onto the web.

After earlier reports this week that Yahoo had blocked an FOIA Freedom of
Information release of its "law enforcement and intelligence price list",
someone helpfully provided a copy of the Yahoo company's spying guide to the
whistleblower web site Cryptome.org.

The 17-page guide, which Yahoo has tried to suppress via legal letters to the
Cryptome.org site run by freedom of information champion John Young, describes
Yahoo's policies on keeping the data of Yahoo Email and Yahoo Groups users, as
well as the surveillance and spying capabilities it can give to the U.S.
government and its agencies.

The Yahoo document is a price list for these spying services and has already
resulted in many people closing down their accounts in protest. However, closing
a Yahoo account is not as easy as one might expect: users have reported great
difficulty in finding the link to delete their account, and, Yahoo will still
keep data for another 90 days.


If you ask Yahoo! to delete your Yahoo! account, in most cases your account will
be deactivated and then deleted from our user registration database in
approximately 90 days. This delay is necessary to discourage users from engaging
in fraudulent activity.

Please note that any information that we have copied may remain in back-up
storage for some period of time after your deletion request. This may be the
case even though no information about your account remains in our active user
databases.

The West Virginia Record reports attorney Joseph Wallace, "winner of a
constitutional contest on behalf of the Constitution Party, seeks $275 an hour
for his services. Wallace persuaded U.S. District Judge John Preston Bailey to
declare that under the U.S. Constitution, the West Virginia Legislature can't
prohibit soliciting in state parks. … A prevailing party in a constitutional
case can claim attorney's fees from the loser, and Bailey asked Wallace to
submit a bill. Wallace billed 79.8 hours at $275 an hour, for a total of
$21,945." Rutherford Institute attorney Douglas McKusick, who also served on
behalf of the Constitution Party in the case, "billed 72.3 hours at $200 to
$250." West Virginia Division of Natural Resources Director Frank Jezioro, "the
loser in the contest, argues that Wallace doesn't deserve $275."
Joe Wallace's fees: 79.8 x $275 = $21,945
Doug McKusick's fees: 72.3x$200+ = $14,460+
COMBINED: $36,408 !!

The question I have is will this be assessed against the DNR, the state, or
Jezioro personally?

North Carolina Libertarians Receive $39,691 From Income Tax Checkoff
August 13th, 2009
On August 13, the North Carolina Libertarian Party received $39,691 from the
State Board of Elections. UPDATE: Democrats received $429,736; Republicans
$264,951. This money is from the North Carolina state income tax forms. Those
forms permit taxpayers to send a small donation to the party of their choice.
This is the first time the Libertarian Party has received such funds in North
Carolina since 2003, when it received $701. North Carolina law says only parties
with registration of 1% should be on the tax form. However, the official who
printed the tax forms late last year ignored that law, and printed the
Libertarian Party on the form anyway, even though its registration was only
.07%. The registration was low because all the party's registrants had been
erased in late 2005 because the party did not requalify quickly for 2006;
instead it requalified in 2008 and remains qualified.

Introduced in the Michigan House on August 11, 2009, the "Firearms Freedom Act"
(HB-5232) seeks "to make certain findings regarding intrastate commerce; to
prohibit federal regulation of firearms, firearms accessories, and ammunition
involved purely in intrastate commerce in [the State of Michigan]; to provide
for certain exceptions to federal regulation; and to establish certain
manufacturing requirements."

The bill was authored by Rep. Phillip Pavlov and currently has 44 co-sponsors.

While the HB5232's title focuses on federal gun regulations, it has far more to
do with the 10th Amendment's limit on the power of the federal government.  It
specifically states:

The regulation of intrastate commerce is vested in the states under amendments
IX and X of the constitution of the United States, particularly if not expressly
preempted by federal law. Congress has not expressly preempted state regulation
of intrastate commerce pertaining to the manufacture on an intrastate basis of
firearms, firearms accessories, and ammunition.

Some supporters of the legislation say that a successful application of such a
state-law would set a strong precedent and open the door for states to take
their own positions on a wide range of activities that they see as not being
authorized to the Federal Government by the Constitution.

