Fraud and Exploitation in Homeowners Association Corporations.
According to Alan Wertheimer as regards exploitation........"To
exploit others is to take unfair advantage of them.
Although 'exploitation' has figured prominently in Marxist theories,
it is frequently invoked in ordinary and political
discourse...fraud, and consensual exploitation, where it appears
that the exploited party has given voluntary and appropriately
informed consent to the transaction."
According to HOA advocates, everything that takes place in the HOA
corporation controlled subdivisions and "Planned Unit Developments"
is consensual because at the time of purchasing their homes, the
homebuyers gave their consent to live under the dictates of the Board
of Directors and Officers, their HOA and CAI lawyers, CAMs and their
management companies, and the Covenants, Conditions, & Restrictions,
(CC&Rs) which are very often ambiguous and subject to interpretation
by the courts.
The problem with HOA homeownership is that, in most cases, "voluntary
and appropriately informed consent to the transaction" did not take
place at the time of the home purchase. This is a matter for the
Community Association Institute to address.