Firearms Freedom Acts have already passed in both Montana and Tennessee, and
have been introduced in a number of other states around the country. There's
been no lack of controversy surrounding them, either.  The Tenth Amendment
Center recently reported on the ATF's position that such laws don't matter:

The Federal Government, by way of the Bureau of Alcohol, Tobacco and Firearms
expressed its own view of the Tenth Amendment this week when it issued an open
letter to `all Tennessee Federal Firearms Licensees' in which it denounced the
opinion of Beavers and the Tennessee legislature.  ATF assistant director Carson
W. Carroll wrote that `Federal law supersedes the Act', and thus the ATF
considers it meaningless.

Constitutional historian Kevin R.C. Gutzman sees this as something far removed
from the founders' vision of constitutional government:

"Their view is that the states exist for the administrative convenience of the
Federal Government, and so of course any conflict between state and federal
policy must be resolved in favor of the latter."

"This is another way of saying that the Tenth Amendment is not binding on the
Federal Government. Of course, that amounts to saying that federal officials
have decided to ignore the Constitution when it doesn't suit them."

Advocates of these efforts say it doesn't matter if the federal government
disagrees, or even threatens states over funding, as they did recently with
Oklahoma.  Gary Marbut, author of the Montana Firearms Freedom Act, and founder
of http://www.firearmsfreedomact.com/ took this position in a recent interview
with the Tenth Amendment Center:

"We're not depending on permission from federal judges to be able to effectuate
our state-made guns bills.  And, we're working on other strategies to wrest
essential and effective power from the federal government and put it where it
belongs."

The principle behind such legislation is nullification, which has a long history
in the American tradition. When a state `nullifies' a federal law, it is
proclaiming that the law in question is void and inoperative, or
`non-effective,' within the boundaries of that state; or, in other words, not a
law as far as the state is concerned.

All across the country, activists and state-legislators are pressing for similar
legislation, to nullify specific federal laws within their states.

A proposed Constitutional Amendment to effectively ban national health care will
go to a vote in Arizona in 2010.  Thirteen states now have some form of medical
marijuana laws – in direct contravention to federal laws which state that the
plant is illegal in all circumstances.  And, massive state nullification of the
2005 Real ID Act has rendered the law void.

While many advocates concede that a federal court battle has a slim chance of
success, they point to the successful nullification of the Real ID Act as a
blueprint to resist various federal laws that they see as outside the scope of
the Constitution.

Some say that each successful state-level resistance to federal programs will
only embolden others to try the same – resulting in an eventual shift of power
from the federal government to the States and the People themselves.

"All the king's horses and all the king's men couldn't put (America)
together again."

      America has fallen from its lofty perch. It lies in pieces
scattered across the country's landscape, the victim of greed. In
2006 I launched the Reenactment of 1776.  In my first mailing I said
that what was coming was "people will be losing their homes in
unprecedented numbers, banks will be going under, unemployment will
skyrocket, and that we would go into a depression like this country
has never experienced."   It was a unique position to take at that
time because the economy was humming along and no one in the
government or Wall Street even mentioned a scenerio like this.  Now
it is 2009 and everything has come true.  A basic knowledge of
economics 101 was all that was needed to predict this catastrophe.
My new forecast calls for the collaspe of the government.  Recently,
I put out an idea for the people to create a bank with which we could
use to fight the tyranny and corruption that got this country where
it is today, on the brink of collapse  This is no longer feasible
because we cannnot create the bank quick enough to accomplish this
goal.  Even if it were possible, the ensuing collapse of the
financial system and the government will ruin the people whether they
have this bank or not.  Here is why there is a high probablility that
the collapse is going to happen.

1. The government finances its debt by selling treasury bills, notes
and bonds.  In its simplest terms either people or institutions give
their money to the government.  In return the government gives an
investor a bill, note or bond.  These instruments are basically IOU's
with varying lengths of maturity.  These range from 30 days to 30
years.  When these instruments mature the government is responsible
to pay off the IOU.

2. Historically, the biggest investors in these financial instruments
have been financial institutions and central banks of other
governments.  These institutions are banks, insurance companies and
pension funds.   The government is now lending money to banks and
insurance companies.  Therefore, the government cannot be loaned
money from the banks or insurance companies.  The pension funds are
crippled by their investments and have no money to lend to the
governement.  As this is a world wide depression, foreign countries
are in the same situation as our government.  They cannot lend our
government any money.

3. The government is experiencing a reduction in income because
people are not working and are not paying taxes.  Instead people are
collecting social security, unemployment and welfare, accounting for
a negative cash flow for the government.  More is going out then is
coming in.  As the depression worsens so does the negative cash
flow.  On top of that we're in a war which is consuming more
government money.  On top of that there will be between $750 billion
to $1 trillion of debt created by the initial bail out, maybe more.
Obama has proposed to create another $800 billion of debt under the
auspices that it is an economic stimulus package.  When the corrupt
lawmakers get finished with it the number will be probably around
$1trillion.  As is the same for individuals, as long as the debt
expense to income is kept at a fiscally responsible percentage then
the debt is managed properly and poses no problem.  However, when the
percentage of debt expense gets too big in relation to income then a
point is reached where the debt cannot be paid back.  The
government's debt is now too large in relation to the gross domestic
product.  Like what happened to everyone that has defaulted on their
mortagages the government has so much debt that it has reached the
point of no return.

4. What the government did for years was borrow money and then when
the IOU's matured they borrowed more to pay those off.  This was
basically a Ponzi scheme.    In addition to that scheme the corrupt
politicians looted social security and other funds that held cash
leaving an IOU behind.  There is no more money to loot.

5. When these bonds mature the government has to pay them off.  If
they cannot pay them off then they will default.  The United States
government has never defaulted on its bonds.  If you and I default on
our debt then that means we're bankrupt, kaput, out of business. Same
with the government.  If the government defaults then no one will
loan it any more money.  These bonds mature every quarter, March,
June, September and December.  The fall of our government will
probably come during one of these months within the next year to year
and a half.

6. If the government cannot borrow then they have one alternative.
That is to just print the money to pay off the IOU's.  It is called
monetarizing the debt.  They will have to print so much money that
the worth of a dollar will be reduced to nothing.  Too much money
chasing too few goods creates inflation, which will in all likelihood
result in a hyperinflation not seen since the pre-World War II days
in Germany.  In this scenereo the dollar will become like the
Confederate currency of old or the German mark prior to Hitler.  In
Germany they had to get a wheel barrow and fill it with money just to
go to the store for a loaf of bread.  Those that forget the past are
doomed to repeat it.  A loaf of bread could easily go to $50 or
higher.  For people on fixed incomes the burden will be
insurmountable, because their income will not go up; it is fixed. For
people on retirement, social secuity, unemployment and welfare,
clearly one fourth of their income would go for one loaf of bread.
The people will not be able to eat or purchase staples that they need.

7. If hyperinflation hits, the worth of the bonds will plumment.
Individuals, institutions and investors and foreign governments will
either sell every bond they have or risk losing everything invested.
The ones who will have to buy those bonds are banks, insurance
companies and pension funds.  As stated above, they are broke and
cannot buy the bonds.  The government bond market will fall apart,
only this time the government will not be able to bail it out.  This
will be equivilent to a run on a bank, only this will be a run on our
entire financial system.

8. Because local and county governments don't have borrowing power
they will be the first to fold.  Individual states and then the
federal government will follow into default.  If the police aren't
getting paid they won't be on the streets.  Minus law and order,
chaos, rioting, looting and other forms of lawlessness will take
place.  It will get ugly.

9. The only positive thing or silver lining is that those corrupt
politicians and lawyers that have stolen all our money from us will
find that their money is also worthless.

10. Obama's plan is a political plan, not an economic plan.  It will
be counterproductive to the economy and actually accelerate the
problems.

11. If we were to create the bank then all of our assets would be
dollar denominated.  Because of that the bank would get wiped out
along with all of the investors.  The plan was a good one but it was
based on the fact that the government would continue as a going
concern. The level of debt and the level of corruption have proved to
be too much for the system to handle. It will collapse – totally!

12. This forecast is from the same guy with the same economics
background that forecast this depression.  These forecasts are not
doomsday forecasts; they are based on basic economics 101.

13. If you have any doubt about this forecast I will ask you one
question.  Why are the Secretary of Treasury and the Chairman of the
Federal Reserve working with members of the government planning
military actions within this country and why are they making plans to
enact Martial Law?  It's simple, they used economics 101 also.  Their
conclusion has to be the same as mine.

    Everyone who has shown interest in the bank has the same thought
at heart.  They want to save the country because it has been going in
the wrong direction.  The hardest part of revolution is taking over
the government.  With no action on our part the government is going
to collapse for us.  It will create an opportuinty for us.  Or it
will create our worst nightmare.  Luck is when planning meets
opportunity.  If the people are ready they will be able to seize the
moment. If anybody has any ideas on how to make this situation work
for us then please contact me with your suggestions.  As for me, I'm
considering arming myself for the first time in my life.

It is promoting a bill for the WV state legislature to declare
(actually re-affirm) that West Virginia is a sovereign state under the
Tenth Amendment to the U.S. Constitution.

This effort appears to be an outgrowth of the recent Liberty Day event
held at WVU a few weeks ago on February 6. Certainly looks like good
work worthy of our support. I have been asked to share this with others
in the CPWV for considering a state party CPWV resolution of
endorsement.

Do you concur?

Recently stumbled across this on the West Virginia Family
Foundation's site. Some of the "CAN DO" items are SURPRISES that
would surely WAKE UP some of our state's religious leaders. THESE
NEED TO BE PROMOTED!! IMHO, much of the "May Not Do" is just via
intimidation tactics from IRS? FEC? ...I would like to see their
references for specific laws which back these up.

Church Involvement in Social Issues

What Churches May Legally Do:
Conduct non-partisan voter registration drives
Distribute non-partisan voter education materials, such as Christian
Coalition, WV Family Foundation voter guides and scorecards
Host candidate or issue forums where all viable candidates are
invited and allowed to speak
Allow candidates and elected officials to speak at church services;
if one is allowed to speak, others should not be prohibited from

1st District Vice Chairman Denzil Sloan has made arrangements for our
next state executive meeting. From his recent email:

"I have made arrangement for the next Constitution Party of West
Virginia meeting to be held at the 79er restaurant at Burnsville
[exit 79] on February 28th Saturday 1-5pm. It is understood that we
will eat there and the room is free on that condition.  - Denzil
Sloan"

CPWV officers will probably arrive around noon to eat lunch
beforehand and get the room set up.

Agenda to follow in early february

We will have:
- display table for general information, flyers, brochures
- donations table of items of interest such as relevant books, tapes,
cds, videos, etc available for acquisition for reasonable donations.
- sign-in/membership table. Remember that 2009 membership dues
renewals are due in January.

do you have around the house of interest to fellow
Constitutionalists? This is one way the party raises funds to pay the

This petitioning victory is relevant to future WV ballot access

fairs and festivals there around the state where large crowds
(potential petition signers) are present. This ruling is FEDERAL, so
it should protect us here in WV. CPWV petitioners, please make a note

Petitioning Victory from 9th Circuit
December 2nd, 2008
On December 1, the 9th circuit issued its opinion in Dietrich v John
Ascuaga's Nugget, 06-17135. The issue was whether petitioning should
still be allowed on public sidewalks, when a private organization has
rented a public square that abuts those public sidewalks. The
decision says that just because a private organization has taken
temporary control (for a day, or a weekend) of a public space, that
does not mean the public space is no longer available for First
Amendment activity.

The decision acknowledges that the private organization may have an
interest in making it plain that it is not associated with whatever
individual or group is petitioning, but says if that is a concern,
the private organization is free to post a sign saying it is not
associated with the petitioning. In this case, the petitioners were
working on a recall petition, and the public sidewalks and public
square had been temporarily rented out to the "Best in the West
Nugget Rib Cook-Off." The decision commented that it was unlikely
that any passerby would assume the recall petition is associated with
the Cook-Off.

John,
    Please enlighten us as to what the reason is behind your new
petition drive? What did they do wrong? The CPWV is in the process of
collecting election complaints from our supporters all around the
state who witnessed an absence of write-in candidate lists. State
election law 3-1-20 mandades that they be posted BOTH inside and
outside polling places on election day.
    On November 4, did you notice any missing lists?

The CPWV will hold it's 4th quarter state executive meeting on
Saturday afternoon, November 22 at the Holiday Inn in Martinsburg
(Berkeley County). The location is very easy to find, just off I-81
(exit 13, King Street) in the middle of this eastern panhandle
county.

We will set-up and have meet-and-greet / sign in from noon to 1pm.
Light refreshments will be provided.

The business portion of our meeting will be held from 1 to 5pm.

Our 2008 gubernatorial candidate, Butch Paugh, is expected to be our

As you can see, it does need to be updated. Our former webmaster
(temporarily out of retirement) will be working on this during the
week to bring you the latest Constitution Party of WV goings-on.

Later this week, please check it out and feel free to PROMOTE our
state party website.

NEWSLETTER: We would like to begin publishing a quarterly hard-copy
newsletter, nothing too sophisticated, perhaps two legal-size sheets
printed double side and folded in half to yield four pages - then
fold that in half and staple and mail.

be an important way to reach them. ***

This would be a good venue for meeting/event announcements, pertinant

access. He has people here in the Mountain State all the way from Utah

I would be really quite sad if Ralph Nader gets on the WV ballot for
this election, but we Constitutionalists fail to secure the same access

Politicians are the only people in the world who create problems and then campaign against them.
I don't ever remember a time when there has been so much unrest and discontent with the entire government in its present state.  I do this anyway because I am mean and hateful.  No, I really feel one term is enough - it is public service - so don't expect a lot of perks after your term is up - get elected, do the job - then get out.  

Have you ever wondered why, if both the Democrats and the Republicans are against deficits, we have deficits?

Have you ever wondered why, if all the politicians are against inflation and high taxes, we have inflation and high taxes?

You and I don't propose a federal budget.   The president does.

You and I don't have the Constitutional authority to vote on appropriations.   The House of Representatives does.

You and I don't write the tax code, Congress does.

You and I don't set fiscal policy, Congress does.

You and I don't control monetary policy, the Federal Reserve Bank does.

One hundred senators, 435 congressmen, one president, and nine Supreme Court justices
545 human beings out of the 300 million  are directly, legally, morally, and individually responsible for the domestic problems that plague this country.

I excluded the members of the Federal Reserve Board because that problem was created by the Congress.   In 1913, Congress delegated its Constitutional duty to provide a sound currency to a federally chartered, but private, central bank.

I excluded all the special interests and lobbyists for a sound reason.   They have no legal authority.   They have no ability to coerce a senator, a congressman, or a president to do one cotton-picking thing.   I don't care if they offer a politician $1 million dollars in cash.   The politician has the power to accept or reject it.   No matter what the lobbyist promises, it is the legislator's responsibility to determine how he votes.

Those 545 human beings spend much of their energy convincing you that what they did is not their fault.   They cooperate in this common con regardless of party.


What separates a politician from a normal human being is an excessive amount of gall
.   No normal human being would have the gall of a Speaker, who stood up and criticized the President for creating deficits.   The president can only propose a budget.   He cannot force the Congress to accept it.

The Constitution, which is the supreme law of the land, gives sole responsibility to the House of Representatives for originating and approving appropriations and taxes.   Who is the speaker of the House?   She is the leader of the majority party.   She and fellow House members, not the president, can approve any budget they want.   If the president vetoes it, they can pass it over his veto if they agree to.

It seems inconceivable to me that a nation of 300 million can not replace 545 people who stand convicted -- by present facts -- of incompetence and irresponsibility.   I can't think of a single domestic problem that is not traceable directly to those 545 people.   When you fully grasp the plain truth that 545 people exercise the power of the federal government, then it must follow that what exists is what they want to exist.


If the tax code is unfair, it's because they want it unfair.

If the budget is in the red, it's because they want it in the red.

If the Marines are in IRAQ, it's because they want them in IRAQ.

If they do not receive social security but are on an elite retirement plan not available to the people, it's because they want it that way.

There are no insoluble government problems.

Do not let these 545 people shift the blame to bureaucrats, whom they hire and whose jobs they can abolish; to lobbyists, whose gifts and advice they can reject; to regulators, to whom they give the power to regulate and from whom they can take this power.   Above all, do not let them con you into the belief that there exists disembodied mystical forces like 'the economy,' 'inflation,' or 'politics' that prevent them from doing what they take an oath to do.


Those 545 people, and they alone, are responsible.


They, and they alone, have the power.


They, and they alone, should be held accountable by the people who are their bosses provided the voters have the gumption to manage their own employees.


We should vote all of them out of office and clean up their mess!

From I-77: Take I-64 East towards Lewisburg; Exit 125-B (Airport
Road); Exit right, come around the ramp and turn right onto Airport
Rd.; Go 1.4 miles on Airport Rd and turn Right onto Industrial Park
Road; Go one (1) mile to the water tower (on the right side) and
make a quick right at Jerry's Gym (tan building on the right). EPS
is the next building down (you can see it), and is also a tan
building with white vehicles in front. Address: 706 Industrial Park
Road.

From White Sulphur Springs/Lewisburg: Take I-64 West to exit 125
Beaver and just make a right from the ramp onto Airport Rd and
follow the above directions.

Reminder that those interested in meeting for lunch will be at
Padrino's Italian restaurant at 11:30. From the I-64 Beaver exit
(see above), just go south (turn left instead) on Airport Road and

The CPWV booth at the flea market at the State Fairgrounds by
Lewisburg this past weekend was judged to be a HUGE success!! Thank
you to everyone who participated:

- the Hudok daughters (Natalie, Natasha, Olivia & ??)

- Gene Stalnaker

West Virginia Constitutionalists pieced together a very respectable
looking booth at minimal cost and maximum ingenuity at the last
minute and manned it for THREE DAYS during inclement weather.

Unfortunately no one remembered to bring a digital camera, so we only
have a couple of film photos on a disposable camera that will be
posted as soon as they are developed.

We had the party banner suspended from 7-foot poles with the 13-star
flag below it. In the middle were our blue 100% cotton party logo T-
shirts for "sale" ($20 sugg donation) donated by Aaron Mills.

Below the T-shirts and Old Glory was 10-feet of folding table and
card table covered with info and literature. A yellow Gadsden flag
hung below the table to hide our supply boxes.

Along the right side of our 10x10 indoor space were two more 2x4
tables covered with a blue/white star cloth topped by four 3-ring
binders of our signature petitions and more party literature, CDs,
candidate cards, brochures, and voter information.

Friday was semi-busy after we got set-up. Saturday was very busy
especially since the cold weather drove people inside. Sunday was not
so busy. Regardless, we collected over 400 signatures for our
candidates. Even though the deadline has passed for our state
candidates, we still need to collect thoudands more signatures to get
our presidential candidate, Chuck Baldwin http://www.baldwin2008.com
on the ballot by Friday, August 1st.

THREE DAYS of FUN talking politics with fellow Mountaineers and
promoting our candidates!!

Just a reminder to those who have already been contacted, and an FYI
and invitation to those who have not yet been:

The Constitution Party of West Virginia is pleased to announce that
the Executive Committee has authorized the expenditure of $60 to
rent a 10x10 INDOOR table space WITH power. We will have at least
two folding tables set-up with information on our candidates, party,
memberships and activities.

PLEASE BRING ANY left-over printed materials, brochures, Butch Paugh
palm cards, etc.
We will hopefully have a TV/DVD player there at least playing the
classic film, 1776.

Bring any patriotic items that you would like to display.
BRING CHAIRS !!  If you like to SIT and talk to people, THIS IS FOR
YOU.

This will be an excellent opportunity to collect signatures. Between
5,000 and 6,000 people are expected.

Please send me an email by THIS THURSDAY NOON indicating if and when
(what specific days and times) you plan to attend so that we can
coordinate keeping our booth manned by at least one person at all
times. So far, four people have indicated that they plan to attend.

On April 18, the West Virginia Constitution Party filed a federal
lawsuit to get access for its petitioners to work in Stonewall
Jackson Lake State Park. The case is Constitution Party of W.V. v
Jezioro. The party is represented by the Rutherford Institute. State
officials barred petitioning from last year's National Hunting and
Fishing Day festivities at that park, and the party hopes to prevent
that from happening again.

The party has 11,000 signatures on its statewide petition, which
carries the name of stand-in candidates for president and vice-
president, and the party's gubernatorial candidate. Since the
petition requires 15,118, the party will probably be unable to
complete the petition by the May deadline that applies to non-
presidential candidates. The petition won't be wasted, because it
can still be used for president if it is finished by August 1. West
Virginia irrationally requires petitions for office other than
president to be submitted in May, but presidential petitions are due
much later. A party remains on the ballot if it polls 1% for
Governor, though, so it is a disappointment of the party can't
qualify for the gubernatorial race.

The same outcome affected the Libertarian Party in 2004 in West
Virginia. It got on the ballot for president, but not Governor. The
party filed a lawsuit in 2004 to challenge the May deadline, in
state court, but the State Supreme Court refused to hear the case.
